AN ORDINANCE OF THE CITY OF ROSEMEAD
REGULATING SERVICE STATIONS AND
AMENDING THE MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 9102.5 of the Rosemead Municipal
Code is amenn3ed to read:
9102.5
Automobile Service Station. A retail business establish-
ment limited to the sale of motor fuels and supplying
goods and services generally required in the operation
and maintenance of automotive vehicles and the fulfilling
of motorists' needs. These may include sale of petroleum
products; sale and servicing of tires, batteries, automotive
accessories and replacement items; washing and lubrication
services; the performance of minor automotive maintenance
and repair; and the supplying of other incidental customer
services and products. Major automotive repairs, painting
and body fender work are excluded except where such uses
are otherwise permitted. "Service Station" as used herein
does not include chain, automatic or coin-operated wash
racks.
Section 2. Section 9124.2 of the Rosemead Municipal Code
is amended -y-5 ng Subsection 14 to read:
14.
Service Stations in all Commercial (C) zones, subject to
the standards provided in Section 9124.7.
Section 3. Section 9124.7 is added to the Rosemead
Municipal
o e to read:
9124.7
Standards, Automobile Service Stations. The following
standards shall be applied in considering Conditional
Use Permit applications for automobile service stations:
A. Physical Site Controls:
1. Street Frontage - The minimum street frontage of
a service station site shall be not less than
120 feet on any street.
2. Lot Area - Minimum area required shall be not
less than 14,000 square feet.
3. Setbacks
a. Minimum setbacks for any building shall be not
less than ten feet from any property line, and
not less than 25 feet from any property line
which adjoins a dedicated street, except that
on any property abutting an alley, buildings
may be established on the property line
abutting said alley. Overhead canopies not
less than ten (10) feet high may extend to
not less than two (2) feet of any property
line.
b. Gasoline pumps, or other facilities for
providing automobiles with gasoline, and
pump islands on which they are placed,
shall be set back not less than 15 feet
from any adjoining property line.

c. Additional setbacks may be established by
the Planning Commission if deemed necessary
to provide for the protection of the safety,
health or welfare of the adjacent property
owners.
B. Site Development Standards:
1. Perimeter Property Line Walls: Where a service
station adjoins property in a residential zone
a six foot high solid masonry wall shall be
constructed adjacent to contiguous side or rear
property lines, except that within 20 feet of
any street front property line, walls shall not
exceed three (3) feet in height.
2. Screening:
a. Outside entrances to restrooms shall be
screened from view of adjacent properties
or street rights-of-way by decorative
screening not less than 6 feet high.
Bottom of screen shall be open 12" to 18"
above grade for light access and ventilation.
• b. Trash Areas - All outside trash, garbage and
refuse containers shall be stored in a
masonry walled enclosure not less than
6 feet high, to the rear of the site. No
storage shall exceed the height of the
walls. Adequate paved vehicular access
shall be provided to and from such areas
for collection of trash.
C. Landscaping:
1. Planters, not less than five (5) feet wide,
shall be located and maintained adjacent to
every street frontage, unless modification
of this requirement is first obtained from
the Planning Commission.
.10 2. No less than one hundred square feet of planting
area shall be located and maintained at the
intersection of two property lines at a street
corner.
3. Unless otherwise approved, raised planters,
not less than three (3) feet wide and of
appropriate length, shall be located and
maintained along the building facades facing
any street.
4. All planting areas shall be separated from
adjacent paving by a minimum 6-inch high curb,
or a low planter wall not to exceed three (3)
feet in height.
5. All planting, other than trees, shall be of a
variety that will not achieve a height greater
than 30 inches or that can be maintained at
said height. Plantings shall not be thorny or
spiked, and shall not extend over any abutting
sidewalk.
6. All landscaped areas shall have permanent
irrigation systems, and such areas shall be
kept planted and maintained.

7. Unless otherwise approved or indicated, planters
not less than three (3) feet wide and not less
than twenty-five (25) feet in length shall be
located and maintained along interior property
lines; trees to be planted and maintained not
more than thirty (30) feet apart, in said planters.
3. Not less than five (5%) per cent of the gross
service station site shall be landscaped.
D. Drainage Control:
Drainage shall be in accordance with City Standards
and subject to the approval of the City Engineer.
E. Permitted and Prohibited Activities:
1. Sale, Lease or Rental Items:
a. There shall be no sale or distribution of
carbonated drinks, candy, coffee, cigarettes,
or other similar items, except from dispensers
within or abutting the building.

