MATTERS FROM CITY MANAGER& STAFF A. Garvey Avenue Specific Plan Live/Work Interpretation Artist Live/Work is currently an allowed land use in the Garvey Avenue Specific Plan, Residential/Commercial (GSP-R/C) and Garvey Avenue Specific Plan, Incentivized Mixed-Use (GSP-MU) zones. A live/work unit is a space where the lessee can both live and work in the unit within established parameters. Since a definition of live/work is not specified in the Zoning Code or Garvey Avenue Specific Plan, staff has developed an interpretation of how live/work units should be defined and how parking should be calculated in mixed-use developments. Recommendation: That the City Council confirm the interpretation of live/work units as provided for in this staff report to apply to the Garvey Avenue Specific Plan, Residential/Commercial (GSP-R/C) and Garvey Avenue Specific Plan, Incentivized Mixed-Use (GSP-MU) zones. City Attorney Richman stated Council Member Clark will recuse herself from this item as it is in proximity to her residence. Director of Community Development Frausto-Lupo stated the interpretation of how live/work units should be defined was based on several factors; asserted the COVID-19 pandemic has resulted in a significant and sustained increase of persons working from home, therefore it can be expected that live/work units may be added into mixed-use development projects within the Garvey Avenue Specific Plan; indicated staff developed an interpretation of live/work units based on discussions with the City's Garvey Avenue Specific Plan Consultant, MIG, and the Council Commercial Task Force Subcommittee. Mrs. Frausto-Lupo noted that staff verified with MIG,that clarifying the definition of live/work would not affect the CEQA and that staff also reviewed the surrounding cities' definitions of live/work units to help determine the best interpretation for the City of Rosemead within the scope of the Garvey Avenue Specific Plan. Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of January 12, 2021 Page 3 of 12 Director of Community Development Frausto-Lupo defined live/work unit as a unit that is designed or structurally modified to combine residential occupancy and commercial activity such as artist studios, professional offices, software/media offices or small-scale retail sales of art and crafts and: • Where at least 25% and no more than 75% of the unit must be dedicated to residential use; • Where the working space is to be used by the one or more of the occupants (owner-occupant or renter-occupant) of a single household or family; • Where one or more occupants is the licensed business owner with a valid City of Rosemead business license; • Where the unit consists of a full kitchen, full bathroom (bathing and sanitary) facilities in compliance with the applicable Building Codes; and • Where no more than one full time equivalent non-occupant employee is permitted to work in addition to the occupants of the live/work unit. Mrs. Frausto-Lupo provided the following examples of permitted live/work uses: professional office such as for an architect,accountant,realtor, sales representative, website/graphic designer;consulting businesses;artist or author studios;businesses such as artisan and home crafts (i.e., ceramics, paintings, handmade goods, etc.) where the goods are to be sold primarily at a different location such as farmers markets, festivals, etc.; and cottage food operations. The Community Development Director stated that the Rosemead Municipal Code Table 17.21.030.1 and the Garvey Avenue Specific Plan Table 3.4—Development Standards sets the off-street parking requirements for mixed-use developments in the Garvey Avenue Specific Plan project area; explained since the Garvey Avenue Specific Plan does not clearly identify the off-street parking requirement for live/work units, the Commercial Task Force Subcommittee and staff determined that the off-street parking requirement would be the greater of the two; emphasized this will ensure that off-street parking will not be impacted by live/work units proposed in the future. Mrs. Frausto-Lupo provided the following example: • Proposed Live/Work Unit is 1,800 square feet: o Size of the live (residential) component is 450 square feet o Size of the work (nonresidential) component is 1,350 square feet o Off-Street Parking Requirement: • Parking requirement for live(residential)is 1.5 parking spaces per unit. • Parking Requirement work (nonresidential) is 3 parking spaces per unit(1,350 square feet/400 square feet). o Project would require 3 parking spaces (greater of the two). Mayor Pro Tem Low opined the verbiage found on page 2 of 5 of the Staff Report is not clear, "The Community Development Director or his/her designee may require the discontinuance of a work activity in a live/work unit if as operated or maintained there has been a violation of any applicable condition or standard. Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes offanuary 12, 2021 Page 4 of 12 The Community Development Director or his/her designee shall have the authority to prescribe additional conditions and standards of operation for any category or work activity in a live/work unit." Director of Community Development Frausto-Lupo clarified if a person obtains a business license as an architect but operates as a completely different business,then the city has the right to discontinue that business license; explained if someone applies for a business license to operate as an artist that is selling crafts at the farmers market, but then opens a retail spot within that live/work unit,the city will add some conditions to that business license. Mayor Pro Tem Low inquired if everyone that is working from home is required to obtain a business license; asked if the process of getting this live/work business license is the same as obtaining one for a commercial unit. Mrs. Frausto-Lupo responded that obtaining a business license is specific to a person who owns/rents a live/work unit as they are considered a business owner; affirmed that the process is similar as submittal of an application, site and floor plan, is needed to determine if the unit meets the minimum requirement of 25% and does not exceed the maximum of 75%dedicated to residential; stated the intent is to make it easy for individuals to apply online, and if all the documentation is properly submitted, a business license can be approved within one to two days. Mayor Pro Tem Low opined it is important that this application process is fairly easy for these small businesses. Council Member Ly thanked staff and Council Member Dang for working with him on the Commercial Task Force to create flexible guidelines to assist us during this pandemic affecting where and how we work; expressed he,would like to see the option of a live/work unit extended to residents that work at a company and are permanently working from home. Council Member Dang applauded the City Council for putting the concept of live/work units in place as it gives startup companies that do not necessarily have the financial backing the opportunity to start off small and let their business grow; thanked staff for their diligent research in bringing this item together as it is critical to the Garvey Avenue Specific Plan. Mayor Armenta thanked Mrs. Frausto-Lupo, Mrs. Valenzuela, Council Members Dang and Ly,for their efforts with this item;expressed concern regarding allocation of off-street parking,noting she understands it is determined according to the square footage of the unit; opined it is unrealistic to say that each unit will have 1.5 parking spaces. Director of Community Development Frausto-Lupo indicated Planning staff will assist any residents and business owners with questions regarding the development Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of January 12, 2021 Page 5of12 and parking standards; asserted the item before Council is not a Municipal Code amendment, therefore we cannot make changes at this time as that is how the parking standards are written in the Code;noted staff went the more restrictive route on parking as it would less impact the neighborhood. Mayor Armenta asked how the city will be informing residents that they only have 1.5 parking spaces; inquired who will determine which property gets the 0.5 parking space or does it become an empty space, also can someone apply for additional parking. Planning and Economic Development Manager Valenzuela indicated the 1.5 parking calculation is mainly for units that are residential only; clarified if a unit is incorporating the work component requiring 1.5 parking spaces but needs 3 parking spaces, then we would require the higher 3 parking spaces; explained staff will complete all the parking calculations when reviewing the developer's project plans, which should incorporate the percentages of how much commercial and residential will be proposed in the live/work units. Mrs. Armenta suggested for future discussion, rounding up the parking space to a whole number instead of a half to avoid confusion. Mrs. Valenzuela noted that concern was discussed with the Commercial Task Force,which is why we chose the stricter parking requirement. Council Member Dang asserted that the Zoning Code states calculations which result in a fraction of 0.5 or higher shall be rounded up to the nearest whole number; providing an example that if there is an apartment with a calculation of 6.5, the requirement would round up to 7. Mrs. Valenzuela affirmed Council Member Dang is correct, we would round up if there is a fraction of 0.5. Mayor Pro Tern Low stated there are certain occupations that are not necessarily considered a business but are professional such as individuals that work as a consultant for a company; suggested allowing an occupant to submit a signed letter, documenting telework or other related activities rather than having to apply for a business license for a live/work unit. Mrs. Frausto-Lupo responded that a consulting firm is permitted as a live/work use; indicated the Garvey Avenue Specific Plan has a 65% residential and 35% nonresidential land use mix