The regular meeting of the Rosemead City Council was called to order by Mayor Imperial at
8:30 p.m. in the Council Chambers of the City Hall, 8838 E. Valley Boulevard, Rosemead.
California.
The Pledge to the Flag was led by Councilman Nunez.
The Invocation was delivered by Mayor Pro Tern Taylor.
ROLL CALL OF OFFICERS:

APPROVAL OF MINUTES: None
PRESENTATIONS:
A proclamation commemorating the end of the Vietnam War thirty years ago was
presented to Frank Yeh, President of the -Indo-Chinese American Political Action Committee.
Wal-Mart's donation of $14,000 to Rosemead High School will be used towards the
purchase of electronic scoreboards. It was presented to the School Principal and team members.
ORAL COMMUNICATIONS FROM THE AUDIENCE
Jim Flournoy, 8655 Landis View, Rosemead, stated that a policy decision needs to be
made regarding the Alhambra Wash earthquake fault. Mr. Flournoy addressed the horizontal
and vertical faults that run through Rosemead and for the City's general planning purposes and
disaster mitigation plans, a structural engineer needs to know what parameters to work within for
building a safe structure.
Mayor Pro Tern Taylor requested the following.to be verbatim:
Mr. Taylor: Mr. Flournoy, I have a question that I need to ask you personally?
Mr. Flournoy: Sure ask away.
Mr. Taylor: Were you in favor of Rosemead having it's own police department?

Mr. Flournoy: It's own police department. I haven't looked into that at all.
Mr. Taylor: Were you aware of the urgency ordinance to put a stop to the Wal-Mart store
by passing a required, a four vote moratorium?
Mr. Flournoy: I don't know about a four vote moratorium.
Mr. Taylor: You know nothing about that? Did you give a letter to Mr. Don Wagner
stating that you did not know about those two items?
Mr. Flournoy: I did not know about that item till I read it in paper.
Mr. Taylor: No, No. But, did you give him a letter with your name on it stating that you
didn't?
Mr. Flournoy: I probably did.
Mr. Taylor: Okay. That is what I needed to clarify.
Mr. Flournoy: That was a draft though.
Mr. Taylor: It came from you and it wasn't somebody that just dropped it off.
Mr. Flournoy: No.
Mr. Taylor: Did Mr. Imperial send you a letter asking you to verify that you did that?
Mr. Flournoy: I came in and saw Mr. Imperial about that.
Mr. Taylor: Okay, because there has been, you did not respond to it in other words, he
wanted to make sure that you were one of the authors of the draft letter.
Mr. Flournoy: Right, I was the total author of that draft letter- That was only a draft.
Mr. Taylor: Okay. But there was Mr. Bevington and Mr. Stewart.
Mr. Flournoy: They had not signed onto it yet.
Mr. Taylor: Those were the three names that were on the letter that you brought to Mr.
Wagner.
Mr. Flournoy: That's right
Mr. Taylor: I just wanted to clarify that because there is no validity of what actually
happened. Thank you.

Mr. Imperial: He is not an engineer, so to speak, he just had experience with building.
Mr. Taylor: I just wanted to....
Mr. Flournoy: We're off the subject.
Mr. Tran: I'm not too sure, correct me if I'm wrong, but I don't think that Mr. Taylor is
an officer. I don't understand why he is interrogating a resident.
Mr. Flournoy: That's fine because
Mr. Tran: I'm blown away.
Mr. Taylor: Mr. Flournoy, forgive me, but I did ask you if I could ask you a personal
question.
Mr. Flournoy: That's perfectly okay.
Mr. Taylor: I'm not interrogating you. I have to back up the fact somebody brought a
letter in here, but nobody signed the letter.
Mr. Flournoy: 1 came in after the Mayor's letter and I talked to him about it.
Mr. Taylor: Thank you.
Mr. Imperial: You have my permission to come and see me anytime.
Mr. Flournoy: That's right.
Mr. Taylor: Thank you for your honest response.
Mr. Flournoy: I'll come in and see you too Gary.
Mr. Taylor: Thank you.
Mr. Tran: I would like to make a comment on its relevance. Whether Mr. Flournoy did
approach any councilmember as far as a police department. or moratorium as for the CLQA
thing. I think Mr. Flournoy is one of 55,000 residents out there. I know where Mr. Taylor is
coming from, but I come up with ideas. I'm an elected official and I meet with constituents.
There is a need and not just an... there is 54,999 other constituents out there that I meet with.
So to answer Mr. Taylor's question,, I didn't come from this... it came from public residents that
did approach me on some of these issues. And for the record, it doesn't matter where I get ideas
from. So I just wanted to make that clear. It's interesting how a councilman can...
Mr. Flournoy: That's fine, we needed to clear this up.

