A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
ADOPTING POLICY GUIDELINES REGARDING PROPOSED
LEGISLATION CONCERNED WITH THE FORMATION OF A LOCAL
RIVERS AND MOUNTAINS CONSERVANCY
WHEREAS, beginning in 1998, the California Legislature has displayed a sincere
interest in forming a conservancy to oversee the maintenance and creation of open space along the
Los Angeles and San Gabriel Rivers; and
WHEREAS, the Rosemead City Council has substantial concerns that the formation
of such a governing body would have long-term negative land-use ramifications in the community; .
and
WHEREAS, the primary goal of the Rosemead City Council regarding the formation
of such a conservancy is that affected cities retain full authority and autonomy over land that would
exist within the jurisdiction of both the City of Rosemead and the proposed conservancy.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVES
AND ADOPTS THE FOLLOWING GUIDELINES PURSUANT TO PENDING
LEGISLATION SEEKING TO CREATE A RIVERS AND MOUNTAINS CONSERVANCY
OVERSEEING THE DEVELOPMENT OF PROPERTY AND WATERSHED RELATED TO
THE LOS ANGELES AND SAN GABRIEL RIVERS:
The governing board of the proposed conservancy must be comprised of a majority of
elected officials representing cities whose jurisdiction lies within the boundaries of
the conservancy.
2. Prior to the acquisition of any property or construction of any project, the conservancy
must obtain the approval of the legislative body of the city in which the acquisition or
construction is to take place.
The conservancy shall have no power of eminent domain nor shall any other State
agency acting on behalf of the conservancy have the power of eminent domain.
4. The conservancy shall not have the power to engage in any offensive litigation.
5. Any project proposed by the conservancy within an existing flood zone must obtain
approval from the Army Corps of Engineers.