requirement while the live/work unit has a minimum of 25% and maximum of 75% of residential, which will help developers; asserted if we eliminate the requirement to apply for a business license, then the unit will simply become an apartment/condominium, and it would be difficult for staff to determine whether it meets the live/work unit requirement; stated anyone can work from their home, explaining the live/work unit is for dual purposes, a busines Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of Januaty 12, 2021 Page 6of12 license is required specifically for business owners conducting any transactional activity within the city. Council Member Dang inquired how much a business license costs. Director of Community Development Frausto-Lupo replied a new business license for office use costs $100 and anything that would not fall under office use but falls under the live/work unit definition would also be $100 and $75 for renewal. Council Member Ly agreed with Mayor Pro Tern Low that we need to make this as flexible as possible; posed the question if I work for Raytheon and they say I can work from home, can I purchase or lease one of these live/work units, and if so, am I required to get a business license. Mrs. Frausto-Lupo affirmed you could purchase or lease a live/work unit, however a business license and floor plan would be required as it is a commercial space. Mayor Armenta stated many businesses have seen the amount that they are saving from not having to lease a space by having their employees work from home. Mayor Pro Tem Low concurred with Mayor Armenta, noting so many companies are asking most of their employees to work from home now. City Manager Molleda asked if Mayor Pro Tem Low would be comfortable if the Commercial Task Force Subcommittee met to address her concerns and brought it back at the next Council meeting. Council Member Dang stated he is comfortable adding verbiage to address Mayor Pro Tem Low's concern now, so we do not delay the process further. Council Member Ly encouraged Mayor Pro Tem Low to work with the Community Development Department on incorporating language she is comfortable with, then bringing that specific language back at the next Council meeting; requested we codify this in a formal resolution so that direction is clear for future use. City Attorney Richman responded if you would like to codify this, there would have to be a plan amendment since this verbiage is in the Specific Plan. Mr. Ly stated it was not necessary then to codify it if it would delay the process. Mayor Armenta asked if a motion is still needed since staff's recommendation was to simply confirm the interpretation of live/work units. City Attorney Richman opined a motion and second would help solidify the record. Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of Januamy 12, 2021 Page 7of12 ACTION: Moved by Council Member Ly and seconded by Council Member Dang to confirm the interpretation of live/work units as provided for in this Staff Report and to direct staff to work with Mayor Pro Tern Low on incorporating language for other commercial-related activities, such as teleworking, into the interpretation to apply to the Garvey Avenue Specific Plan, Residential/Commercial (GSP-R/C) and Garvey 'Avenue Specific Plan, Incentivized Mixed-Use (GSP-MU) zones. That specific modified language will be brought back at the next City Council meeting for review and file. Motion was carried out by the following vote AYES: Armenta, Dang, Low,Ly ABSENT: None ABSTAIN: Clark B. COVID-19 Update This is a recurring item that will be on the agenda to update the City Council on items related to COVID-19. Recommendation: That the City Council discuss and provide further direction. City Manager Molleda stated as of December 6, 2020, the County of Los Angeles Health Officer aligned its mandate with the California regional Stay at Home Order to further prevent different households from congregating and overwhelming the healthcare system; indicated on December 30th, the County announced the extension of the Order to remain in effect for as long as the State Public Health Officers regional Stay at Home Order remains in effect in Southern California. The order continues to put a great emphasis on requesting all County residents to remain in their homes except as necessary to conduct activities specifically permitted in the Order and those that are essential services. In addition to the Order, the City has also opted to close our parks and fields, and which will be reevaluated in February depending on the City's numbers. Ms. Molleda shared that we continue to provide COVID-19 at home test las, noting as of today, we have given out 718 of the 900 test kits purchased; commented unfortunately the City has 3,564 confirmed COVID-19 cases and 67 deaths. City Attorney Richman provided a brief recap on our existing moratorium ordinance adopted in March 2020, which states if a tenant (applies to both residential and commercial) notifies the landlord in writing how the current pandemic has impacted