CC - Minutes - 10-12-21MINUTES OF THE CITY COUNCIL AND SUCCESSOR AGENCY TO THE COMMUNITY DEVELOPMENT COMMISSION SPECIAL AND REGULAR JOINT MEETING OCTOBER I2, 2021 The special meeting of the Rosemead City Council was called to order by Mayor Low at 5:44 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Low, Mayor Pro Tem Dang, Council Members Armenta, Clark and Ly ABSENT: None 1. WORKSHOP A. Consideration of Resolution No. 2021-45 Authorizing the Need for Teleconferencing Option for City Council and Commission Meetings Pursuant to Assembly Bill No. 361 On March 17, 2020, Governor Newsom signed Executive Order No. N-29-20 which suspended the Brown Act's requirements for teleconferencing during the COVID-19 pandemic if notice and accessibility requirements are met. With the surge of COVID-19 delta variant cases and the Executive Order N-08-21 sunsetting on September 30, 2021, Assembly Bill (AB) 361 was signed by Governor Newsom on September 16, 2021. AB 361 provides an alternative to the teleconferencing requirements of Government Code Section 54953(b)(3) as long as there is a state of emergency, and the Legislative Body makes certain findings regarding the state of emergency. Recommendation: That the City Council adopt Resolution No. 2021-45 authorizing the need for. a teleconferencing option in accordance with Government Code Section 54953 (AB 361) to apply for the next 30 days. City Clerk Hernandez reported Governor Newsom signed Executive Orders No. N- 29-20 and N-08-21, suspended the Brown Act's requirements for teleconferencing during the COVID-19 pandemic. However, the Executive Orders sunset on September 30, 2021. Asa result of the ongoing pandemic, Assembly Bill (AB) 361 was signed by Governor Newsome to provide an alternative to the teleconferencing requirements, as long as there is a state of emergency, and the Legislative Body makes certain findings regarding the state of emergency for the next 30 days. ACTION: Moved by Mayor Pro Tem Dang and seconded by Council Member Armenta to approve Resolution No. 2021-45 authorizing the need for a teleconferencing option in accordance with Government Code Section 54953 (AB 361) to apply for the next 30 days. Overview of Draft Strategic Plan 2021-2030 The City Council and consultant MIG, Inc., will discuss and review the City of Rosemead's Draft Strategic Plan for 2021-2030. Consultant Esmeralda Garcia, from MIG, Inc., presented an overview of the draft framework of the Strategic Plan for 2021-2030. Explained the process in updating the Strategic Plan, began with an environmental scan, which involved Council interviews, Team workshops, surveys, community pop-up events, and Council goal -setting workshops. Second, establishing a framework and strategies that included multiple Council study sessions and Team sessions. Third, develop the plan. She explained, the last step is the implementation, includes a Team session to establish a work plan and schedule periodic review of the plan every two years. Mrs. Garcia reiterated the updated Values, Vision, Mission, and Goals to achieve the plan's implementation. Council Member Ly joined the meeting via teleconference at 5:58 p.m. Mayor Low thanked staff and Consultant Garcia for the work and presentation to update the City Council on the draft framework of the Strategic Plan. Council Member Armenta expressed concerns with the amount of input received from the community and City staff. She reiterated that approximately 125 members of the community and 2-3- 25 City staff responded to the Strategic Plan survey. She noted that the low turnout may have been because of the COVID pandemic, but hopes there will be more input from the community, business community, and City staff in the future. Mayor Pro Tem Dang thanked Mrs. Garcia for working with the community and City staff in developing the draft Strategic Plan. He stated he did not see an entry item in the draft Action Plan, to address new development and local business focus on revitalizing major corridors. For example, in a Strategic Plan meeting, he suggested that a food hall would create a communal space for business tenants. In addition, he asked about how was Housing going to be addressed in the draft Action Plan. He suggested perhaps utilizing a lot of commercial corridors and creating a mixed-use opportunity, opposed to stagnant commercial use. Lastly, asked for clarification on exploring shared housing development. Consultant Garcia explained that a shared housing development included tiny homes or developments to allow for multiple individuals to share a space and cost, similar to having roommates to be able to afford housing. It's a development that responds to groups of people, co -living together as an innovative solution to address some of the issues young people face regarding