STAFF RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 21-03 with findings (Exhibit "A"), and APPROVE MOD 20-03 and PCN 20-01, subject to the 53 conditions outlined in Attachment "A" attached hereto. PROPERTY HISTORY AND DESCRIPTION The project site is located at the northeast corner of Temple City Boulevard and Valley Boulevard. According to the Los Angeles County Assessor's records, the site is approximately 12,380 square feet. According to Building and Safety Division records, the site consists of 7 - Eleven totaling 2,400 square feet. According to Business License records, 7 -Eleven was issued a business license on August 16, 2018. Elevation from Valley Boulevard (Existing) On July 20, 2015, the Planning Commission conducted a duly noticed public hearing for Design Review 14-02, Conditional Use Permit 14-01, and PCN 14-02 for the construction of a new 7 - Eleven with a retail beer and wine (Type 20) ABC license. At the public hearing, several residents raised concerns over the proposed development as they believed the City did not need another convenience store which would increase in crime rates. One resident requested that the Planning Commission continue the meeting, as several other residents were unable to attend the meeting and voice their concerns. In response to testimony from the residents at the public hearing, the Planning Commission continued the item to the regular meeting of September 21, 2015, in order for the community to provide additional input. Valley Blvd. Rosemead, CA 91770 To the City of Rosemead: 7 -Eleven is requesting to modify CUP 14-01 to allow the upgrade of their existing Type 20 ABC license to a Type 21 ABC license to include a small amount of distilled spirits. Premium distilled spirits will be kept behind the counter and not on sales floor. The applicant has purchased this license from the adjacent census track within the city to not create an additional license. In addition, they would like to modify Condition of Approval #39 and #40, to allow the sale of alcohol from 6:00 a.m.-2:00 a.m., 7 days a week. This request is consistent with other retailers with like stores in the area that have later hours and allow premium single sales of beer. The applicant has been a model business in the City of Rosemead to permit theses requested privileges at this location. This is a common and accepted practice at most businesses with a similar use. The proposed hours will service members of the community with alternate work hours and continue to provide a variety of goods that cater to a variety consumer needs. With a selection of other goods such as medicines, fresh foods, hot foods, pre-packaged food items, beauty products, dairy products, meats, breads, coffee station, and danishes, it is a pleasant atmosphere to relax in. Residents and employees within the immediate area can benefit from an offering of this kind, since there is no other similar use to ours in the immediate area. 7 -Eleven Market has been at this location for approximately 3 years without any major policing issues. The proposed modification would be compatible as the surrounding area has establishments that operate with a Type 21 ABC license and are permitted to sell alcohol until 2:00 a.m. The subject property is classified as commercial and is approximately 2,400 square feet and with 1,422 square feet of floor sales. The property is located and designed to encourage business and job growth within the city.
