ROSEMEAD BUILDING REHABILITATION
APPEALS BOARD
FEBRUARY 25, 1997
The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order
by Chairman Clark at 7:02 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard,
Rosemead, California.
The Pledge to the Flag was led by Vice-Chairman Imperial.
The Invocation was delivered by Boardmember Taylor
ROLL CALL OF OFFICERS:

Chairman Clark

APPROVAL OF'MINUTES: JANUARY 28, 1997 -REGULAR MEETING
I. ADMINISTRATION OF OATH
The Board Secretary administered the oath to all persons wishing to address the Board.
II. HEARINGS
The following item was taken out of order in deference to those in the audience.
C. 8749-51 MISSION DRIVE
The subject property consists of four rental units with a possible garage conversion. The
property is zoned C-1. Initial inspection was conducted on July 31, 1996 based on a referral from
Los Angeles County Fire Department. A 'Please Letter"was mailed to the property owner on
August 5, 1996. On August 6, 1996,the owner called to schedule an inspection, however called
again the following day to cancel. Inspection on September 4, 1996 revealed only minor cleanup
at the rear of the property, The Building Official declared the property substandard and filed a
Declaration of Substandard with the Los Angeles County Recorder's office. A"Thirty Day"
certified letter was mailed and posted on the property on September 18, 1996, requesting
abatement of the substandard conditions. Subsequent inspections in October,November, and
December 1996 showed no progress. On January 8,, 1997, another trash letter was sent to the
owner and tenants. Inspection on January 23, 1.997 revealed no improvement.
A Notice of Hearing was mailed and posted on the property on February 11, 1997. All
interested parties have been notified.
The City Building Official recommends that the Board find the property substandard and
order all substandard conditions removed and/or corrected by April 1, 1996.
Yusan Tong, 842 Calle La Prima Vera, Glendale, property owner was present and read a
letter to the Board outlining the problems they havehad to deal with and their efforts in.
correcting the items on the list of defects. Ms. Tong continued that all debris has been removed,
there are no inoperable vehicles on the property, roof does not leak, and listed various other items
thathave been fixed, and, if not, why they cannot fix them.

James Guerra,Building Official, stated that inspection today revealed that basically
portions of the original items on the list of defects remain the same. Mr. Guerra continued that
there are still 3 inoperable vehicles without current registrations on the property and confirmed
with a tenant that the garage had been vacated, but the door cannot be opened for inspection.
Mr. Guerra stated that the last contact with the owner was in August.
Boardmeinber Taylor asked Ms. Tong about the inoperable vehicles.
Ms. Tong responded that the last time she was on the property, approximately 30 days
ago, the cars were movable.
Vice-Chairman Imperial requested that Mr. Tong be present at the next hearing as he was
the one that dealt with the inspectors previously.
Boardmembers Taylor and Bruesch requested that an appointment be arranged for both
Mr. and Mrs. Tong to meet with the Building Inspector at the property to go over the list of
defects.
Discussion ensued that this item be continued to the March 25, 1997 meeting.
Chairman Clark requested that a stipulation be added that there is progress shown before
the meeting of March 25th.
MOTION BY'BOARDMEMBER BRUESCH, SECOND BY BOARDMEMBER.
TAYLOR that the Board find the property substandard and order all substandard conditions
corrected by March 10, 1997, and return for re-hearing on March 25, 1997. Vote resulted:

