TRIPEPI, CITY MANAGER DATE: APRIL 1, 1997 RE: APPROVAL OF LORICA STREET CUL-DE-SAC DESIGN As the council is aware, with the exception of the property owner at the northwest end of the street, all of the other property owners have executed the documents to dedicate the required 25 feet of right-of-way for the reconstruction of Lorica Street. Staff has been working with the one owner of the remaining three properties to acquire sufficient right-of- way to construct a standard radius cud-de-sac at the west end of the street. The property owher has recently verbally agreed to freely dedicate the existing 25 foot private easement which the other property owners have dedicated from their respective properties. However, he feels that any additional dedication, such as what is required for construction of the cul-de-sac, is above and beyond what the other property owners have dedicated. Therefore, he has requested that the additional right-of-way be appraised and the City offer fair compensation for any right-of-way that exceeds the 25 feet. There are two alternative ways to proceed with the project. The first is to continue to try obtain the additional right-of-way or construct a sub-standard cul-de-sac at the west end of the street. To obtain the additional right-of-way would require authorization to proceed COUNCIL AGENDA APR 08 1997 ITEM No. .i] .- -F 2 • April 1, 1997 Page 2 with the appraisal of the property. It is estimated the compensation for the additional right- of-way, based on $20.00 per square foot, would be $35,000.00. It should be noted that it is doubtful the City would be able to recover this cost of acquisition through an assessment since the property owner is willing to freely dedicate the 25 feet in the same manner as the other property owners along the street. The other alternative is to construct a sub-standard cul-de-sac within the 50 foot right-of- way. The cul-de-sac would have a radius of 24.5 feet, which does not meet the Fire Departments standards for new development. However, staff contacted the Fire Department regarding the sub-standard radius. Attached is their response which supports the 24.5 foot radius. Although the letter does not mention parking restrictions, the Fire Department indicated during staffs initial telephone conversation that parking restrictions should be implemented in the cul-de-sac to provide the maximum turning movements available. Additionally, should the Council desire, staff will present to the City Council on an upcoming agenda an item to establish the ultimate right-of-way requirements for the west end of Lorica Street. This would allow the City to obtain the required right-of-way for a standard cul-de-sac in conjunction with any future'development of the properties at the west end of the street. RECOMMENDATION: It is recommended that the City Council direct staff to obtain the necessary documents for the dedication of the 25 feet from the remaining property owner and proceed with the sub- standard cul-de-sac alignment. It is further recommended that staff prepare the necessary documents to establish the ultimate right-of-way requirements for Lorica Street for City Council consideration. As we discussed, the property owners along Lorica Avenue, a private street, have contacted the City of Rosemead to inquire about the possibility of converting their street to a public street. The • existing street is in disrepair and has a current private easement width of 50 feet: The City of Rosemead is willing to reconstruct and provide future maintenance of the street as long as the property owners freely dedicate the required right-of-way. If the existing 50 foot private easement is dedicated to the City, the maximum radius that can be constructed will be 24.5 feet. As mentioned above, the existing private street requires total reconstruction, which would improve access to the properties. However, the City also realizes the 24.5 foot radius would not meet the Fire Department's standards for the cul-de-sac. Under what conditions would this be acceptable to the Fire Department? We have reviewed the unusual circumstances involved with Lorica Avenue. Cases such as this, must be evaluated on a case by case basis. It is true that the 24.5 foot radius cul-de-sac would not meet our standards for new development. However, the dedication and construction of the road with even a substandard cul-de-sac would be a vast improvement to what is currently existing. It is the Fire Department's decision to support the dedication and improvement of Lorica. Avenue. The benefits of this much improved street would far out weight the continuance of having a substandard cul-de-sac bulb.
