Ordinance No. 242 - Building CodeORDINANCE NO. 242 AN ORDINANCE OF THE CITY OF ROSEMEAD ADOPTING BY REFERENCE, PURSUANT TO SECTION 50,022.2 OF THE GOVERNMENT CODE, THE LOS ANGELES COUNTY BUILDING CODE AS CONTAINED IN THE 1968 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS, INCLUDING CHAPTERS 68, 69 AND 98 AND 99 INCLUDED IN THE SUPPLEMENT TO SAID LOS ANGELES BUILDING CODE, AS AMENDED BY ARTICLE Vill OF THE ROSEMEAD MUNICIPAL CODE, THE LOS ANGELES COUNTY ELECTRICAL CODE AS CONTAINED IN SAID 1968 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS, AS AMENDED BY ARTICLE VIII OF THE ROSEMEAD MUNICIPAL CODE, FURTHER ADOPTING BY REFERENCE THE LOS ANGELES COUNTY PLUMBING CODE AS CONTAINED IN SAID 1968 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS, INCLUDING APPENDICES A, B, C, F AND G, AS AMENDED BY ARTICLE VIII OF THE ROSEMEAD MUNICIPAL CODE AND FURTHER ADOPTING BY REFERENCE THE LOS ANGELES COUNTY MECHANICAL CODE AS CONTAINED IN SAID 1968 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS AS AMENDED BY ARTICLE VIII OF THE ROSEMEAD MUNICIPAL CODE, REPEALING CERTAIN SECTIONS OF THE ROSEMEAD MUNICIPAL CODE AND AMENDING THE ROSEMEAD MUNICIPAL CODE. • THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS: Section 1. Section 8100 of the Rosemead Municipal Code is amended to red 8100. Adoption of Building Code. Except as hereinafter provided, the Building Code of.the County of Los Angeles as contained in the 1968 Edition of the Los Angeles County Building Laws and published by the Building News, Inc., including Chapters 68, 69, 98 and 99 included in the supplement to said Los Angeles County Building Code, is hereby adopted and shall hereafter be referred to, as the Building Code of the City of Rosemead, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, use, height, area • and maintenance of all structures and certain equipment therein specifically regulated, and -rading within the City of Rosemead, and providing for the issuance of permits and the collection of fees therefor. Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Rosemead and shall be at all times maintained by said Clerk for use and examination by the public. Said edition of the Los Angeles County Building Code, except as provided in this Chapter, is hereby substi- tuted for and shall take the place of the Building Code and amendments thereto heretofore adopted. Section 2. Section 8102 of the Rosemead Municipal Code is amended as foll s: (a) "Los Angeles County is amended to read Laws, 1968 Edition. Building Laws, 1965 Edition" "Los Angeles County Building (b) Subsections 4, 8, 9 and 10 of Section 8102 are hereby repealed, and subsections 5, 6 and 7 are renumbered 4, 5 and 6 respectively. Section 3. Section 8101 of the Rosemead Municipal Code is amended to rea : 8101. Definitions. Whenever any of the following names or terms are used in said Los Angeles County Building Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows: "Board of Appeals" shall mean the Board of Appeals established by Section 206 of said Los Angeles County Building Code. "Building Department" shall mean the "Building and Safety Division" of the Department of County Engineer. "Building Official" shall mean County Engineer of the County of Los Angeles. "City" shall mean the City of Rosemead except in Section 103 of said Building Code. "County", "County of Los Angeles" or "unincorporated territory of the County of Los Angeles" shall mean the City of Rosemead. "General Fund" shall mean the City Treasury of the City of Rosemead. "Health Officer" shall mean the Health Officer of the City of Rosemead. "Ordinance No. 7583, an ordinance adopting a Health Code" shall mean Chapter I of Article V of the Rosemead Municipal Code. "Special inspector" shall mean a person holding a valid Certificate of Registration issued by the County of Los Angeles as set forth in Section 305 (b) of said Los Angeles County Building Code. Section 4. Section 8102 of the Rosemead Municipal Code is amended y__a ding sections 7 and 8 thereto to read as follows:. 