The Chairman declared said motion duly carried and so ordered.
Vice-Chairman requested a memo from the Planning Department explaining why the
Tong's request for an electrical permit was denied.
B. 3371 BURTON AVENUE-HEARING
The subject property consists of a vacant single family residence located in the R-1 zone.
A "Please Letter"was mailed to the property owner on June 24th, and a "bulky item" trash notice
was sent on July 8, 1996. Inspection on July 25, 1996. revealed the yard had been cut, but no
other visible improvement had been made. The electric meter had been shut off and locked by
Southern California Edison. A neighbor informed the building inspector that the owner resided m
a rest home and that his son was maintaining the property. The Building Official declared the
property substandard and filed a Declaration of Substandard with the Los Angeles County
Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on
August 9, 1996, requesting abatement of the substandard conditions. The letter was returned
"unclaimed" and was sent again by first class mail. On September 4, 1996, the owner's son, John
Newell, contacted the building inspector. he indicated that he was in the process of cleaning the
property and that he would call back to schedule an inspection when he could meet with the
inspector at the site. A follow-up inspection was made on September 12, 1996, however no
progress was observed. On October 2, 1996, another trash notice was sent. John Newell phoned
again on October 7, 1996 to request an additional time and stated the work would be complete by
the end of the month. Inspection on October 28, 1996 revealed some yard area cleanup. John
Newell was present and was reminded of permit requirements and to request inspection when the
work was complete. Progress inspections in December 1996 and January 1997 showed no
additional progress. A third trash notice was mailed on January 7, 1997..

order all substandard conditions removed and/or corrected by April 1, 1997. However, if permits
and approvals are obtained and sufficient progress is achieved by April 1, 1997, the abatement
date may be extended to May 1, 1997. The building shall remain secure against unlawful entry.
Mr. Guerra reported that the inspection today revealed no change in the conditions.
John Newell, 2764 Santa Clarita Road, Santa Clarita, son of the owners,was present to
answer any questions. Mr.Newell stated that his parents are currently in a rest home; however,
his father wishes to return home and he is maintaining the property until that date. Mr. Newell
continued that he has cleaned up the property somewhat, but the remaining items are large and
bulky.
Boardmember Taylor requested a commitment from.Mr.Newell to begin correcting the
list of defects.
Mr. Newell stated that he disagrees with some of the items on the list of defects; however,
in reviewing the list, agreed that many of the items listed need to be corrected.
Mr. Guerra requested that a meeting with a building inspector and Mr. Newell at the
property be arranged to go over the list of defects.
MOTION BY BOARDMEMBER BRUES'CH, SECOND BY BOARDMEMBER
VASQUEZ that the Board find the property substandard and order all substandard conditions
removed and/or corrected by April 1, 1997. However, if permits and approvals are obtained and
sufficient progress is achieved by April 1, 1997, the abatement date may be extended to May 1,.
1997.. The building shall remain secure against unlawful entry. Vote resulted:

The subject property consists of two, tenant-occupied dwelling, two accessory building,
and an illegally occupied garage conversion. The property is zoned R-2. A"Please Letter" was
mailed to the property owner on March 26, and a"bulky item" trash notice was sent to both the
owner and tenants on March 28, 1996. Inspection on April 3, 1996, with the owner present,
revealed no progress. The items on the list of defects were discussed and explained. Inspection
on May 6, 1996, showed some progress toward yard area and exterior cleanup. Further progress
was noted in June. However, inspections in July and August revealed no further improvement
had been made. The Building Official declared the property substandard and filed a Declaration
of Substandard with the Los Angeles County Recorder's office. A"Thirty Day" certified letter
was mailedand posted on the property on September 10, 1996, requesting abatement of the
substandard conditions. The letter was returned"unclaimed" and was sent again by first class
mail. On October 2, 1996, another trash notice was sent. No substantial progress was observed
during follow-up inspections in October, November and December 1996. Inspection on February
5, 1997 also revealed no progress.
A Notice of Hearing was mailed and posted on the property on February 11, 1997. All
interested parties have been notified.

The City Building Official recommends that the Board find the property substandard and
order all substandard conditions removed and/or corrected by April 1, 1997. However, if the
converted garage is vacated, and sufficient progress is achieved by April 1, 1997, the abatement
date may be extended to May 1, 1997.
Mr. Guerra stated that he and the Planning Director have talked,to the owner and the
owner agrees to the conditions.

removed and/or corrected by April 1, 1997. However, if the converted garage is vacated, and.

Vice-Chairman Imperial requested an update on 4623 Earle Avenue.
Mr. Guerra responded that there has not been any changes a Bench Warrant is still
outstanding for the new owner.
V. ADJOURNMENT
There being no further action to be taken at this time, the meeting was adjourned at 7:35
p.m. The next regular meeting is scheduled for March 25, 1997, at 7:00 p.m.
