RECONSTRUCTION PROJECT
Attached are the easement deeds for street purposes and Right-of-Way Agreements for
eighteen properties on Lorica Street, west of Temple City Boulevard. These documents
represent all of the easements necessary for the reconstruction of the street.

it the City'to relocate/reconstruct
private improvements which are existing within the future public right-of-way. Per City
Council policy, none of the agreements require the City to construct an improvement which
was not existing as of date the agreements were prepared.
It should be noted that the easements for two of the properties are different than the
others, due to existing circumstances. A portion of the existing residence located at the
northwest corner of Lorica Street and Temple City Boulevard is within the proposed future
right-of-way. The property owners have signed two easement deeds. One is for a width
of 24 feet instead of the typical 25 feet along the street so the residence is not in public
right-of-way. The other easement is an irrevocable offer to dedicate the additional one
foot. By accepting both documents, the City can proceed with the project with a narrower
parkway along the property frontage. At any time in the future, if the residence is
demolished the City Council can accept the dedication that is irrevocably offered without
additional documents from the property owners to obtain the ultimate street width.

The other propertywas recently involved in`a sales transaction between Sparling
Instruments, the listed owner, and John Adams, who was the owner of Sparling
Instruments and retained ownership of the land. During the transaction, title to the
property was not transferred per the terms of the sale. The new owners of Sparling
Instruments have agreed to quitclaim the property to John Adams to expedite the transfer
of ownership and Mr. Adams has agreed to dedicate the property to the City. Once the
quitclaim is filed with the County Recorder, the recordation information will be added to the
legal description and Mr. Adams will sign the completed easement deed. It is appropriate
for the City Council to accept the dedication in this format and staff will obtain the_proper
signatures and file the easement for recordation after the legal description is completed.
RECOMMENDATION
It is recommended that the City Council accept the attached easement deeds and direct
the City Clerk to record the deeds together with the certification of acceptance and
authorize the City Manager to execute the Right-of-Way Agreements on behalf of the City.

RIGHT-OF-WAY AGREEMENT
EASEMENT DEEDS, dated , 1996, covering property in the
City of Rosemead have been executed and delivered to the City of Rosemead.
IN CONSIDERATION of which, and the other considerations hereinafter set forth,
it is mutually agreed as follows:
1. The parties have set forth the whole of their agreement. The performance of this agreement
constitutes the entire consideration for said document and shall relieve the City of Rosemead of all
further obligations or claims on this account or on account of the location, grade or construction of
the proposed public improvement.
2. It is agreed that the property conveyed by the above said easement deeds is being donated to
the City of Rosemead by the undersigned grantor(s), having been informed .of the right to
compensation for the property donated and hereby waive(s) such right to compensation.
3. The City shall, as part of the construction of the proposed public improvement, remove and -
replace existing chain link fence and gate and reconstruct portion of private driveway on private
property to match proposed street improvements at 9628 Lorica Street; remove and replace existing
chain link fence and gate, tree, mail box, and reconstruct portion of private driveway and curbing on
private property to match proposed street improvements at 9632 Lorica Street; remove and replace
existing chain link fence and gate, tree, mail box, and reconstruct portion of private driveway on
private property to match proposed street improvements at 9638 Lorica Street; remove and replace
existing chain link fence and gate and reconstruct portion of sidewalk on private property to match
proposed street improvements at 9644 Lorica Street; and remove and replace existing tree and hose
bib behind proposed sidewalk and reconstruct in kind portion of sidewalk and private driveway on
private property to match proposed street improvements at 4035 Temple City Boulevard.
4. Permission is hereby granted to the City of Rosemead, or its authorized agent, to enter upon
grantor's land, where necessary, for purposes of construction of street improvements and removal
and or replacement of those items mentioned in Section 3 of this agreement.
Grantor understands and agrees that upon completion of the work described in Section 3 of this
agreement, said chain link fences and gates, trees, sidewalks, hose bib, curbing, and driveways
located upon the grantor's land shall be considered as the sole property of the grantor, the
responsibility for maintenance and repair of said property shall be that of grantor.
5. In consideration for donating the property by the undersigned grantor, the City of Rosemead
agrees to pay all improvement/construction costs of this project and no assessment shall be levied
upon grantor's land for said costs.
6. All work done under this agreement shall conform to all applicable building, fire, and sanitary
laws, ordinances, and regulations relating to such work, and shall be done in a good and workmanlike
manner. All structures, improvements, or other facilities, when removed and relocated, or
reconstructed by the City of Rosemead, shall be left in as good a condition as found.

