AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD DECLARING A MORATORIUM ON THE
ESTABLISHMENT OF THEATRE AND AMENDING THE
ROSEMEAD MUNICIPAL CODE.
The City Council of the City of Rosemead does orda.in:as follows:
SECTION 1. Notwithstanding the provisions of Article IX,
Chapter I of the Rosemead Municipal Code, no theatre or auditorium
in which motion or moving pictures are exhibited for which a fee
or other consideration is charged, received, or collected, shall
be constructed, established, or maintained, in any zone., without
a Conditional Use Permit granted pursuant to Part XXIV;of Article
IX, Section 1.
SECTION 2. Section 9111.1 of the Rosemead Municipal
Code is amend- ed-Fy--deleting therefrom Item 39 as follows:
• "39. Theatres or auditoriums (except drive-in
theatres)."
SECTION 3. Section 9124.2 of the Rosemead Municipal
Code is amende Fy adding Item 18 to read:
"18. Theatres or auditoriums in the C-3 and M Zonez.
SECTION 4. The Planning Commission of the City of
Rosemead is commencing study of the provisions of the Zoning
Ordinance of the City affecting the use of property for theatres
or audi"toriums in which moving or motion pictures are exhibited
for compensation to determine the proper regulations for the
location and operation thereof. The location or establishment
of such uses in the City is imminent and unless this ordinance
shall take immediate effect, will be established in potential
conflict with the regulations to be promulgated upon completion
of such study, thereby creating conflicting land uses and
adversely affecting property values and the public health,
safety, and welfare. This ordiance is therefore an urgency
and temporary interim ordinance, shall be effective immediately
upon adoption, and shall be effective for a period of ninety days.
