SUBJECT: ADOPT RESOLUTION NO. 2020-46 APPROVING THE CERTIFICATION
OF THE CITY OF ROSEMEAD 2013 ENGINEERING AND TRAFFIC
SURVEY ALLOWING THE SURVEY TO BE EFFECTIVE FOR A TOTAL
OF 10 -YEARS, UNTIL MARCH 2023 AS PERMITTED UNDER VEHICLE
CODE SECTION 40802
SUMMARY
The City Engineer's certification of the 2013 Engineering and Traffic Survey will allow the Survey
to be valid for a total of 10 -years, from March 2013 through March 2023. This extension will
allow the for posted speed limits in the City of Rosemead to be upheld by the courts and not be
deemed an impermissible "Speed Trap" as defined by CVC Section 40802. There is a total of 42
roadway segments citywide that have been included and listed in the Certification document
(Attachment B).
BACKGROUND
The purpose of an Engineering and Traffic Survey is to establish updated speed limits that can be
enforced using radar at pre -determined locations. The City of Rosemead approved and has certified
the citywide speed limits per the Engineering and Traffic Survey conducted and dated March 2013.
Engineering and Traffic Surveys can be an enforceable document for a maximum of 10 years as
long as there have not been any significant changes in roadway or traffic conditions, including, but
not limited to, changes in adjoining property or land use, roadway width, or traffic volumes (for
example a traffic signal, road diet, bike lanes, road widening, etc.). State and local agencies should
conduct engineering studies at least once every 5, 7 or 10 years, in compliance with the California
Vehicle Code (CVC Section 40802) to reevaluate non -statutory speed limits on segments of their
roadways.
The 2013 Engineering and Traffic Survey for the City of Rosemead is in compliance with CVC
(California Vehicle Code), Section 40802, Paragraph (c), Sub -paragraphs (1) and (2)/(B)/(i)/(II)
and has been re-evaluated by a registered civil engineer. A review of the street segments listed in
the City's 2013 Engineering and Traffic Survey, determined that no significant changes in roadway
or traffic conditions have occurred on the street segments as indicated in the attached Certification,
including, but not limited to, changes in adjoining property or land use, roadway width, or traffic
volume. Therefore, where noted on the attached list, posted speed limits shall be valid for 10 years

from the date of the survey of March 2013 through March 2023. Applicable sections of the
California Vehicle Code (CVC), United States Department of Transportation Federal Highway
Administrations Manual on Uniform Traffic Control Devices (MUTCD), and the California
Supplement were followed to prepare to the Engineering and Traffic Survey.
STAFF RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 46 approving the Certification of
the City of Rosemead 2013 Engineering and Traffic Survey to 10 -Years, effective until March
2023.
FINANCIAL IMPACT
There is no fiscal impact as there are no recommended changes in speed limits.
STRATEGIC PLAN IMPACT
This item is consistent with the City of Rosemead's Strategic Plan goal of ensuring traffic safety
measures are effective and enforceable.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD, CALIFORNIA TO ADOPT AND
APPROVE THE CERTIFICATION OF THE CITY OF
ROSEMEAD'S 2013 ENGINEERING AND TRAFFIC
SURVEY TO 10 -YEARS, EFFECTIVE UNTIL MARCH 2023
WHEREAS, the purpose of an Engineering and Traffic Survey is to establish updated

The City Council adopts and approves this resolution approving the Certification of the
City of Rosemead 2013 Engineering and Traffic Survey to 10 -Years, effective until March 2023.
PASSED, APPROVED AND ADOPTED this 10th day of November 2020.
