CC - Minutes - 11-09-21MINUTES OF THE CITY COUNCIL REGULAR MEETING NOVEMBER 9, 2021 The regular meeting of the Rosemead City Council was called to order by Mayor Low at 7:07 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Low, Mayor Pro Tem Dang, Council Members Armenta, Clark, and Tang ABSENT: None PLEDGE OF ALLEGIANCE was led by Council Member Clark INVOCATION was led by Council Member Armenta STAFF PRESENT: City Manager Molleda, City Attorney Richman, Interim Director of Community Development Persico, Interim Director of Finance Chamberlain, Director of Parks and Recreation Boecking, Director of Public Works Chung, and City Clerk Hernandez 1. PUBLIC COMMENT Mayor Low opened the Public Comment period. German Hernandez, Representative from Republic Services, introduced incoming Municipal Affairs Manager Isabel Rios. Isabel Rios, Municipal Affairs Manager, stated she was newly assigned to the City of Rosemead, thanked the City Council for welcoming her and looked forward to working with City staff. There being no further speakers, Mayor Low closed the Public Comment period. 2. PRESENTATIONS A. Administration of the Oath of Office as an Appointed Council Member to John Tang The Honorable Los Angeles County Board of Supervisor Hilda Solis administered the Oath of Office to newly appointed Council Member John Tang. Honorable Supervisor Hilda Solis stated she was honored to be asked to administer the Oath of Office to Council Member John Tang. She wished him success in his new role and presented a certificate of recognition to Council Member Tang. B. Presentations and Commendations for Newly Appointed Council Member John Tang Rosemead City Council Regular Meeting - Minutes of November 9, 2021 Page 1 of 11 Honorable Congresswoman Judy Chu congratulated newly installed Council Member John Tang and presented him with a Congressional certificate of recognition. Congresswoman Chu wished him success in leading the City of Rosemead as a newly appointed public official. Commended Mr. Tang for his commitment to his community, his family, and previously serving on the Traffic and Planning Commissions. Former Assembly Member Mike Eng congratulated Council Member Tang on his appointment to the Rosemead City Council. He noted that John Tang was a former staff member of his. Mr. Tang worked on legislative projects to get the youth more involved in the democratic process. He commended John Tang on his new role and thanked Council Member Steven Ly for his service in the military. Council Member Armenta, on behalf of the Honorable Senator Susan Rubio, presented a certificate of congratulations to Mr. Tang on his installation as Council Member. In a prerecorded congratulatory video, the Honorable Senator Rubio commended newly installed Council Member John Tang for his involvement in the community and looks forward to working with him in the future. Council Member Tang thanked and expressed appreciation to his family and friends for supporting him in his new role as Council Member. He expressed he had a new appreciation of elected public officials on the work they do in public service. He thanked Council Member Steven Ly for serving in the military and looks forward to his return home safely. Council Member Clark congratulated and welcomed Council Member Tang. Council Member Armenta congratulated and noted she had known John Tang when he was a kid in the City's recreation program. His commitment to the City of Rosemead and public service is commendable and it was an honor to serve along his side as a newly installed Council Member. Mayor Pro Tem Dang congratulated and welcomed newly installed Council Member Tang and commended his leadership as a former Planning Commissioner. He noted he looks forward to working with Mr. Tang. Mayor Low welcomed and congratulated Council Member Tang and was excited to have him join the City Council and help lead the City. B. Approval of Minutes Recommendation: That the City Council approve the regular meeting minutes of June 23, 2020. C. Adoption of Resolution No. 2021-55 Approving a Revised Fund Balance Policy for the City of Rosemead A revised Fund Balance Policy has been prepared in accordance with Governmental Accounting Standards Board (GASB) Statement No. 54. The Policy, as proposed, increases the General Fund committed fund balance requirement from 31% of General Fund revenue to 40% of General Fund annual expenditures. The proposed policy also removes language referencing a closed fund, funding requirements for the Equipment and Technology Replacement Funds, and designates the Finance Director as the position authorized to make certain fund balance assignment determinations for reporting