CC - Minutes - 02-08-2022MINUTES OF THE CITY COUNCIL SPECIAL AND REGULAR MEETING FEBRUARY 8, 2022 The special meeting of the Rosemead City Council was called to order by Mayor Low at 6:08 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Low, Mayor Pro Tem Dang, Council Members Armenta, Clark, and Tang ABSENT: None 1. CLOSED SESSION A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION Government Code Section: 54957 Title: City Manager City Attorney Richman stated the City Council would go in to Closed Session to discuss one item and would report on any reportable action. Mayor Low recessed the meeting to Closed Session at 6:09 p.m. 7:00 P.M. The regular meeting of the Rosemead City Council was called to order by Mayor Low at 7:25 p.m., in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Low, Mayor Pro Tem Dang, Council Members Armenta, Clark, and Tang ABSENT: None PLEDGE OF ALLEGIANCE was led by Council Member Armenta INVOCATION was led by Mayor Pro Tem Dang STAFF PRESENT: City Manager Molleda, City Attorney Richman, Assistant City Manager/ Director of Community Development Kim, Interim Director of Finance Chamberlain, Director of Parks and Recreation Boecking, Director of Public Works Chung, and City Clerk Hernandez City Attorney Richman reported the City Council took the following action in Closed Session: Rosemead City Council Special and Regular Meeting Minutes of February 8, 2022 Page I of 6 ACTION: Moved by Council Member Armenta and seconded by Mayor Pro Tem Dang to give a 3 rating that meets expectations, for the City Manager's evaluation, which grants a three percent salary increase. The motion was carried out by the following vote AYES: Armenta, Clark, Dang, Low, and Tang NOES: None 2. PUBLIC COMMENT Mayor Low opened the Public Comment period. City Clerk Hernandez stated there were no public comments received from the public. 3. PRESENTATIONS A. Introduction of Human Resources Manager Karina Rueda, and newly assigned Temple Sheriff Station Sergeant John Marquez to the Rosemead Special Assignment Team Mayor Low announced Sergeant John Marquez was not available to attend in person. His presentation would be moved to the next meeting. City Manager Molleda introduced newly hired Human Resources Manager Karina Rueda. Human Resources Manager Karina Rueda thanked the City Manager and City Council for the welcome and giving her the opportunity to apply her 19 -year expertise in the public sector to the City of Rosemead. The City Council welcomed Human Resources Manager Rueda and looks forward to working with her. 4. PUBLIC HEARING None 5. B. Approval of Minutes Recommendation: That the City Council approve the City Council and Planning Commission special joint meeting minutes of August 25, 2020. C. Approval of Reinstatement and First Amendment to Professional Services Agreement with CEJ Engineers, Inc., to Provide Design Services for Safe Routes to School - Sidewalk Gap Closure - Delta Avenue from Mission Drive to Wells Street As part of the City's Fiscal Year 2018-2019 Capital Improvement Program (CIP), the City Council approved the Safe Routes to School - Sidewalk Gap Closure - Delta Avenue from Mission Drive to Wells Street project (Project). On July 24, 2018, the City Council awarded a professional services agreement for design services to CEJ Engineers, Inc. In September 2018, prior Public Works staff directed CEJ Engineers, Inc. to place the design of the Project on hold, and the Project has been inactive since. The Project is now being restarted, and due to changes in existing field conditions during the Project's inactivity, the Project requires additional relocation of existing fixed structures within the public right-of-way on Delta Avenue. Therefore, additional services from CEJ Engineers, Inc. are needed to complete the final design. The required services include additional field assessment to reconfirm existing conditions, design of relocated fixed structures within the public right-of-way, and public outreach with property owners for such relocations. Staff is requesting to reinstate and amend the professional services agreement with CEJ Engineers, Inc. to extend the contract term and approve compensation to perform the additional services. Recommendation: That the City Council take the following actions: Authorize the City Manager to reinstate and execute First Amendment to the professional services agreement with CEJ Engineers, Inc. for the Safe Routes to School - Sidewalk Gap Closure - Delta Avenue from Mission Drive to Wells Street project to extend the contract term to December 31, 2023; and increase compensation by $12,940, to complete the final design. 