accessible housing. Council Member Ly agreed with Council Member Armenta and hopes there is a larger input size in the future. He opined the plan reflects the residents and the innovative approach of how the next ten years will look. Any reportable action taken by the City Council in Closed Session would be reported at the 7:00 p.m. regular joint meeting. Mayor Low adjourned to Closed Session the City Council special meeting at 6:09 p.m. 7:00 P.M. Regular Meeting The regular meeting of the Rosemead City Council was called to order by Mayor Low at 7:43 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Low, Mayor Pro Tem Dang, Council Members Armenta, Clark, and Ly ABSENT: None PLEDGE OF ALLEGIANCE was led by Council Member Ly INVOCATION was led by Council Member Clark STAFF PRESENT: City Manager Molleda, Assistant City Manager Kim, City Attorney Richman, Chief of Police Lt. Hernandez, Director of Public Work Chung, Interim Director of Community Development Persico, Interim Finance Director Chamberlain, Director of Parks and Recreation Boecking, and City Clerk Hernandez 3. PUBLIC COMMENT Mayor Low opened the Public Comment period. Speaker Sue Yamamoto, Rosemead Library Manager, submitted a public comment via email announcing the library will be hosting a Flu Shot event on Thursday, Rosemead City Council and Successor Agency to the Community Development Commission Special and Regular Joint Meeting Minutes of October 12, 2021 Page 3of10 October 28, from 12:30 pm — 3:30 pm. Public Health guidelines will be followed, such as face -covering and social distancing. There being no further speakers, Mayor Low closed the Public Comment period. 4. PRESENTATIONS A. Introduction of Newly Hired Director of Public Works Michael Chung, Interim Director of Community Development Mark Persico, and Contracted Building Official Faye Yuan City Manager Molleda welcomed and introduced the newly hired Director of Public Works, Michael Chung. Director of Public Works Chung thanked the City Council and staff for the opportunity to serve the Rosemead community. The City Council congratulated and welcomed Mr. Chung to the City of Rosemead. City Manager Molleda welcomed and introduced the newly appointed Interim Director of Community Development, Mark Persico. Interim Community Development Persico thanked the City Council and stated he looked forward to working with City staff on projects. The City Council welcomed Mr. Persico and also noted they look forward to new developments in the City. Interim Community Development Persico introduced the newly hired Building and Safety Division, Building Official, Faye Yuan. Building Official Yuan thanked the City Council for the warm welcome to the City and is happy to be serving the Rosemead community. B. Proclamation Declaring the Month of October 2021 as "Crime Prevention Month" in the City of Rosemead Public Safety Supervisor of Emergency Services Wong accepted the Crime prevention Month proclamation on behalf of the City. Council Member Armenta commended Mrs. Wong for her commitment to emergency preparedness and crime prevention. Mayor Pro Tem Dang thanked Mrs. Wong for her commitment to her work and involvement in the community. He thanked Rosemead Special Assignment Sheriff Team and City Manager Molleda for their ongoing commitment and support on public safety in the City. C. Recognition of Donors and Volunteers of the 7th Annual Back to School Resource Fair, Backpack Giveaway Event Council Member Armenta thanked and presented certificates of recognition to the volunteers and donors of the 7th Annual Back to School Resources Fair, Backpack Giveaway event. She noted that due to the pandemic and obstacles, Mrs. Wong always had a positive attitude and found ways to obtain funds for the school supplies. Thanked Mrs. Wong and everyone that took part in the 7th Annual Back to School Resource Fair. Public Safety Supervisor of Emergency Services Wong thanked the City Council for their ongoing support of the event in the last seven years. The City Council thanked volunteers and donors and commended Council Member Armenta and Public Safety Supervisor of Emergency Services Wong for their work on the Back to School Resources Fair, Backpack Giveaway event. Second Reading and Adoption of Ordinance No. 1003 -Amending Municipal Code Section 1.12.010 - Moving the Date of the City's General Municipal Election Date from March of Even -Numbered Years to the Date of the Statewide Primary Election in Even -Numbered Years Pursuant to Senate Bill 970 Beginning in 2022 On September 28, 2021, the City Council introduced for first reading Ordinance No. 1003, which amends municipal code section 1.12.010, moving the date of the city's general municipal election date from march of even -numbered years to the date of the statewide primary election