purposes. Designations for `Committed Fund Balance' remains with the City Council as established by GASB 54. Recommendation: That the City Council adopt Resolution No. 2021-55, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING THE FUND BALANCE POLICY IN ACCORDANCE WITH Rosemead City Council Regular Meeting Minutes offovember 9, 2021 Page 3 of 11 GOVERNMENTAL ACCOUNTING STANDARDS BOARD STATEMENT NO. 54 D. Adoption of Resolution No. 2021-56 Approving Certain City Officials to Receive and Review Sales and Use Tax Information Section 7056 of the California Revenue and Taxation Code sets forth certain requirements and conditions for the disclosure of Department of Tax and Fee Administration (CDTFA) records and establishes criminal penalties for the unlawful disclosure of information contained in, or derived from, the sales, use and transactions tax records of the Department. As a result, the CDTFA, formerly the State Board of Equalization (SBOE), requires local governing boards to formally designate the titles of personnel that are entitled to receive and review sales and use tax transaction data. Upon adoption, the positions authorized to receive and review this information will be the City Manager, Assistant City Manager, City Attorney, Finance Director, Finance Manager (new), and Community Development Director. The updated Resolution also includes new language to accommodate `acting' and `interim' designations for the authorized positions. Use of this information is restricted and therefore, the purpose for receiving the sales and use data is limited to revenue management and budgeting, community and economic development, business license tax administration and city administration as defined in the Resolution. The City's third -party vendor for review, audit, and analysis remains Hinderliter de Llamas and Associates (HdL Companies). The City last updated this resolution in 2010. Recommendation: That the City Council adopt Resolution No. 2021-56, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AUTHORIZING CERTAIN CITY OFFICIALS AND A CITY CONTRACTOR ACCESS TO SALES AND USE TAX RECORDS PURSUANT TO GOVERNMENT CODE SECTION 7056 E. Traffic Commission Recommended Traffic Control Measures at the Intersection of Ramona Boulevard and Burton Avenue On September 9, 2021, a traffic study with several recommendations was presented to the Traffic Commission to improve the existing stop signage, pavement legends, and markings at the intersection of Ramona Boulevard and Burton Avenue. After discussion and presentation of the item, the Traffic Commission approved Staff's recommendations for the area. Public Works Field Services staff will be able to complete all the recommended items. If necessary, additional materials and supplies may be purchased at a minimal expense to complete the recommended work and staff would utilize approved Fiscal Year 2021-2022 Traffic Signs & Markers available funds. Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 4 of 11 Recommendation: That the City Council authorize approval for the following traffic control measures at the intersection of Ramona Boulevard and Burton Avenue: 1. Install new larger STOP Signs (3606) along with an All -Way (R1 -3P) plaque mounted under each STOP Sign at the Intersection of Ramona Boulevard and Burton Avenue. a. Larger STOP Signs: Larger 36"x36" STOP signs will increase the driver's awareness of the intersection. The visibility of intersections and ability of approaching drivers to perceive them can be enhanced by installing larger signs at intersections. This should follow the guidelines per CAMUTCD Table 2B.1. b. All Way (R1 -3P) Plaque: An All -Way plaque will increase the driver's awareness that all directions of travel are required to stop at the intersection. (RI -3P) 18"x6". 2. Install red retroreflective strips on all the STOP posts, per CAMUTCD Section 2B.10, paragraph 6. a. Retroreflective strips are strips installed on posts that match the background of the sign which aids to enhance the visibility of the STOP Signs and is beneficial when additional attention needs to be drawn to a stop sign especially during nighttime conditions. 