7. Section 9906 of said Los Angeles County Building Code is amended to read: "Section 9906. Building Rehabilitation Appeals Board. In order to hear appeals provided for in Chapter 99 regarding substandard buildings and substandard property, there shall be and is hereby created a Building Rehabilitation Appeals Board consisting of five members who are qualified to pass on matters pertaining to substandard build- ings. The members of the Board shall be appointed by the City Council of the City of Rosemead and shall hold office at the pleasure of the City Council and may recommend such new legislation as deemed necessary. -he Board shall adopt reasonable rules and regulations for conducting its investi- gations. The County Engineer shall be an ex officio non-voting member and act as secretary. He shall keep a record of all proceedings and notify all parties concerned of the finding and decisions of the Board." 8. Said Building Code is amended by deleting Section 307 therefrom. - 2 - • 0 Section 5. Section 8200 of the Rosemead Municipal Code is hereby ame~to read: 8200. Ado tion of Electrical Code. Except as hereinafter prove e o; he Los nge es County Electrical Code as published in the 1968 edition of the Los Angeles County Building Laws published by Building News, Inc,., is hereby adopted and shall hereafter be known as the Electrical Code of the City of Rosemead, regulating the installation, arrangement, alteration, repair, use and operation of electric wiring, connections, fixtures and other electrical appliances on premises !,!ithin the City of Rosemead, and providing for the issuance of permits and the collection of fees therefor. Three copies of said Los Angeles County.Building Laws have been deposited in the office of the City Clerk of the City of Rosemead and shall be at all times main- tained by said Clerk for use and examination by the public. Said Electrical Code, except as hereinafter provided, is substituted for and supersedes all Electrical Codes and amendments thereto heretofore adopted and in effect. Section 6. Section 8201 of the Rosemead Municipal Code is amended y-b ng subsection 3 to read: 3. "Maintenance Electrician" shall mean a person holding a valid Certificate of Registration as Maintenance Electrician issued by the County of Los Angeles as set forth in Section 8 and 9 of said Los Angeles County Electrical Code. Section 7. Section 8203 of the Rosemead Municipal Code is hereby repealed. Section 8. Section 8300 of the Rosemead Municipal Code is amended to read: 8300. Adoption of Plumbing Code. Except as hereinafter pro- vide-d-, the os Angeles County Plumbing Code as contained in the 1968 Edition of the Los Angeles County Building Laws published by the Building News, Inc., including appendices A, B, C, F and G thereto, is hereby adopted and shall hereafter be referred to as the Plumbing Code of the City of Rosemead, regulating plumbing and drainage systems, house sewers, private sewage disposal systems and precribing conditions under which such work may be carried on within the City of Rosemead, and pro- viding for the issuance of permits and the collection of fees therefor. Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Rosemead and shall be at all times maintained by said Clerk for use and examination by the public. Said Plumbing Code, except as hereinafter provided, is substituted for and supersedes all Plumbing Codes and amendments thereto heretofore adopted and in effect. Section 9. Section 8301 of the Rosemead Municipal Code is amended read: - 3 - 0 8301. Definitions. Whenever any of the following names or terms are used in said Los Angeles County.Plumbing Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this Section as follows: "Administrative Authority", "Chief Plumbing Inspector" or "Plumbing Inspector" shall mean the County Engineer of the County of Los Angeles except in Section 3 of said Plumbing Code. "Board of Examiners of Plumbers, Gas Fitters, and Sewer- age Contractors" or "Board of Examiners" shall mean the Board of Examiners of Plumbers, Gas Fitters, and Sewerage Contractors of the County of Los Angeles established by Section 73 of the said Los Angeles County Plumbing Code. "City". shall mean the City of Rosemead except in Section 2 of said Plumbing Code. "County", "County of Los Angeles" or "unincorporated territory of the County of Los Angeles" shall mean the City of