in even -numbered years pursuant to senate bill 970 beginning in 2022. Recommendation: That the City Council approve the second reading and adopt Ordinance No. 1003 by title only, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING MUNICIPAL CODE SECTION 1.12.010, CHANGING THE DATE OF THE CITY'S GENERAL MUNICIPAL ELECTION FROM THE FIRST TUESDAY AFTER THE FIRST MONDAY IN MARCH OF EACH EVEN - NUMBERED YEARS TO THE DATE OF THE STATEWIDE PRIMARY ELECTION IN EVEN - NUMBERED YEARS IN RESPONSE TO SENATE BILL 970, AND ADJUSTING THE TERMS OF OFFICE ACCORDINGLY Rosemead City Council and Successor Agency to the Community Development Commission Special and Regular Joint Meeting Minutes of October 12, 2021 Page 6of10 7. MATTERS FROM CITY MANAGER & STAFF City Manager Molleda announced Wealth by Health hosted a COVID-19 vaccination clinic at the Rosemead Community Recreation Center. Wealth by Health reported they administered 457 COVID-19 vaccines during the three days at the Rosemead Community Recreation Center. Mayor Pro Tem Dang congratulated Wealth by Health for hosting a COVID-19 vaccine event, proving the community still needs access to the vaccine. 8. MATTERS FROM MAYOR & CITY COUNCIL A. Presentation and Discussion on Possible Ordinance Relating to Secondhand Smoke, Vaping and Smoke Free Multi -Unit Housing and Outdoor Dining This item is presented to the City Council at the request of Council Member Sandra Armenta. She would like to discuss a possible ordinance relating to secondhand smoke, vaping and smoke free multi -unit housing and outdoor dining. Recommendation: That the City Council discuss and provide further direction. Council Member Armenta stated she invited Rosemead High School students to present before the City Council when the students approached her about secondhand smoke and policies. Rosemead High School Student Erika Ly, also representing Advocates for Investment for Restoring the Environment (AIRE) and, in partnership with the National Asian Pacific American -Families against Substance Abuse (NAPAFASA), introduced Rosemead High School Students Lauren Ly and Emily Nguyen. They spoke about the effects of secondhand smoke from cigarettes and policies. Lauren Ly reported on secondhand smoke and its effect on all ages. She noted that children have a higher prevalence of secondhand smoke exposure at home or those living in multi -unit housing. Emily Nguyen reported about the popular electronic cigarette called vaping, which has increased in use by middle school and high school students. She reiterated that it is essential to educate the public on various electronic smoking devices, which expose you to toxins. In addition, those working in outdoor dining restaurants are unwillingly exposed to secondhand smoke. Erika Ly also spoke on the effects of secondhand smoke exposure toward tenants of multi -unit housing. Rosemead City Council and Successor Agency to the Community Development Commission Special and Regular Joint Meeting Minutes of October 12, 2021 Page 7 of 10 Emily Nguyen explained that having comprehensive smoke-free policies in multi- unit housing has successfully protected those who do not smoke and is the only way to protect their health. In addition, imposing outdoor dining policies can protect non-smokers, improve air quality, and reduce secondhand smoke exposure. She noted, some Los Angeles County cities have implemented similar outdoor smoking bans with great success. Lastly, a statistic from a survey taken from Rosemead diners indicates that 73.1 % are bothered by smoking outdoor dining, 79.4% think smoking in outdoor dining should be prohibited, and 88.5% prefer smoke-free dining. Council Member Clark commended the students on their presentation. She expressed concerns that inhaling vaping is like smoking a pack of cigarettes, and there should be more talk about how to protect kids from secondhand smoke. Mayor Low opened the public comment period. Resident Pat Hashmi expressed concerns with secondhand smoke in residential areas. She stated her family is constantly exposed to secondhand smoke and toxins unwillingly. She asked the City Council to consider policies to address secondhand smoke in public areas and single-family residential homes. Resident Jessica Dance submitted her comment via email expressing support for smoke-free multi -unit housing and smoke-free outdoor dining. She shared while living in her apartment complex, her son had active asthma attacks due to secondhand smoke exposure. Ms. Dance further explained that after moving to a new home where secondhand smoke was not present, her son's asthma improved. In addition, indicated she supports smoke-free outdoor dining because of her experience with her children. One individual smoke can cause harm to an individual who has health issues. There