3. Refresh STOP legend and bar at STOP locations (high visibility paint) at the intersection of Ramona Boulevard and Burton Avenue. a. STOP Pavement Legend and bar: a STOP pavement legend and bar provides further awareness for driver's that they are approaching an intersection that requires a vehicle to make a complete Stop. 4. Repaint the yellow painted crosswalk to white (high visibility paint) ladder stripe for the west leg at the intersection of Ramona Boulevard and Burton Avenue. a. Repaint the Crosswalk in the west leg white. Per CVC Section 21368 and CAMUTCD 313.18 unless a crosswalk is within 600' of school grounds or 2,800' from a school building with no other marked crossings the crosswalk should be painted white.; and 5. Install STOP Ahead (W3-1) Symbol Sign along Burton Avenue (high visibility paint). a. STOP Ahead (W3-1) Sign: STOP Ahead Signs increase the driver's awareness that they are approaching an intersection that requires a vehicle to make a complete Stop per CAMUTCD 2C.05. Traffic Commission Recommended Street Improvements to the Signage and Markings on San Gabriel Boulevard Near Hellman Avenue and the EB I-10 Freeway On -Ramp On March 11, 2021, a traffic study with several recommendations was presented to the Traffic Commission to improve the existing signage and markings located on San Gabriel Boulevard for northbound travel as drivers approach Hellman Avenue and the EB 1-10 Freeway On -Ramp. After discussion and presentation of the item, the Traffic Commission directed staff to review the location further and evaluate additional options for signage and pavement markings. On September 9, 2021, Staff presented their traffic review with additional enhancement options based on the Traffic Commission request during the March meeting and proposed new recommendations for signage and pavement markings for the location. All proposed improvements are within the City's right of way. Traffic Commission accepted Staff recommendations and requested that staff contact Caltrans regarding the process for using the Interstate freeway symbol pavement marker to present and include the option for along with the other recommendations for Council approval. Staff has contacted Caltrans about the recommendations, and it was determined that neither a Caltrans permit nor permission is necessary for the recommended items. Public Works Field Services staff will be able to complete all the recommended items. If necessary, additional materials and supplies may be purchased at a minimal expense to complete the recommended work and staff would utilize approved Fiscal Year 2021-2022 Traffic Signs & Markers available funds. Recommendation: That the City Council authorize the approval for the following traffic improvements on San Gabriel Boulevard for the northbound (NB) travel as drivers approach Hellman Avenue and the eastbound (EB) 1-10 Freeway On -Ramp: 1. Remove the existing mast arm signage for northbound traffic along San Gabriel Boulevard and on the approach to the intersection and replace with larger signs (54x45) for Multi -Lane Roads per CAMUTCD 2B.19. To make the sign easier for motorists to read the lane designations, it is recommended to add ONLY HELLMAN below the right turn arrow on the sign per CAMUTCD 2B.19-20. It is also recommended to remove the Thru/RT symbol on the mast arm sign and replace with a thru arrow with the 10 FWY EAST in larger font to avoid confusion for vehicles that aim to turn onto Hellman Avenue. The approach sign should be moved to the start of the right turn only lane (150' to 300' in advance); 2. Re -paint existing Right Arrow and "ONLY" Pavement Legend for the right -only lane along San Gabriel Boulevard as show in the proposed diagram of Attachment A. Add Pavement Legend "ONLY" approximately 80 -feet before Hellman Avenue, directly under the RT ARROW to say "ONLY" Legend, to indicate to drivers this lane is only for turning onto Hellman Avenue; Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 6 of 11 3. Install "Through Arrow with "FWY" and Interstate logo pavement legend approximately 20 -feet south of Hellman Avenue and again approximately 80 -feet south of Hellman Avenue; 4. Install lane line extension through the intersection (per Section 313.08 and Figure 313-13 of the CAMUTCD) for the right turning lane to Hellman Avenue to help guide vehicles to making the right onto Hellman Avenue; 5. Install approximately 25' & 15' of red curb along the east side of San Gabriel Blvd, approximately 150'& 250' south of the intersection, respectively, as shown on Figure 8 and Figure 9 of Attachment A. This will prohibit any parking within 300' of the intersection of San Gabriel Blvd and Hellman Avenue; 6. Install approximately 100' of wide dotted white lane line following the wide solid white lane line for the right turn lane, as shown on Figure 10 of Attachment A. (CAMUTCD Figure 313-11); and 7. Install 36"x36" regulatory sign Thru Traffic Merge Left W74(CA), as shown on Figure 10 of Attachment A. Per CAMUTCD Section 2C.40, this sign may be used in advance of the R3 -7R sign. G. Receive and File the 1 st Quarter Budget Report; Adoption of Resolutions Amending the FY 2021-22 Operating and Capital