2. Adopt Resolution No. 2022-11, entitled: Rosemead City Council Special and Regular Meeting Minutes of February 8, 2022 Page 3 of 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AUTHORIZING CITY MANAGER OR HER DESIGNEE TO EXECUTE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR THE ACTIVE TRANSPORTATION PROGRAM D. Approval to Award the Purchase of Mobile Stage to Century Industries, Inc. The Parks and Recreation Department is seeking to purchase a new mobile stage that staff will use for various programs and special events. After more than 25 years of use, the current stage has surpassed its life expectancy, and a replacement is necessary. As part of the Fiscal Year 2021-2022 budget, the City Council allocated $200,000 to purchase a new mobile stage. Staff recommends that the City Council authorize the City Manager to approve a purchase order with Century Industries, Inc., in an amount not -to -exceed $199,550, including sales tax. Second Reading and Adoption of Ordinance No. 1007 - Amending Section 2.08.070(B) of the Rosemead Municipal Code Relating to the Chief of Police On January 25, 2022, the City Council introduced for first reading Ordinance No. 1007, which amends the Municipal Code to remove the position of Chief of Police from Section 2.08.070(B) for clarification purposes. Recommendation: That the City Council adopt the second reading by title only, Ordinance No. 1007, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING SECTION 2.08.070(B) OF THE ROSEMEAD MUNICIPAL CODE RELATING TO THE CHIEF OF POLICE 6. MATTERS FROM CITY MANAGER & STAFF A. COVID-19 Update This is a recurring item that will be on the agenda to update the City Council on items related to COVID-19. Recommendation: That the City Council discuss and provide further direction. Rosemead City Council Special and Regular Meeting Minutes of February 8, 2022 Page 4 of 6 City Manager Molleda reported the City partnered with Mountain Castle Marketing to provide COVID-19 testing services at the Rosemead Community Recreation Center. The COVID testing site operates every Friday until the end of February. The City also obtained 2,000 COVID-19 test kits to distribute to the public. In partnership with Chinatown Service Center, a vaccination clinic is scheduled for February 9, at the Rosemead Community Recreation Center. As of date, there are 10,145 confirmed Rosemead COVID-19 cases and 174 deaths. Mayor Pro Tem Dang stated there is still a need for COVID-19 test sites. Asked if Mountain Castle Marketing would come back and service the south side of the City at the Garvey Community Center or Public Safety Center. City Manager Molleda replied staff would speak with Mountain Castle Marketing to coordinate additional testing sites in the future. Council Member Tang inquired about two one-time testing site events that occurred at Zapopan Park. City Manager Molleda explained the one-time testing sites were hosted in partnership with County of Los Angeles Board of Supervisor Hilda Solis' Office. 7. MATTERS FROM MAYOR & CITY COUNCIL A. Council Comments Council Member Armenta inquired on the status of the outdoor and multi -unit Smoke -Free Ordinance that the group presented at a previous Council meeting. City Manager Molleda replied she would have to go back and review her notes to see if there was direction from the City Council. Council Member Armenta stated the Council may have asked for samples of ordinances from the cities the group mentioned in their presentation but was not sure if that was a direction to staff. Council Member Armenta requested to add a discussion about street parking during street sweeping at a future agenda. Mayor Pro Tem Dang agreed with Council Member Armenta to bring the street parking item to allow the rest of the Council to discuss the item. Council Member Armenta stated the Council had not fully discussed the issues about a retaining wall across from Rice Elementary School. She inquired who is responsible for removing graffiti from the wall. She inquired if the resident is responsible since the wall is on private property. She requested the item be placed on a future agenda to discuss. Rosemead City Council Special and Regular Meeting Minutes of February 8, 2022 Page 5 of 6 City Manager Molleda stated graffiti on private businesses and private properties is handled by Code Enforcement Officers. They give businesses owners and property owners a notice to make sure they take care of the graffiti abatement. Mayor Low agreed the graffiti topic should be brought back for discussion. The City may need to change the way the process is done because there is a cost involved. In addition, she requested to add to the agenda for discussion the formation of a Public Safety Commission as she has received calls about businesses being broken into along Garvey Avenue; noted one business was broken into at least three times. The Public Safety. Commission could look at the current safety problems in the City and work with the Sheriff's Department and City staff to improve public safety in the community. Council Member Armenta agreed a Public Safety Commission should be formed to help deter crime in the community. She suggested staff look into possible funding that could provide resources to improve blighted areas. City Manager Molleda stated staff would look into a potential Public Safety Commission and provide options for the City Council to review at a future meeting. Mayor Pro Tem Dang inquired about the need for additional flock cameras. City Manager Molleda replied staff ordered more flock cameras to be installed in the City. 8.