Mr. Imperial: For the record, I will call that questioning instead of interrogation.
Mr. Taylor: Mr. Flournoy, I asked you a question.
Mr. Flournoy: Gary asked me if he could ask a question and I told him he could.
Mr. Taylor: Did I intimidate you?
Mr. Flournoy: No. Because I set here like most of the audience and Mr. Tran came up
with idea of police department and on moratorium. I had no prior knowledge on any of this.
Mr. Taylor: I believe that. I honestly believe that.
Mr. Flournoy: In hindsight, the moratorium is going on anyway, so it does not matter,
and hiring special council which also I did not know about ahead of time. _
Mr. Taylor: You are an officer of the SOC group.
Mr. Flournoy: Yes.
Mr. Taylor: And you did not know anything about hiring an attorney to come in and
appeal the, and put the moratorium on. You were not informed of that?
Mr. Flournoy: I didn't hear about that until I let me see. I got my original copy right
here.
Audience: What is happening Mr. Mayor?
Mr. Flournoy: When I sat here and I learned about two problems when I was here for the
council meeting.
Mr. Taylor: I appreciate that.
Mr. Flournoy: It might turn out to be a good idea.
Mr. Taylor: Thank you for your honestly.

Stephen Ing, 8444 Drayer Lane, Rosemead, voiced his opposition to the Wal-Mart
project because of the detrimental effect it would have on his family and the neighborhood.
Dolly Leong, 8455 Mission Drive, Rosemead, addressed condominium lot standards,
street frontage, parking requirements, and related ordinances adopted through the years.

Jessica Liu. student at UC Riverside, requested interviews with the Councilmembers for
her school project.

CC-E AUTHORIZATION TO PARTICIPATE IN THE STATE OF CALIFORNIA CAL-
CARDPROGRAM
MOTION BY COUNCILMAN NUNEZ, SECOND BY COUNCILMAN TRAM that the
Council authorize staff to submit an application and required documentation for any
COrmellmember who may desire to participate. It is further recommended that Council authorize
a maximum monthly limit of $5,000. Before vote could result, more discussion ensued.
Councilwoman Clark stated that credit cards for the Council are not necessary and that
$60.000 per Councilmember is exorbitant. Staff books the best airfares and makes the hotel and
conference reservations. Mrs. Clark continued that a staff member usually attends the
conferences and pays for any charges. '
Mayor Pro Tern Taylor stated that staff makes the airline, hotel and conference
reservations, and there is a $150 travel advance available. Mr. Taylor stated that he has never
had a need for a City credit card and he is opposed to this item.
Councilman Tran stated that the Cal-Card system allows for lodging, travel, and meals
only, and cannot be used for any other miscellaneous expenses. Mr. Tran continued that the
system is regulated specifically for elected officials and staff, and with the Cal-Card system, a
travel advance is not needed, nor would staff need to attend conferences with elected officials.
Councilman Nunez stated that staff can still make travel arrangements, but that the card
can be used in case of emergencies, such as an overbooked hotel. The Cal-Card system keeps a
direct record of each individual Councilmember's charges.

Mayor imperial stated that he has never had a problem with the way travel/conference
reservations have been handled and that he is opposed to this item.
Councilman Taylor called for the question.

The Motion failed.
Councilman Nunez asked if anyone checked with staff to see if using the Cal-Card
system made it easier on them.
V. MATTERS FOR DISCUSSION AND ACTION
Councilman Tran requested that the Council consider supporting AB 1222. AB 888 and
SB 459 at the next meeting. Councilwoman Clark agreed and explained that these bills would
regulate emissions from trains and rail yards.
VI. STATUS REPORTS - None
VII. MATTERS FROM OFFICIALS
A. MAYOR'S COMMITTEE APPOINTMENT FOR 2005-2006
Councilwoman Clark requested that she be appointed as alternate to the L.A. County
Sanitation District since the cities of District 15 elected her to serve as Chair, and the office
requires her to be a delegate or alternate. She stated that she must remain the delegate to the San
Gabriel Valley Council of Governments (COG) in order to continue to serve on the Rivers and
Mountains Conservancy.
MOTION BY COUNCILWOMAN CLARK, SECOND BY MAYOR PRO TEM
TAYLOR that the Council approve the appointments to the L.A. County Sanitation District and
to the San Gabriel Valley Council of Governments, and that the remainder of the appointments
be deferred to the next meeting. Vote resulted:

VIII. ORAL COMMUNICATIONS FROM THE AUDIENCE
Larry Bevington, 8372 Rush Street, Rosemead, representing Save Our Community, stated
that he came tonight to ask questions about Cal Trans, but has since decided not to, and that he
will turn in a letter to the City Clerk requesting that his item be placed on a future agenda.
IX. ADJOURNMENT
There being no further action to be taken at this time, the meeting was adjourned at 9:45
p.m. The next regular meeting will be held on Tuesday, May 10, 2005, at 8:00 p.m.