Improvement Program Budgets., and the FY 2021-22 Authorized Staffing List; and Approving Changes to the Middle Management, Professional, and Confidential Group Salary and Benefits Resolution This report summarizes the City's financial position for FY 2020-21 (unaudited) and FY 2021-22 through September 30, 2021 (1st Quarter) for the General Fund. Also included are carryover appropriations for the capital improvement program, a proposed change in staffing, and the 2022-23 Budget Preparation Calendar. The actions recommended within this report include the adoption of resolutions to amend the 2021-22 operating and capital improvement program budgets and the Middle Management, Professional, and Confidential Unit Salary and Benefits. To summarize the data below, FY 2021 General Fund revenue actuals were $1.2 million over the budgeted estimate, expenditures were $2.7 million below budgeted appropriations, providing nearly $1.4 million to fund balance; there is $36.1 million in prior year appropriations within 10 funds being carried forward to FY 2021-22 for 18 CIP projects; FY 2021-22 1st quarter receipts are 7% of total revenue at 25% of the year while expenditures are 17% for the same period; there is one recommended staffing change in the Public Works Department; there are two modifications to the Middle Management, Professional, and Confidential unit resolution; and the 2022-23 budget cycle kicks off in mid-January. Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 7 of 11 Recommendation: That the City Council take the following actions: 1. Receive and file the 1St Quarter Budget Report; 2. Adopt Resolution No. 2021-57, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING THE FY 2021-22 OPERATING BUDGET AND CAPITAL IMPROVEMENT PROGRAM BUDGETS; and 3. Adopt Resolution No. 2021-58, entitled: APPROVING THE MIDDLE -MANAGEMENT, PROFESSIONAL, AND CONFIDENTIAL SALARY AND BENEFIT RESOLUTION 5. MATTERS FROM CITY MANAGER & STAFF A. Approval of Adjustment to Salary and Benefits for City Manager and City Clerk Based on Recent Salary and Benefit Changes Approved to Employee Groups on October 26, 2021 The City Council will consider the approval of employee salary and benefit adjustments to the City Manager's and City Clerk's employment agreements to mirror and reflect the changes that were approved for the Executive Management Team on October 26, 2021. These adjustments include the 2% salary increases given to all other employees, effective November 1, 2021 and June 27, 2022, the management incentive pay, and other benefit and leave modifications. Based on contract provisions detailed herein and State law regarding compensation for key executive employees, this report has been placed on the Matters from City Manager and staff for discussion. Recommendation: That the City Council approve the adjustments in salary and benefits to the City Manager's and City Clerk's employment agreements to mirror those approved for the Executive Management Group on October 26, 2021. If approved, adoption of Resolution No. 2021-59, presented separately, will establish the salary amounts for the two positions effective November 1, 2021. Council Member Armenta requested to table Agenda Item 5A for a future meeting since there was no urgency on the matter to get approved. She wanted more information, and that a separate discussion is warranted regarding the City Clerk's and City Manager's salary and benefits. Mayor Low inquired with the City Attorney about tabling the item. Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 8of11 City Attorney Richman explained that contract provisions in both employment contracts required that any salary and benefit increases be brough for discussion before the City Council. There is no timeline associated with the current contracts. Council Member Tang asked how employment salary increases were approved in the past, were salary and benefits retroactive if the item was postponed. City Attorney Richman explained that a retroactive provision could be proposed in salary and benefits recommendation. The employment of the City Manager and City Clerk are pursuant to contracts. Council Member Armenta reiterated that the proposed salary and benefits were not part of the contract. The items are therefore being brought to the City Council for discussion at the discretion of the City Council. The increase in salary and benefits is not treated the same as the employees of the city. Mayor Low announced the item would be postponed to the next City Council meeting. B. Adoption of Resolution No. 2021-59 Amending the City of Rosemead's Salary Schedule for Fiscal Year 2021-22 to Meet the California Code of Regulations Title 