their ability to pay a portion of or even all of their rent, the landlord will not be permitted to evict the tenant during the period of the ordinance; indicated in October, the State adopted AB 3088 which overlaps what the City has but, in some parts, preempt what we have; commented the State requires that residential tenants pay 25%of their rent for the months of October to February, and if not paid,then they could be taken to small claims court but still cannot be evicted. Mrs. Richman shared that starting March 1, 2021, State law will now allow you to be evicted if you have not paid the 25% and you have 12 months to pay rent for the months of March to September; informed Council that the County adopted their own moratorium to cover the month of February 2021 until they have more insight to what the State plans on carrying out; opined it appears the State will extend the current 25% payment at least another month, if not several months. Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of Janziaty 12, 2021 Page 8 of 12 City Attorney Rivit would be beneficial for Cto review existing moratoriumchman to dadetermineised if we want to continue it as propeouncilrty ownersthe and tenants have expressed confusion whether they are supposed to follow the city or state moratorium; suggested Council focus on reviewing the commercial component since the State is requiring that 25%rent component for residential and. we cannot require anything less than that; noted she will bring this back to Council for discussion at the next meeting or first meeting in February. Mayor Armenta indicated a resident informed her that the landlord increased her rent by $200 and threatened to evict her if she did not pay; inquired if there are any provisions whether city, county, or state, that imposes a rent cap for landlords; posed the question that if there are no provisions,would it be difficult to incorporate a rent cap in our city? City Attorney Richman replied that the County does have rent increase limit but only applies to the unincorporated areas of the County and does not include any incorporated cities such as Rosemead; commented that a rent cap could be considered but there is the potential for property owners to believe that the City is trying to regulate their properties and not getting a fair market in return; noted there was legislation that went into effect that regulates which properties you can impose a rent cap on; encouraged Council and staff to refer residents to our housing authority that the City contracts with. Mayor Armenta asked if City Attorney Richman could prepare a memo explaining the parameters pertaining to imposing a rent cap. Mrs. Richman affirmed she would prepare the memo for Council. Council Member Dang inquired since the vaccines are coming out, how do we ensure the seniors that live in Rosemead are not skipped. Mrs. Armenta responded 75 years and older is the current eligible age, however with the change in power, President-Elect Biden is trying to lower the age to 65 years old. City Manager Molleda stated she has discussed possible options with surrounding cities, including possibly joining our cities resources to provide vaccines at a local location to our residents. Mayor Armenta indicated she has also been part of the LA County Public Health meetings, noting the City of Alhambra said they were under the impression that every city would receive a certain amount of vaccines and could disseminate them to public servants such as police officers or firefighters; clarified the County has made it clear that they will decide how many vaccines are administered and not every city will get a specific amount. Mrs. Armenta stated from November to December,our positivity rate increased by 400%;asked the City Manager to ensure Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of January 12, 2021 Page 9 of 12 the city is aggressive in protecting its residents; commented it is not our intent to take exercise or physical activity away from residents by closing parks rather we are striving to protect everyone to the best of our ability. Council Member Clark opined these regulations are important; applauded Mayor Armenta for her remarks during tonight's invocation; expressed appreciation for all of staffs' efforts during the pandemic. Mayor Armenta noted that doctors have reported that they are seeing the highest increase in positivity rates from children. 