NIB No. 2020-03 - Garvey Park Gym Cooling Additions - Project No. 31019 CITY OF ROSEMEAD NOTICE INVITING BIDS NIB No. 2020-03 NOTICE IS HEREBY GIVEN that the CITY OF ROSEMEAD, California, will receive sealed bids up to 10:30 o’clock a.m. on Wednesday, the 18th day of March, and they will be publicly opened at 11:00 a.m. for GARVEY PARK GYM COOLING ADDITION PROJECT No. 31019 The project consists of the installation of cooling addition of the existing Garvey Park Gym building located at 7933 Emerson Place, Rosemead, CA 91770 and consists of new cooling system, electrical, fixtures, framing, and landscaping as indicated in the appendix and other related work as described in the Plans, Specifications, and Contract Documents, by this reference, made a part hereof. The engineer’s estimate for this project is $240,000. The successful bidder shall have SIXTY (60) working days to complete the work. Liquidated damages shall be $500.00 per working day. Plans, Specifications, and Contract Documents may be obtained at the office of the City Clerk of the CITY OF ROSEMEAD, 8838 E. Valley Boulevard, Rosemead, California 91770, (626) 569-2177, for a non-refundable charge of $25.00 and $40.00 if mailing is requested. All prospective bidders must register with the office of the City Clerk’s in order for your bid to be considered responsive. SB 854 Requirements: This project is subject to the requirements of SB 854. No prime contractor or subcontractor may be listed on a bid proposal for a public works project unless registered and qualified with the Department of Industrial Relations pursuant to Labor Code section 1725.5. No prime contractor or subcontractor may be awarded a contract for public work on a public works project unless registered and qualified with the Department of Industrial Relations pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. The bid proposal must include a print out from the DIR registration website showing that the prime contractor and each subcontractor is currently registered and qualified. No bid proposals will be accepted nor any contract entered into with a prime contractor without proof of registration as required above. No bidder may withdraw his bid for a period of sixty-one (61) days after the above bid opening date. FEDERAL CONTRACT PROVISIONS FOR COMMUNITY DEVELOPMENT BLOCK GRANT Prevailing Wages Statement: “This project is funded in whole or in part with Community Development Block Grant (CDBG) funds provided by the U.S. Department of Housing and Urban Development (HUD). Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts will be enforced.” The current Federal Wage Decision” is the one in effect 10-days prior to the bid opening date and can be found on-line at http://www/dol.gov. In the event of a conflict between Federal and State wage rates, the higher of the two will prevail.” Payrolls and basic records. Payrolls and basic records relating thereto shall be maintained by the contractor during the course of the work preserved for a period of five (5) years thereafter for all laborers and mechanics working at the site of the work. The contractor or subcontractor shall make the records required under subparagraph A.3.(i) of HUD 4010 available for inspection, copying, or transcription by authorized representatives of HUD or its designee or the Department of Labor, and shall permit such representatives to interview employees during working hours on the job. If the contractor or subcontractor fails to submit the required records or to make them available, HUD or its designee may, after written notice to the contractor, sponsor, applicant or owner, take such action as may be necessary to cause the suspension of any further payment, advance, or guarantee of funds. Furthermore, failure to submit the required records upon request or to make such records available may be grounds for debarment action pursuant to 29 CFR 5.12. Conflict of Interest Statement: No employee, officer or agent of the sub-recipient shall participate in selection, or in the award administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved. Refer to: 24 CFR 85.36 [Non-Profit Organizations – 24 CFR 84.4], OMB Circular A-110, and 24 CFR 570.611, respectively, shall apply. Section 3 Statement: This is a HUD Section 3 covered construction contract. A bid preference may be given to a bidder who provides a reasonable bid (within the Zone of Consideration) and is a qualified Section 3 Business Concern. Federal and State Contractor Eligibility Check: Prior to awarding a contract, contractor verification will be performed through the California Department of Industrial Relations at http://www.cslb.ca.gov, http://efiling.dir.ca.gov, and eligibility at http://www.dir.ca.gov/dsle/debar.html and excluded parties list at the federal System for Award Management (SAM) website http://www.sam.gov. The CITY OF ROSEMEAD will affirmatively ensure the disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, disability, sex or national origin in the consideration for an award. Any contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wage and apprenticeship employment standards established by the State Director of Industrial Relations will be required. Bidders shall be licensed in accordance with the provision of Chapter 9, Division 111 of the Business and Professions Code of the State of California. Bidder shall have a Class “B” license in good standing at the time Bids are received. Retention of Records Relevant to Audits and Reviews: The Contractor and subcontractors working in the City of Rosemead must retain records pertaining to said project for a minimum of five (5) years. Record to be retained include but not limited to documents regarding payroll, change orders, field directives, as-built plans, etc. The Council reserves the right to reject any and all bids and to waive any informality, technical defect, or minor irregularity in any bid submitted. An award of service shall not be final until the bids have been reviewed and a Contract Agreement with the City has been signed by the lowest responsible bidder and by the City.
