CC - 2001-08 - Amending Existing Land/Use Designations of Commercial; Mix useRESOLUTION NO. 2001-08 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD TO ADOPT A NEGATIVE DECLARATION AND TO APPROVE GENERAL PLAN AMENDMENT 01-01 AMENDING THE EXISTING LAND USE DESIGNATIONS OF COMMERCIAL; MIXED USE: INDUSTRIAL/ COMMERCIAL; AND OFFICE/ LIGHT INDUSTRIAL TO COMMERCIAL FOR THE 84 PROPERTIES DESIGNATED AS PART OF THE PROJECT AREA. WHEREAS, Section 65350 et seq. of the Government Code allows a City to amend all or part of its General Plan, if it deems it to be in the public interest, and pursuant to this the City Council must hold a public hearing on the proposed change; and WHEREAS, City Council policy encourages the preparation of these amendments because of the superior level of planning and protection they offer to the quality and character of area where they are located; and WHEREAS, pursuant to the provisions of Section 15063 of the California Environmental Quality Act (CEQA), an Initial Study was prepared which concluded there would be no potential for a significant effect on the environment and a Negative Declaration was prepared; and WHEREAS, on March 5, 2001, the Planning Commission held a public hearing and recommended that the City Council adopt a resolution to adopt a Negative Declaration and approve General Plan Amendment 01-01; and i NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead as follows: SECTION 1. An Initial Study and Negative Declaration were previously prepared pursuant to CEQA assessing the potential environmental impacts that might result from the approval of the proposed General Plan Amendment 01-01. Based on this analysis, it was concluded that there would not be significant environmental impacts associated with the project. The Planning Commission certified the proposed Negative Declaration for the project, and recommended that the City Council adopt the Negative Declaration and approve General Plan AmendmentOl -01; and n~ SECTION 2. The City Council FURTHER FINDS AND DETERMINES General Plan Amendment 01-01, amending the land use area designation of the general plan from "Commercial; Mixed Use: Industrial/Commercial; and Office/Light Industrial" to "Commercial" for the subject property, is in the interest of the public necessity and general welfare, and good city planning practice dictates and supports the proposed general plan amendment, in that the change to the General Plan Land Use Area will provide a superior level of planning and protection to the quality and character of the neighborhood where the development is proposed. • 0 Resolution No. 2000-08 General Plan Amendment 01-01 Page 2 of 3 SECTION 3. That based on the recommendation of the Planning Commission and the testimony and evidence received at the public hearing, the City Council hereby approves General Plan Amendment 01-01. SECTION 4.