b. There shall be no sale or distribution of
peat moss, fertilizer, toys or other pro-
motional items except from stock piles
located within or to the rear of the build-
ing.
c. There shall be no sale, display, or advertising
for sale of automobiles, trucks, or trailers.
The lease or rental of automobiles, trucks or
trailers shall be subject to the approval of
the Planning Commission, including the number
of vehicles permitted, their location on the
site, the extent of use, except that this
restriction shall not apply in any M Zone.
2. No commercial vehicles over 7500 pounds (gross
weight), except vehicles operated by the permittee
as a normal incidental service station use, shall
be permitted to be stored on the site between
10:00 p.m. and 6:00 a.m.
3. No vehicles shall be parked or displayed on the
premises other than those of persons attending
to business on the site, vehicles being serviced
for customers, vehicles of employees, and other
service vehicles used in operation of the station.
4. Repairs and Servicing: All hydraulic hoists and
pits, and all lubrication, greasing, automobile
washing, and permitted repair equipment shall be
enclosed entirely within a building.
F. Access, Parking and Circulation Requirements:
1. Access ways (Driveways):
a. Each developed site shall not have more than
2 access ways (driveways) to any one street
unless otherwise specifically approved by the
Planning Commission.
b. Access ways shall not be located within five
feet of any adjoining residential side
property lines.

c. Curb cuts and driveway width shall be in
accord with Rosemead Municipal Code
Section 7100.
2. Parking:
Two (2) parking spaces shall be provided for
each working bay in the building and one (1)
for each employee on the largest shift.
b. No vehicles may be parked on sidewalks,
parkways, driveways, alleys or planting
areas.
G. Miscellaneous Provisions:
1. Signs as permitted by Rosemead Municipal Code,
except that, unless otherwise approved by the
Planning Commission:
a.
There shall be no more than two (2) free-
standing name signs, and no portable price
or promotional signs.
b.
There shall be no signs in excess of

thirty-five (35) feet in height unless
otherwise specifically approved by the
Planning Commission.
c.
Price or promotional signs shall not exceed
twelve (12) square feet in face area. Not
more than two (2) permanent and internally
lighted double faced signs may be erected
on fixed pipe supports, the overall height
not to exceed seven (7) feet, or in lieu
thereof one (1) sign may be suspended from
the station sign or column supporting such
sign, with at least seven (7) feet of
clearance from the ground level. Location
of such signs shall be first obtained from
the Planning Director.

d.
There shall be no promotional flags, banners,
or signs displayed outside any building on
any service station site, except as provided
in G.c, of this Section, without issuance of
a valid thirty (30) day display permit by
the City Clerk subject to a twenty-five ($25)
dollar refundable deposit to guarantee removal
of the display. Such display permits may only
be issued for temporary use, not to exceed
thirty (30) days once per year.
e.
Signs shall be placed to eliminate or minimize
any glare, reflection, or light on adjoining
property or buildings, or interference with
vision of pedestrian or vehicular traffic.
f.
No blinking, flashing, animated or giant
statuary signs are permitted. Revolving
signs may not exceed eight (8) revolutions
per minute.
2. Lig
hting:
Out
side lighting shall be arranged and shielded
so
as to prevent any glare, reflection, muisance
or
hazardous interference of any kind to adjoin-
ing
streets or property.

3. Hours of operation:
a. In Commercial or industrial Zones - unlimited,
except as otherwise provided by the Planning
Commission.
H. Application of Requirements:
1. Notwithstanding any other provisions of the
Rosemead Municipal Code or of this Part, this
section shall not apply to any existing auto-
mobile service station operating in the City
of Rosemead on the date of the enactment of this
ordinance until the expiration of seven (7) years
from the date this ordinance becomes effective;
except that no new building shall be placed or
installed on any automobile service station
existing at the date this Section 9124.7 becomes
effective, unless the service station is
developed in compliance with the requirements
of this section, excluding therefrom the minimum
area requirements, and the applicant obtains a
permit as required herein; and, except that the
provisions of subsection E and subsection G
• subsections 1 - c, d, e, and f of this Section
9124.7 shall apply to all existing service
stations on the effective date of this section.
2. No existing automobile service station (established
prior to the effective date of this section) which
has been inoperative for a period of twelve (12)
months or more after the effective date of this
section, and no new automobile service station
shall be installed, constructed or operated with-
out first securing a conditional use permit in
compliance with the Rosemead Municipal Code,
unless such station is located in an industrial (i)
Zone.
1. The Planning Commission may modify any of the standards
• governing service stations as set forth in this section,
if the Commission finds that circumstances of a parti-
cular case justify modification, and that the modifi-
cation will be in keeping with the spirit and intent
of this section and the zoning ordinance.
Section 4. Section 9114.1 of the Rosemead Municipal Code
is amended yT aid'i'ng an item 49 thereto to read:
1149. Automobile Service Stations, provided the station
is developed in accordance with the standards set
forth in Section 9124.7."
Section 5. The following are hereby deleted from the
Rosemead Municipal Code:
Section 9102.49.
Item 3 of subsection A of Section 9109.1.
Item 3 of subsection B of Section 9111.1.
The words "automobile service stations and" from
subsection A (a) of Section 9109.1.

Section 6. The present ordinance regulating the
installations service stations in the City is expiring before
the next meeting of the Council. Upon its expiration there will
be no regulations or' such land uses, and the construction of
additional service stations without protection to adjoining
properties, to traffic movements, or to the effect on the surrounding
area, would be imminent. This ordinance is therefore necessary
for the preservation of the public peace, safety and welfare and
shall take effect immediately.
