RESOLUTION 2020-08
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
PROCLAIMING THE EXISTENCE OF AN EMERGENCY SITUATION AND LOCAL
EMERGENCY DUE TO THE WORLDWIDE SPREAD OF THE CORONAVIRUS
(COVID-19)
WHEREAS, California Government Code section 54956.5 authorizes the City
Council to hold emergency meetings on shortened notice to address emergency
situations as determined by a majority of the City Council; and
WHEREAS, the California Emergency Services Act (California Government
Code sections 8630, 8550, et. seq.) defines a local emergency as to the existence of
conditions of disaster or of extreme peril to the safety of persons and property within the
territorial limits of a city, caused by conditions such as an epidemic, which are or are
likely to be beyond the control of the services, personnel, equipment, and facilities of a
city, and require the combined forces of other political subdivisions to combat
WHEREAS, Title 2, Chapter 2.40, Section 2.40.060 of the Rosemead Municipal
Code authorizes the City Manager to request the City Council to proclaim the existence
of a local emergency if the Council is in session.
WHEREAS, Novel Coronavirus 2019 (COVID-19) is a new communicable
disease, was first detected in Wuhan City, Hubei Province, China in December 2019.
COVID-19 has since spread globally. Symptoms of the virus include fever, cough, and
shortness of breath, and infected individuals have experienced a range of outcomes,
from mild sickness to severe illness and death.
WHEREAS, on March 11, 2020, the World Health Organization declared the
COVID-19 outbreak a pandemic, which means a global epidemic.
WHEREAS, on March 4, 2020, the State of California declared a State of
Emergency in an effort to aid in the prevention and mitigation of the effects of the
COVID-19.
WHEREAS, on March 4, 2020, the County of Los Angeles also declared a State
of Emergency in an effort to prevent the further spread of COVID-19 throughout the
County of Los Angeles.
WHEREAS, the counties of Orange, Santa Clara, San Diego, Sonoma, and the
city and county of San Francisco have each declared local health emergencies and
proclaimed local emergencies.
WHEREAS, on March 13, 2020, the President of the United States issued an
emergency declaration relating to the widespread transmission of COVID-19.
WHEREAS, to combat the spread of COVID-19, many local agencies have
declared local health emergencies to provide their governmental organizations with the
procedural flexibility and tools needed to procure additional equipment, materials and
supplies and to modify the delivery of public services and gatherings in ways that follow
and support the advice of public health officials.
WHEREAS, the mobilization of local resources, ability to coordinate interagency
response, accelerate procurement of vital supplies, use of mutual aid, and follow for
future reimbursement by the stand and federal governments will be critical to
successfully responding to COVID-19.
WHEREAS, in response to the COVID-19 outbreak, the City reasonably
anticipates that it will be required to use resources to take action to limit the outbreak,
provide for the safety of persons in the City as well as its employees, and provide for
continuity of the essential services provided by the City.
NOW THEREFORE, BE IT RESOLVED AND PROCLAIMED THAT:
A.That the above recitals are true and correct and based thereon, hereby
finds that the spread and potential further spread of COVI D-19 constitutes a situation
that severely impairs the public health and safety within the City of Rosemead and
constitutes conditions of extreme peril to the safety of persons and property within the
City of Rosemead.
B.That, as authorized in Government Code Sections 8630 and 54956.5 and
Chapter 2.40 of the Rosemead Municipal Code and based on the foregoing, an
"emergency" as defined in Government Code section 54956.5(a) and Rosemead
Municipal Code section 2.40 and also a "local emergency" as defined in Government
Code section 8558(c) hereby exists within the territorial jurisdiction of the City of
Rosemead and is deemed to continue to exist, and shall be reviewed at least once
every 60 days, until its termination is proclaimed by the City Council of the City of
Rosemead.
C.That the City Manager, as the Director of Emergency Services, is hereby
authorized to exercise her powers and duties as provided in Chapter 2.40 of the
Rosemead Municipal Code or in state and federal laws.
PASSED, APPROVED, AND ADOPTED this 13th day of March, 2020.