being no further comments, Mayor Low closed the public comment period. Mayor Low commended Rosemead High School Students on their presentation about secondhand smoke. Council Member Armenta thanked Rosemead High School Students Erika, Emily, and Lauren for their presentation and commended Dignity Health St. Mary Medical Center, Families in Good Health AIRI, and NAPAFASA for their support. Requested that City staff check with surrounding cities on smoking ordinances. She also thanked the students for providing the list of cities that have adopted smoke- free policies that City staff can utilized to do research for a possible ordinance. Mayor Pro Tem Dang thanked Council Member Armenta for inviting the students to present before the City Council. He expressed support for City staff to look into Rosemead City Council and Successor Agency to the Community Development Commission Special and Regular Joint Meeting Minutes of October 12, 2021 Page 8 of 10 a policy. He asked the City Attorney if a rule existed that you could not smoke 25 - feet of an entrance. City Attorney Richman replied there are certain government regulations on government buildings regarding smoking. The City Council can direct staff to look into something similar to adopt. Mayor Pro Tem Dang suggested Planning staff research the issue if it deals with zoning. City Attorney Richman reiterated City staff could do research and look into the matter to see if the proposed policy will involve land use or it may be a health and safety policy. If a policy requires Planning review, Council could direct staff to take it to the Planning Commission. City Manager Molleda reported Council Member Ly left the City Council meeting at 8:50 p.m. Council Member Clark expressed support for directing City staff to bring back a report on a proposed policy. Mayor Low reiterated the Council's direction for staff to look at other cities' smoke -related ordinances and bring back a report for discussion. B. Adding Hispanic Heritage Month to the List of Approved Proclamations On June 14, 2021 the City Council discussed and approved a master list of proclamations. To facilitate the process, routine proclamations will be approved on an annual basis. Any proclamations not listed will be presented to the City Council for discussion and approval before officially declaring the proclamation at a subsequent meeting. At the request of Council Member Sandra Armenta, she would like to include Hispanic Heritage Month on the list of approved proclamations. Recommendation: That the City Council discuss and approve adding the Hispanic Heritage Month Proclamation to the list of approve proclamations. Mayor Low stated Rosemead is a diverse City and supports adding the Hispanic Heritage Month Proclamation to the list of annual proclamations. Council Member Armenta clarified that National Hispanic Heritage Month begins on September 15 to October 15. ACTION: Moved by Mayor Low and seconded by Council Member Armenta to approve adding the Hispanic Heritage Month Proclamation to the list of approve proclamations. Council Comments Council Member Armenta commended staff for a successful Fall Fiesta event. She thanked City Manager Molleda for her quick response and dispatching a crew to address a fallen tree on Marshall Avenue. She asked if staff plans to analyze City trees to see which ones are diseased versus healthy trees citywide. She stated she looks forward to the creation of the Rosemead Park Walking Trail ad-hoc committee. She spoke to some residents who have requested the first meeting at Rosemead Park on a Saturday morning to get more input from residents. Mrs. Armenta asked City Attorney if having a meeting on a Saturday morning would not violate provisions of the Brown Act. Lastly, she shared that the family of fallen Police Officer Richard Ramirez sent their thank you and appreciation to the Temple Sheriff Station for their involvement in the procession of Police Officer Ramirez. She requested to adjourn the meeting in honor of Arizona Police Officer Richard Ramirez. Mayor Pro Tem Dang thanked staff for their work at the Fall Fiesta event. Council Member Clark expressed appreciation of the work it took for the Fall Fiesta event and to finally be able to celebrate in person. Mayor Low thanked the staff for coordinating the Fall Fiesta event. Council Member Armenta read the obituary of the fallen Police Office Ramirez and added he was raised in Rosemead and attended San Gabriel High School. He was a Marine and served two tours in Afghanistan and left behind a wife and three children. 9. ADJOURNMENT Mayor Low adjourned the meeting in memory of Arizona Police Officer Richard Ramirez at 9:08 p.m. The next regular meeting will take place on October 26, 2021, at 7:00 p.m. in the Rosemead City Hall Council Chamber.