Rosemead. "Gas Fitting Contractor", "Journeyman Gas Fitter", "Journeyman Plumber", "Plumbing Contractor", or "Sewage Contractor" shall mean a person holding a valid Certifi- cate of Registration issued by the County of Los Angeles • as set forth in Section 72 of said Los Angeles County Plumbing Code. Section 10. Section 8303 of the Rosemead Municipal Code is hereby repealed. Section 11. Chapters 4 and 5 of Article VIII of the Rosemead Municipa ode are renumbered as Chapters 5 and 6 respectively, and Sections 8400 to 8402, inclusive, are renumbered 8500 to 8502, inclusive, and present Sections 8500 to 8506, inclusive, are renumbered to 8600 to 8606, inclusive. Section 12. A new Chapter 4 of Article VIII of the Rosemead Municipa Code is hereby adopted to read: CHAPTER 4 - MECHANICAL CODE • 8400. Adoption of Mechanical Code. Except as hereinafter provided, the Los Angeles County Mechanical Code as contained in the 1968 Edition of the Los Angeles County Building Laws published by the Building News, Inc., including the appendix thereto, is hereby adopted, and shall hereafter be known as, the Mechanical Code of the City of Rosemead, providing for the issuance of permits and-the collection of fees therefor and providing penalties for violation of such Code. Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk and shall be at all times maintained by said Clerk for use and examination by the public. 8401. Definitions. Whenever any of the following names or terms are used in said Los Angeles County Mechanical Code, each such name or term shall be deemed and con- strued to have the meaning ascribed to it in this Section as follows: "Board of Appeals" or "Board of Examiners of Plumbers" shall mean the Board of Examiners of Plumbers, Gas Fitters, and Sewerage Contractors of the County of Los Angeles established by Section 73 of the Los Angeles County Plumbing Code as published in the 1968 Edition of the Los Angeles County Building Laws previously referred to in this Article VIII. - 4 - "Building Department" shall mean the "Building and Safety Division" of the Department of the County Engineer. "Building Code", "Uniform Building" or "Los Angeles County Building Code" shall mean the Building Code adopted by Chapter 1 of Article VIII of the Rosemead Municipal Code. "Building Official" shall mean County Engineer of the County of Los Angeles. "City" shall mean the City of Rosemead. "Electrical Code" shall mean the Electrical Code adopted by Chapter 2 of Article VIII of the Rosemead Municipal Code. "Fire Code" or "Los Angeles County Fire Code" shall mean the Fire Code adopted by Chapter 1 of Article III of the Rosemead Municipal Code. "General Fund" shall mean the City Treasury of the City of Rosemead. "Health Code" or "Los Angeles County Health Code" shall mean the Health Code adopted by Chapter I of Article V of the Rosemead Municipal Code. • "Mechanical Code" shall mean the Mechanical Code of the City of Rosemead. "Plumbing Code" shall mean the Plumbing Code adopted by Chapter 3 of Article VIII of the Rosemead Municipal Code. 8402. Amendments to Mechanical Code. Said Mechanical Code is hereby amended as follows: 1. Section 202 of said Mechanical Code is amended to read: "Section 202. Violations and Penalties. It shall be unlawful for any person, firm, or corporation to erect, install, alter, repair, relocate, add to, • replace, use or maintain heating, ventilating, comfort cooling, or refrigeration equipment in the jurisdiction or cause the same to be done, contrary to or in violation of any of the provisions of this Code. Maintenance of equipment which was unlawful at the time it was installed and which would be un- lawful under this Code if installed after the effective date ,of this Code, shall constitute a continuing violation of this Code. Any person, firm or corporation violating any of the provisions of this Code shall be deemed ^.uilty of a misdemeanor, and each such person shall be- deemed -uilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued or permitted, and upon conviction o any such violation such person shall be punishable by a fine of not more than $500.00, or by imprisonment for not more than six months, or by both such fine and imprisonment.
