CC - 2002-10 - Representation on Board of The San Gabriel Basin Water Quality Authorityso RESOLUTION NO. 2002 - 10 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CASTING ITS VOTES FOR COUNCILMEMBER MIKE MILLER TO REPRESENT CITIES WITHOUT PUMPING RIGHTS, AS ALTERNATE MEMBER, ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY WHEREAS, the San Gabriel Basin Water Quality Authority is governed by a Board of Directors composed of seven (7) members, one of which is elected by cities with pumping rights in the San Gabriel groundwater basin, and one of which is elected by cities without pumping rights in the basin (city members); and WHEREAS, at the election for each city member, the candidate receiving the second highest number of votes is elected alternate member to serve in the place of the city member when that member is absent from a meeting or when the member's office becomes vacant, until a successor is elected; and WHEREAS, in order to be eligible to hold office as a city member or alternate city member of the San Gabriel Basin Water Quality Authority Board of Directors, a nominee must be an elected member of the city council of the city with pumping rights or a city without pumping rights, respectively; and WHEREAS, on or about October 12, 2001, Assembly Bill 152 (Chapter 259 of the Statutes of 2001) amending the San Gabriel Basin Water Quality Authority Act, was signed into law by Governor Gray Davis; and WHEREAS, Assembly Bill 152 states that if a city member or alternate city member ceases to be a city council member during his or her tenure on the San Gabriel Basin Water Quality Authority Board of Directors, the seat on the Board occupied by that member shall be deemed vacant; and WHEREAS, alternate city member Richard Melendez, representing cities without pumping rights, has ceased to be a city council member; and WHEREAS, the Board of Directors of the San Gabriel Basin Water Quality Authority has called a special election for the purpose of filling the vacancy in the office of alternate city member for cities without pumping rights; and WHEREAS, the City of Rosemead is one of the cities in the San Gabriel Basin without prescriptive water pumping rights, entitled to vote for city member representing cities without pumping rights; and WHEREAS, the City of Rosemead may cast its vote for the office of alternate city member of the San Gabriel Basin Water Quality Authority representing cities without pumping rights by resolution delivered to the Authority no later than March 4, 2002, at 5:00 p.m. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSMENAD DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1. The City Council of Rosemead casts its full votes for Councilman Mike Miller, an elected member of the City Council of West Covina, as alternate member of the San Gabriel Basin Water Quality Authority representing cities without pumping rights. PASSED, APPROVED AND ADOPTED THIS ATTEST: CITY CLERK I, Nancy Valderrama, City Clerk of the City Council of the City of Rosemead, do hereby certify that the foregoing Resolution was duly adopted at the Regular Meeting of the City Council on the 12'h day of February, 2002, by the following vote to wit: YES: BRUESCH, TAYLOR, IMPERIAL, CLARK, VASQUEZ NO: NONE ABSENT: NONE ABSTAIN: NONE NANCY VALUE MA, CITY CLERK L~] BALLOT L ELECTION OF ALTERNATE BOARD MEMBER FROM CITIES WITHOUT PUMPING RIGHTS TO THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY CITY: ROSEMEAD NUMBER OF VOTES TO BE CAST: 5 TO THE CITY COUNCIL: The following candidates have been duly nominated by qualified cities for the office of city member and alternate of the Board of the San Gabriel Basin Water Quality Authority ("the Authority") from cities without pumping rights. The election of the city member and alternate will take place at the regularly scheduled meeting of the Board of the Authority set for March 5; 2002, at 5:00 p.m., at 858 Oak Park Road, Suite 200, Covina, California. Your city may cast its votes for one candidate by resolution of the city council. The number of votes to which your city is entitled, based upon population, is set forth above. All your city's votes must be cast for only one candidate. The resolution of the city council casting its votes must be delivered to the Authority at least 24 hours before the meeting of the Board of the Authority at which the election of the city member and alternate will take place or the votes will not be counted. This Ballot may accompany the resolution of the city council casting its votes for city member and alternate from cities without pumping rights. 0 0