EASEMENT DEEDS, dated , 1996, covering property in the
City of Rosemead have been executed and delivered to the City of Rosemead.
IN CONSIDERATION of which, and the other considerations hereinafter set forth,
it is mutually agreed as follows:
1. The parties have set forth the whole of their agreement. The performance of this agreement
constitutes the entire consideration for said document and shall relieve the City of Rosemead of all

replace gate and reconstruct in kind portion of private driveway on private property to match
proposed street improvements at 9614 Lorica Street; and remove and replace existing wrought iron
fence and mail box behind proposed sidewalk and reconstruct in kind portion of private driveway on
private property to match proposed street improvements at 9620/9622 Lorica Street.
4. Permission is hereby granted to the City of Rosemead, or its authorized agent, to enter upon
grantor's land, where necessary, for purposes of construction of street improvements and removal
and or replacement of those items mentioned in Section 3 of this agreement.
Grantor understands and agrees that upon completion of the work described in Section 3 of this
agreement, said gate, wrought iron fence, mail box, and driveways located upon the grantor's land
shall be considered as the sole property of the grantor, the responsibility for maintenance and repair
of said property shall be that of grantor.

EASEMENT DEED, dated , 1996, covering property in the
City of Rosemead has been executed and delivered to the City of Rosemead.
IN CONSIDERATION of which, and the other considerations hereinafter set forth,
it is mutually agreed as follows:
1. The parties have set forth the whole of their agreement. The performance of this agreement
constitutes the entire consideration for said document and shall relieve the City of Rosemead of all
further obligations or claims on this account or on account of the location, grade or construction of
the proposed public improvement.
2. It is agreed that the property conveyed by the above said easement deed is being donated to
the City of Rosemead by the undersigned grantor(s), having been informed of the right to
compensation for the property donated and hereby waive(s) such right to compensation.
3. The City shall, as part of the construction of the proposed public improvement, remove and
replace existing chain link fence and gate, relocate mail box, and reconstruct in kind portion of private
driveway on private property to match proposed street improvements.
4. Permission is hereby granted to the City of Rosemead, or its authorized agent, to enter upon
grantor's land, where necessary, for purposes of construction of street improvements and removal
and or replacement of those items mentioned in Section 3 of this agreement.
Grantor understands and agrees that upon completion of the work described in Section 3 of this
agreement, said chain link fence and gate, mail box, and driveway located upon the grantor's land
shall be considered as the sole property of the grantor, the responsibility for maintenance and repair
of said property shall be that of grantor.
5. In consideration for donating the property by the undersigned grantor, the City of Rosemead
agrees to pay all improvement/construction costs of this project and no assessment shall be levied
upon grantor's land for said costs.
6. All work done under this agreement shall conform to all applicable building, fire, and sanitary
laws, ordinances, and regulations relating to such work, and shall be done in a good and workmanlike
manner. All structures, improvements, or other facilities, when removed and relocated, or
reconstructed by the City of Rosemead, shall be left in as good a condition as found.

----RIGHT-OF-WAY AGREEMENT --- -
EASEMENT DEED, dated , 1996, covering property in the
City of Rosemead has been executed and delivered to the City of Rosemead.
IN CONSIDERATION of which, and the other considerations hereinafter set forth,
it is mutually agreed as follows:
1. The parties have set forth the whole of their agreement. The performance of this agreement
constitutes the entire consideration for said document and shall relieve the City of Rosemead of all
further obligations or claims on this account or on account of the location, grade or construction of
the proposed public improvement.
2. It is agreed that the property conveyed by the above said easement deed is being donated to
the City of Rosemead by the undersigned grantor(s), having been informed of the right to
compensation for the property donated and hereby waive(s) such right to compensation.
3. The City shall, as part of the construction of the proposed public improvement, remove
existing chain link fence and a gate and replace a portion to be located behind the proposed sidewalk
area, remove one foot high block wall now used as a curb, rose bushes,-and trees, all located at 4043
Temple City Boulevard and now within the construction area; remove and replace existing chain link
fence behind proposed sidewalk at 9647 Lorica Street; and reconstruct in kind portions of all
driveways on private property to match proposed street improvements.
4. Permission is hereby granted to the City of Rosemead, or its authorized agent, to enter upon
grantor's land, where necessary, for purposes of construction of street improvements and removal
and or replacement of those items mentioned in Section 3 of this agreement.
Grantor understands and agrees that upon completion of the work described in Section 3 of this
agreement, said fences and driveways located upon the grantor's land shall be considered as the sole
property of the grantor, the responsibility for maintenance and repair of said property shall be that
of grantor.
5. In consideration for donating the property by the undersigned grantor, the City of Rosemead
agrees to pay all improvement/construction costs of this project and no assessment shall be levied
upon grantor's land for said costs.
6. All work done under this agreement shall conform to all applicable building, fire,and sanitary - -
laws, ordinances, and regulations relating to such work, and shall be done in a good and workmanlike
manner. All structures, improvements, or other facilities, when removed and relocated, or
reconstructed by the City of Rosemead, shall be left in as good a condition as found.
IN WITNESS WHEREOF, the said parties hereto have caused this agreement to be
executed in duplicate as of the date first hereinabove written.
