CC - Minutes - 02-26-19 MINUTES OF THE CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION REGULAR JOINT MEETING FEBRUARY 26,2019 The regular meeting of the Rosemead City Council was called to order by Mayor Steven Ly at 7:07 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PLEDGE OF ALLEGIANCE was led by Council Member Low INVOCATION was led by Mayor Pro Tern Clark STAFF PRESENT: City Manager Molleda, Assistant City Manager Tsujiuchi, City Attorney Richman, Chief of Police Kusayanagi, Director of Community Development Kim, Director of Public Works Alfonso, Director of Finance Lieu, Director of Parks and Recreation Boecking, and City Clerk Hernandez 1. PUBLIC COMMENT Mayor Ly opened the Public Comment period. ASB students, Muscatel Middle School, shared about "Grand March," a month- long challenge to encourage students and adults to think about the purpose and audience in all forms of their writing (i.e. emails, texts, social media or school assignments);noted an assembly to kick-off"Grand March"will be held on March 1St, where students will compete in literacy focused games. The ASB students extended an invitation to the City Council to attend the Community Festival on March 9th,from 12 to 4 p.m.,at Rosemead Park,to celebrate literacy and the power of writing. There being no further comments, Mayor Ly closed the Public Comment period. 2. PRESENTATIONS B. Presentation Update by Joe A. Gonsalves and Son on State Legislative Advocacy Efforts Mayor Ly indicated the presentation by Joe A. Gonsalves and Son would be heard first as the presenter has an early flight to catch. Anthony Gonsalves,representing Joe A. Gonsalves and Son,noted 2,698 bills were introduced this past year; indicated Governor Brown allocated 500 million in the State's budget for planning and housing, however, explained that not all cities are the same, meaning while Rosemead is paying the same dollar on the 1% property Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Regular Joint Meeting Minutes of February 26, 2019 Page 1 of 9 tax, the City is only getting .0675 cents back; concurred housing is important, but posed the question — how can the City be expected to pay for housing when it receives less than 7 cents on the dollar? Mr. Gonsalves opined its best if the State comes up with a new system as how the money can be redistributed. Council Member Armenta congratulated Blanca and Susan Rubio for making history in becoming the first-ever two Latina women sisters elected to legislature at the same time; inquired if there is legislation being proposed that would require cities to pay PERs to contracted employees. In response to Council Member Armenta's inquiry,Mr. Gonsalves ascertained that PERs will not accept any private agencies as they must be a public agency to qualify;noted he could see legislation trying to limit a city's ability to contract with a private agency. Council Member Armenta stated sitting on the Executive Board of the Contract Cities Association, she needed to express concern as that type of legislation would bankrupt many small cities such as Rosemead;thanked Gonsalves& Son for being our advocate in Sacramento. Mayor Pro Tem Clark commended Gonsalves & Son for being at the forefront of so many issues that affect Rosemead. Mr. Gonsalves applauded the City Council for caring about their constituency; affirmed that together they will be able to work out the legislative issues at hand. A. Recognition of Congressional Gold Medal Act Enacted to Pay Tribute to Chinese- American World War II Veterans Sharon Wong, President, Chinese-American Citizens Alliance of the Greater San Gabriel Valley Lodge, stated the Citizens Alliance purpose is to protect the civil liberty of Chinese-Americans; thanked the City Council for recognizing their efforts in securing the passage of the Chinese-American Act. John Wong,Chinese-American Citizens Alliance of the Greater San Gabriel Valley Lodge, provided history of the Congressional Gold Medal Act enacted to pay tribute to Chinese-American World War II Veterans. Mayor Ly presented a Certificate of Recognition to the Chinese-American Citizens Alliance of the Greater San Gabriel Valley Lodge in recognition of the Congressional Gold Medal Act enacted to pay tribute to Chinese-American World War II Veterans. Mr. Wong requested the City's assistance in determining whether Rosemead has residents that were Chinese-American World War II Veterans so that gold medals could be presented to those individuals. Claims and Demands • Resolution No. 2019-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $1,195,059.37 NUMBERED 102450 THROUGH NUMBER 102535 INCLUSIVELY Recommendation: Adopt Resolution No. 2019-11. • Resolution No. 2019-02 SA A RESOLUTION OF THE CITY OF ROSEMEAD, CALIFORNIA, AS THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN 111 THE SUM OF $514,219.00 NUMBERED 10256 THROUGH 10259 INCLUSIVELY Recommendation: Adopt Resolution No. 2019-02 SA. B. Approval of Minutes Recommendation: That the City Council approve the regular meeting minutes of September 25, 2018. C. Crosswalk