CC - 08-26-59 - Adjourned Meeting• • 0 CITY OF ROSEMEAD ROSEMEAD, CALIFORNIA August 262 1959 An adjourned regular meeting of the City Council of the City of Rosemead was held in the City Hall, 3964 North Rosemead Boulevard. • The meeting was called to order by Mayor Stead at 8:00 p.m. 1. The pledge of allegiance was lead by Mayor Stead. 2. Present: Councilmen Buchanan, Cook, Lowrey, Stead, Williamson. Ex officio: Woollett, Judge, Stump, Armstrong. Absent; None. 3. It was moved by Lowrey, second by Cook, and unanimously carried that minutes of the regular meeting of August 19, be approved. 4. 'ORDINANCE NO. 3 AMENDING MUNICIPAL CODE PROVIDING FOR THE ESTABLISH- MENT OF A PLANNING COMMISSION. ( 2nd Reading) AN ORDINANCE OF THE CITY OF ROSEMEAD ADDING CHAPTER 5 TO ARTICLE II OF THE ROSEMEAD MUNICIPAL CODE AND PROVIDING FOR THE ESTABLISffiAENT OF PLANNING COMMISSION FOR THE CITY OF ROSEMEAD. It was moved by Lowrey, second by Cook, and unanimously carried that Ordinance 3 be read by title only. It was moved by Lowrey, second by Cook, that Ordinance No. 3 pass the second reading and be approved. Roll call vote as follows: Ayes: Buchanan, Cook, Lowrey, Stead, Williamson. Noes: None. Absent: None. 5. ORDINANCE NO. 4 AMENDING MUNICIPAL CODE PROVIDING REGULATIONS AND PROCEDURES FOR THE PURCHASE AND SALE OF SUPPLIES, SERVICES AND EQUIPMENT. (2nd Reading) AN ORDINANCE OF THE CITY OF ROSEMEAD AMENDING THE MUNICIPAL CODE BY PROVIDING REGULATIONS AND PROCEDURES FOR THE PURCHASE AND SALE Or SUPPLIES, SERVICES AND EQUIPMENT. It was moved by Cook, second by Buchanan, and unanimously carried, that Ordinance No. 4 be read by title only. Absent: None. 6. RESOLUTION NO. '1-~ ENDORSING THE STATE REAPPORTIONMENT PLAN ADVOCATED BY SUPERVISOR FRANK G. BONELLI. Motion to table this resolution in order to study it further was made by Lowrey, second by Cook. Roll call vote as follows: Ayes: Buchanan, Cook, Lowrey, Stead, Williamson. Noes: None. Motion was made by Cook, second by Buchanan, and carried unanimously that this communication be filed. 15, TIME RESERVED FOR THOSE IN THE AUDIENCE WHO DESIRE TO ADDRESS THE COUNCIL. Kirk Schulkey, 9122 East Whitmore Street, wished to know if any action had been taken concerning his complaint of last week, regard- ing the construction of a factory on property which has been annexed to the City of E1 Monte, but will be using a residential street within the incorporated city limits of the City of Rosemead as its only means of access. Attorney James Judge stated that the City of Rosemead has some regulation of the roadways in the city but cannot prohibit use of roads. W. N. Haglund, 9134 East Whitmore Street, wanted to know if the Council had any information as to how the sewers and driveways would • be laid out for this factory. Mr. Haglund stated that this property was annexed by the City of E1 Monte in March of 1958 and that residents of the area received no notice of any change of zone. Attorney James Judge informed Mr. Haglund that the City Attorney was not the one to handle a question of the legality of the change of zone, _that a private attorney would have to be consulted. Mr. Haglund then asked what could be done if the factory created a public nuisance. Attorney Judge informed Mr. Haglund that the City of Rosemead has • no jurisdiction over a public nuisance in the City of E1 Monte. Motion was made by Lowrey, second by Cook, and unanimously carried 'P that the CA be instructed to investigate the various aspects of this problem. Mr. Haglund wished to know how soon he could expect to be informed of the findings of the CA. CA stated he would have a report at the next meeting of the City Ccuncil. -21- Victor Bonito, 9116 East Whitmore Street, stated that his children attend Potrero School at the present time and wished to know if there would be any change in the school districts due to incorporation. Mr. Bonito was informed by Councilman Lowrey that school districts are not affected in any way by incorporation. rrank Foster, 8603 Zerelda Street, stated that there is a real problem in the Council Chambers. The audience is unable to hear with the air • cooler on and unable to stay in the room with the cooler off. The Council stated that they will try to speak louder. MATTERS FROM CITY OFFICIALS. Motion was made by Cook, second by Lowrey, that the Attorney be instructed to draw up an ammendment to Ordinance 1, altering the hours of the City Hall, by closing from 12:00 noon until 1:00 p.m.. Carried unanimously. Motion was made by Lowrey, second by Buchanan, and carried unanimously that the meeting dates for the Council be changed from the 1st and 3rd 8 Wednesday to the 2nd and 4th Wednesday of each month. The attorney was instructed to draw up the necessary ammendment to Ordinance 1. Mayor Stead thanked the American Legion, John Guess Post for lending their chairs for our first Council meeting and the DuBois Funeral Home for lending their chairs for our meeting tonight. Mayor Stead also thanked Oscar Randall for his kindness in moving the chairs back and forth in his pick-up truck. CA reported receipt of another communication from the Boundary Commission, County of Los Angeles, which arrived to late to be placed on the agenda. The Boundary Commission notification concerned E1 Monte Annexation No. 202. Motion was made by Lowrey, second by Cook, and carried unanimously that this communication be filed. CA read a letter of resignation from Councilman B. A. Williamson, who stated he has accepted employment which makes it necessary for him to move from the County, therefore making his resignation necessary. He stated he wished this resignation to take effect as soon as possible and not later than September 21, 1959. y Motion was made by Cook, second by Lowrey, and carried unanimously that this letter be received and filed until further action. CA advised the Council of a communication from Jack H. Wilsford, .)o63 North Gaydon Avenue, and Gerald F. O'Neill, 3658 North Gaydon Avenue requesting permission to circulate petitions for annexation to the City of Rosemead. Motion was made by Lowrey, second by Cook, and carried unanimously that this request be read by title only. is RESOLUTION NO. 43 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS "PORTION OF TRACT NO. 12491° Motion was made by Lowrey, second by Cook, that Resolution No. 43 be approved. Roll call vote as follows: Ayes: Buchanan, Cook, Lowrey, Stead, Williamson. Noes: None. Absent: None. . CA advised the Council that communications had been received from two accounting firms. Motion was made by Cook; second by Lowrey that the CA make a decision 9 as to the services and qualifications of the two firms and be author- ized to hire the firm of his choice. Roll call vote as follows: Ayes: Buchanan, Cook, Lowrey, Stead, Williamson. Noes: None. Absent: None. CA introduced Ed Ferraro of the County-City Coordinators Division of Los Angeles County. -3- • Mr. Ferraro spoke briefly on the functions of his office and thanked the Council for allowing him the opportunity to do so. Lieutenant Don Mead, Temple City Sheriff's Station, stated that Sergeant Kingsman of the License Detail has reported 172,1yusinesses within the city limits which require licensing. He further stated that the Sheriff's Department is pleased to be the law enforcement agency for the City of Rosemead and that the Department will be happy to appear and answer questions at any time. The Department feels the Council should give some thought to licensing and its enforcement within the Rosemead area. Motion was made by Cook, second by Lowrey, and carried unanimously that the CA be instructed to study the license situation with assistance from the City Attorney.