2, Section 570.5 and 571 to Reflect New Salary Rates Approved for All Full -Time Employees California Code of Regulations (CCR) Section 570.5 and amendments to 571(b) require a consolidated Salary Schedule that shows all City classifications and salary ranges to determine eligible salary compensation for retirement be publicly available. The consolidated salary schedule must be adopted by the City Council even though the compensation changes were approved via a Memorandum of Understanding and/or employee salary and benefit Resolutions. Resolution 2021-59 represents the Citywide Salary Schedule, including salary increases on the agenda for concurrent approval. If any changes are made to salary -related resolutions presented concurrently, a modification would need to be made to the Schedule. This action includes compensation changes for key executive employees (City Manager and City Clerk). Pursuant to State law, approval of compensation changes for key executive employees must be accompanied by a verbal report. Recommendation: That the City Council adopt Resolution No. 2021-59, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING THE COMPREHENSIVE SALARY SCHEDULE TO MEET THE CALIFORNIA CODE OF REGULATIONS TITLE 2, SECTION 570.5 AND 571 TO REFLECT APPROVED Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 9of11 RATES FOR ALL FULL-TIME EMPLOYEES OF THE CITY OF ROSEMEAD Council Member Armenta requested to table Agenda Item 5B to the next meeting since it's connected to Agenda Item 5A. Interim Finance Director Chamberlain explained the City Council still needed to approve the resolution, with modifications, because it amends the overall salary of all employees and the reclassification of a position. The City Manager and City Clerk salaries on the table would have to be reduced back to their original amounts. ACTION: Moved by Council Member Armenta and seconded by Council Member Clark to approve Resolution No. 2021-59, with the amendment to retain the original salary of the City Manager and City Clerk. The motion was carried out by the following vote AYES: Armenta, Clark, Dang, Low, and Tang NOES: None 6. MATTERS FROM MAYOR & CITY COUNCIL A. Appointment to the San Gabriel Valley Mosquito & Vector Control District The City recently received a letter stating that the term of office for the representative from the City of Rosemead to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District ends on December 31, 2021. The Board of Trustees is respectively requesting that the City Council appoint a representative to the Board prior to its January 14, 2022, meeting. Recommendation: That the City Council discuss and appoint a representative from the City of Rosemead to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District. Council Member Clark moved to reappoint Council Member Armenta as the delegate to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District. ACTION: Moved by Council Member Clark and seconded by Council Member Tang to reappoint Council Member Armenta to a two-year term as the delegate to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District. Council Comments Council Member Clark commended Public Works staff, Thomas Medinilla for retrieving promptly a resident's prescription glasses that fell in a storm drain. Rosemead City Council Regular Meeting Minutes of November 9, 2021 Page 10 of 11 Council Member Armenta commended the Parks and Recreation Department, Public Works – Maintenance crew, and other City staff that took part in the Trunk -or -Treat event. Many participants enjoyed the movie, the maze, and treats. She also inquired about the size of a STOP sign at the Target Store property, and opined it was not big enough to be visible. Asked staff if there were different regulations for STOP signs on public streets versus in a plaza. Lastly, she asked why she had not been contacted about ensuring that all City vehicles have the City emblem. City Manager Molleda replied she was not aware Council Member Armenta was expecting to be contacted about the matter. Council Member Armenta stated she would like communication on items she brings to a Council meeting for discussion or follow-up. 7. CLOSED SESSION City Attorney Richman stated the City Council would go in to Closed Session to discuss two items and would report out if there was any reportable action. A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION Government Code Section: 54957 Title: City Manager Mayor Low adjourned the meeting to Closed Session at 8:00 p.m. 8. ADJOURNMENT The regular meeting adjourned at 10:30 p.m. with no reportable action taken in Closed Session. The regular meeting of November 23, 2021 was cancelled.