Installation at Jay Imperial Park (Project No. 28011) and Sidewalk Replacement(Project No. 24008)—Award of Contract As part of the City's Fiscal Year 2018-19 Budget, the City Council approved the Capital Improvement Program that included the Crosswalk Installation and Sidewalk Replacement Projects. In order to attract more bidders,the City Engineer combined the two projects into a single project, prepared bid specifications, and advertised the project for bids on January 10, 2019. On February 6, 2019, staff received five bids and is recommending the award of contract to FS Contractors Inc., of Sylmar, in the amount of$100,090. Recommendation: That the City Council take the following actions: Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Regular Joint Meeting Minutes of February 26, 2019 Page 3 of 9 1. Authorize the City Manager to execute a contract with FS Contractors Inc., in the amount of$100,090 for the Crosswalk Installation at Jay Imperial Park and Sidewalk Replacement Projects; 2. Authorize the Director of Public Works to approve change orders up to$10,000 (up to 10% of contract amount) for these projects; and 3. Take such additional, related action that may be desirable. D. Installation of Red Curb at 8622 Garvey Avenue On February 7, 2019,the Traffic Commission considered a request for installation of red curb at 8622 Garvey Avenue. Upon reviewing the letters received from two business owners at 8622 Garvey Avenue and hearing their testimony and staffs analysis, the Commission concurred with staff's recommendation to install 15 feet of red curb immediately west of the driveway serving the property. The red curb will improve visibility for oncoming traffic and provide relief for the business owners and their patrons exiting the driveway. In accordance with the City's Curb Marking Policy, staff is requesting Council's approval of the red curb installation at 8622 Garvey Avenue. Recommendation: That the City Council approve the installation of 15 feet of red curb immediately west of the driveway located at 8622 Garvey Avenue in order to improve visibility for oncoming traffic;and take such additional,related action that may be desirable. ACTION: Moved by Council Member Low and seconded by Council Member Dang to approve Consent Calendar Items A, C, D. Motion was carried out by the following vote AYES: Armenta, Clark,Dang,Low,Ly ABSENT: None It came to Mayor Ly's attention that Council Member Armenta inadvertently requested the incorrect Consent Calendar Item to be pulled for separate discussion; Ms. Armenta meant to pull Item No. 4C, not Item No. 4B. ACTION: Moved by Council Member Armenta and seconded by Mayor Pro Tern Clark to reverse the approval of Consent Calendar Items A, C,D. Council Member Armenta noted she pulled this item in effort to be transparent with residents by providing a timeline of when the City anticipates completion of the project. Director of Public Works Alfonso affirmed now that the City is awarding the contract, our goal is to complete the work by April. ACTION: Moved by Council Member Armenta and seconded by Council Member Low to take the following actions: 1. Authorize the City Manager to execute a contract with FS Contractors Inc., in the amount of$100,090 for the Crosswalk Installation at Jay Imperial Park and Sidewalk Replacement Projects; 2. Motion was carried out by the following vote AYES: Armenta, Clark, Dang, Low, Ly ABSENT: None 5. MATTERS FROM CITY MANAGER & STAFF A. Fiscal Year 2018-19 Mid-Year Budget Review Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Regular Joint Meeting Minutes of February 26, 2019 Page 5 of 9 The City Council will consider adjustments to the Fiscal Year 2018-19 adopted Budget. During the Fiscal Year, unforeseen financial needs and opportunities typically arise, which require Council approval of recommended adjustments to projected revenues and expenditures. At this time, there are several items that require appropriations as well as projected revenue adjustments. Recommendation: That the City Council take the following actions: 1. Receive and file the Mid-Year Budget Review and related reports; and 2. Approve Resolution No. 2019-10, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA,APPROVING VARIOUS APPROPRIATIONS FOR FISCAL YEAR 2018-19 Director of Finance Lieu indicated there is a cost saving of$254,000 in the General Fund from the reallocation of CDBG to fund the Garvey Park Restroom Renovation Project; noted the total General Fund appropriation of $210,500 is offset by the General Fund cost saving and the net impact is a reduction to the General Fund expenses of$43,500.Ms.Lieu ascertained that an increase in General Fund revenue of$387,000 is anticipated as staff reassessed revenue projections when the budget was adopted, which included increased property tax, sales tax, county grants, 111 Parks and Recreation revenues and other Building fees. Director of Finance Lieu affirmed a positive impact of $431,000 to the General Fund operating budget; while staff is requesting additional appropriations, there will be