CC - 2002-16 - Approving Planned Development review 01-01 at 3675 Rosemead Blvd6 RESOLUTION 2002-16 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING PLANNED DEVELOPMENT REVIEW 01-01 FOR THE DEVELOPMENT OF A PARKING AREA FOR PASSENGER VANS AS PART OF AN AUTOMOTIVE RENTAL BUSINESS, LOCATED AT 3675 ROSEMEAD BOULEVARD IN THE P-D; PLANNED DEVELOPMENT ZONE. (APN: 5390-017-080). WHEREAS, Ming-You Product Corporate DBA Rent-4-Less of 1412 Annadel Avenue, Rowland Heights, California 91748 has submitted a planned development review application for development of a parking area for passenger vans as part of an automotive rental business in the P-D; Planned Development Zone located at 3675 Rosemead Boulevard on December 20, 2001; and WHEREAS, 3675 Rosemead Boulevard is located in the P-D; Planned Development zone; and WHEREAS, Sections 65800 & 65900 of the California Government Code and Chapter 17.16 of the Rosemead Municipal Code authorize the City Council to approve, conditionally approve or deny planned development reviews; and WHEREAS, Section 17.76.070 of the Rosemead Municipal Code (RMC) specifies the criteria by which a planned development review may be modified; and WHEREAS, on March 14, 2002, 36 notices were sent to property owners within a 300-foot radius from the subject property, in addition to notices posted in 12 public locations, specifying the availability of the application, plus the date, time and location of the public hearing for Planned Development Review 01-01; and WHEREAS, on March 26, 2002, the City Council held a duly noticed and advertised public hearing to receive oral and written testimony relative to Planned Development Review 01-01; and WHEREAS, the Rosemead City Council has sufficiently considered all testimony presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead as follows: SECTION 1. The City Council HEREBY DETERMINES that this activity is exempt from further CEQA review under section 15304 of CEQA, which exempts projects that consist of minor alterations in the conditions of the land, such as grading, gardening, and landscaping that do not affect sensitive resources. • Resolution No. 2002-16 Rosemead City Council March 26, 2002 SECTION 2. The City Council HEREBY FINDS AND DETERMINES that facts do exist to justify approving Planned Development Review 01-01 according to criteria of Section 17.116.01 of the Rosemead Municipal Code as follows: A. Whenever the public necessity, convenience, general welfare or good zoning practice justifies such action, the City Council or City Council, upon its own motion, or upon the verified application of one or more owners, or of a public or private agency that is or will be a plaintiff in eminent, domain with respect to property affected by such zoning or regulation, may initiate proceedings to change any zone or regulation, established by this title. FINDING: Based on the above discussion, staff feels that the proposed development is appropriate, given its location, proposed operating hours and floor plan, and would not be detrimental to the surrounding properties and land uses in the general area. In addition, the applicant has expressed their intent to provide site improvements that will increase visibility and beautify the existing area. Though staff finds no foreseeable negative impacts to the adjacent neighborhood with this requested use, conditions have been incorporated to address possible issues related to the proposed business. The existing site has already been developed as a parking area, which is appropriate to the requested land use. Since this area is underutilized and considering the extensive site improvements proposed, this development request would integrate suitably with the intent of the present planned development and the surrounding land uses. SECTION 3. The City Council APPROVES Planned Development Review 01-01, for development of a parking area for passenger vans as part of an automotive rental business in the P-D; Planned Development Zone, on property located at 3675 Rosemead Boulevard, subject to conditions listed in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 4.