6. MATTERS FROM MAYOR& CITY COUNCIL A. City Council Comments Mayor Pro Tem Low thanked Mrs. Frausto-Lupo, Mrs. Valenzuela, Council Members Dang and Ly for their efforts with the interpretation of the live/work unit in the Garvey Avenue Specific Plan; expressed appreciation to Mayor Armenta for assisting with her complaint regarding the freeway sent to the Senator's Office; opined she was appalled by the attack on our Capitol on January 6th, noting she is proud to be on this Council working closely together to make our community better; asked the Sheriffs Department to continue patrolling and protecting our community and City Hall. Council Member Dang stated he visited Rosemead Park since the pavement of the walking trail was just finished, noting it was beautiful, however it felt a little stiff; noted he visited Zapopan Park to compare the pavements,the one at Zapopan Park felt softer and squishier; asked if the City Manager or Director of Public Works could provide insight as to whether there was a different vendor or different specifications for the parks. Director of Public Works Daste affirmed that Council Member Dang is correct that the surface at Rosemead Park is a little firmer than the one at Zapopan Park as the original surface installed was a porous surface, basically a playground surface that needs to be able to drain, noting the subbase at Rosemead Park is solid concrete and it does not drain; stated since the original surface installed at Rosemead Park was incorrect, you could actually lift it up from the surface, so we needed to find a nonporous surface because of lack of drainage; explained we would not be able to make the concrete surface drainable as we would have to put holes in the concrete surface, which would be problematic to the subbase, as well as from a cost perspective. Mr. Daste indicated the Design Engineer found a nonporous surface designed specifically for walking, also for bikes if that were necessary, which meant when it rains, the rain will not go through the surface and into the subbase; noted we heard some concerns when the surface was being installed, so the Design Engineer, Inspection Team and I, went to the trail to inspect it twice a day to ensure Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes ofJanuamy 12, 2021 Page 10 of 12 it was done per specifications; commented once it was over, we checked that all things on the punch list were corrected per the City's specifications and that the surface is currently under warranty; asserted if we would have opted to go with a porous surface, they would have installed it but not placed it under warranty as it did not have the proper drainage; reiterated it is a little firmer than other surfaces, however emphasized the surface installed is the correct surface. Council Member Dang shared it was firmer and feels stiff when walking on it, however if you bend down and touch it, it gives, so there is some cushion value; opined he understood the reasoning behind the different surface was the lack of drainage; gave kudos to staff for identifying the problem and coming up with an engineering solution. Mayor Pro Tern Low asked if the other parts of the walking trail fall into the already existing way. Director of Public Works Daste responded that he has not inspected the existing sub surfaces of the other trails; opined he is suspecting that it may have been done similar, but is unsure as every project is different; stated we will evaluate when it comes time to replace a specific surface. Mayor Armenta inquired if Mr. Daste had record of how the previous construction took place. Mr. Daste replied that he can compile and provide the data available to Council. Mayor Armenta requested a memo to see what type of surface the other walking trails are. City Manager Molleda affirmed we will include the requested information in the Council Weekly Update. Mayor Armenta thanked Director of Parks and Recreation Boecking, Parks staff, Chief of Police Duong and his Deputies, for escorting Santa on his special visit to spread holiday cheer throughout Rosemead; indicated several residents working from home reached out to her as they received citations for not having a license plate or simply for being parked two to four inches too far away from the curb; opined if it is not a hazard we should not be issuing citations or using it as a source of revenue; expressed concern that we are putting our residents through unnecessary hardship as many people have lost their jobs and cannot even feed their children; shared another complaint received was that our citation machine was issuing the wrong citation to residents;emphasized we need to look into being more compassionate to our residents, especially during this pandemic; requested an update on this matter. Mrs. Armenta echoed Mayor Pro Tern Low's sentiment on the insurrection that occurred on January 6th at the Capitol; stated she prays our nation comes together and hopes for a smooth transition to new leadership. Rosemead City Council, Successor Agency to the Community Development Commission and Housing Development Corporation Regular Joint Meeting Minutes of January 12, 2021 Page 11 of 12 Mayor Armenta announced the following: 1)There is a new temporary Community Garden underway and that garden plots will be assigned through a lottery system; 2)In response of the physical needs in our community,Rosemead Churches are co- hosting a food distribution drive-through on Saturday, January 30th, at 11:00 a.m., at Open Bible Church, 7915 Hellman Avenue; and 3) City Hall will be closed on Monday, January 18th, in observance of Martin Luther King Jr. Day, and we will resume business on Tuesday, January 19th 7.