no adjustments to special revenue funds. Ms. Lieu further stated as a result, there will be a negative impact of$247,767 to the CDBG funds, $455,037 to HOME funds, and $130,000 to the Proposition C fund. Council Member Armenta thanked Director of Finance Lieu for preparing the budget with a fine-tooth comb; inquired how much money has the City saved in CDBG funds since staff corrected the misallocation of funds last year. Director of Community Development Kim affirmed the City was not spending the CDBG funds for various activities as we could have; however, staff was able to correct that concern through the substantial amendment to the Annual Action Plan and funding of our Public Works Activity Center. Council Member Armenta commended Director of Community Development Kim for his diligence in correcting the shortchange to the City and finding ways to properly allocate money into more projects while having the City's best interest in mind and keeping the City's resources well-kept and guarded. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Regular Joint Meeting Minutes of February 26, 2019 Page 6 of 9 Director of Community Development Kim acknowledged it was a team effort and expressed appreciation to City Manager Molleda and his fellow Department Heads for their continuous support. Approval of First Amendment to City Manager Employment Agreement Recommendation: That the City Council take the following actions: 1. Approve the First Amendment to the City Manager Employment Agreement granting a 5% salary increase to the City Manager; and 2. Approve an additional 3.5% salary increase this year and an additional 3.5% increase next year to the City Manager's salary as a step to begin to make her current salary more reflective of and competitive with the labor market for city managers. City Attorney Richman stated the City entered into an Employment Agreement with the City Manager on January 16, 2018; indicated pursuant to Section 3 (a)(ii) of the Agreement, the City Council conducted the City Manager's performance evaluation,where she received a"Substantially Exceeds Expectations"review with a 5 rating. A "Substantially Exceeds Expectations" review entitles the Council to grant the City Manager a 5%salary increase,which would bring the City Manager's total annual salary to $199,500. Ms. Richman informed the City Council that they are also being asked to consider an additional 3.5% salary increase to the City Manager's salary to help close the gap between her current salary and the current labor market in the area. City Attorney Richman noted in 2017,a salary survey was conducted in which results indicated that the City Manager's compensation is 17.3% behind the labor market; ascertained an additional 3.5% increase this year would bring the City Manager's total annual salary to $206,150. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Regular Joint Meeting Minutes of February 26, 2019 Page 7 of 9 Council Member Low clarified after Council approves the additional 3.5%increase for this year,the City Manager's current salary will close the gap to approximately 8-9%below the market value,and the following year would be dependent upon her evaluation per the Agreement. In response to Council Member Dang's inquiry, Mayor Ly explained the City of South El Monte was not included in the 2017 salary survey conducted as it was not part of the neighboring cities that Management agreed upon with the Employee Association negotiations. Council Member Dang concurred with Council Member Armenta that South El Monte is incomparable in size to Rosemead. The City Council commended City Manager Molleda for her diligence; stated she is very deserving of this salary increase. ACTION: Moved by Council Member Armenta and seconded by Council Member Low to take the following actions: 1. Approve the First Amendment to the City Manager Employment Agreement granting a 5% salary increase to the City Manager; and 2. City Council Comments Mayor Pro Tern Clark indicated she was not able to attend the February 13th City Council Meeting as she was in Sacramento for SCAG's legislative tour; objected to legislatures' indication that it is the City's responsibility to build housing; emphasized the City does not build the housing, rather the City zones for it; expressed frustration that the legislatures took away the redevelopment tools that enabled cities to build low income housing; implored legislature to give the City more redevelopment tools instead of falsely casting blame. Council Member Dang expressed appreciation to City Manager Molleda, Director of Community Development Kim, and Director of Finance Lieu for their effort. Mayor Ly congratulated staff on their hard work and ensuring its fruition; thanked the audience for attending the City Council meeting and the residents at home for watching. 7. ADJOURNMENT Mayor Ly adjourned the regular meeting at 8:21 p.m., and reconvened to the special meeting at 8:26 p.m.,in the City Hall Conference Room.The regular City Council meeting of March 12, 2019 is cancelled due to lack of quorum.
