DATE: April 26, 2022 SUBJECT: Parking Review: Green Curb Installation Request at 8424 Garvey Avenue INTRODUCTION The City of Rosemead received a request from a business owner to install green curb in front of the business located at 8424 Garvey Avenue. The applicant stated that the request for green curb would provide temporary parking to aid customers who want to run in to pay a bill at the business. The City has spoken to the business owner and they indicated they are in the process of completing a general curb request form. This item had previously been brought to the Rosemead Traffic Commission at the February 2, 2017, meeting where it was approved. Later the item was taken before City Council at the April 25, 2017, meeting where it was tabled until the mixed use property development at 8408 Garvey Avenue was complete, and the parking could be considered. The initial request was to install green curb approximately 29' to 30' (feet) long at the space between the two existing driveway aprons and gates to the property at 8424 Garvey Avenue. In response to this new request, and on behalf of the City, engineering staff completed a parking review and analysis of existing field conditions and previously prepared traffic reports and recommendations. A parking study and analysis was also conducted on the south side of Garvey Avenue between Delta Avenue and Earle Avenue on one (1) weekday to determine the existing parking conditions and patterns. Garvey Avenue is approximately 76 -feet wide with two lanes of travel in each direction and a double yellow marked center median. Parking is available on the north and south side of Garvey Avenue except where red curb is marked and during street sweeping. There is also a sign indicating 2 -hour parking between 7:00 am and 6:00 pm along Garvey Avenue. This segment of Garvey Avenue travels through a mix use of medium density residential zoning and commercial zoning, per the Rosemead General Plan. Delta Avenue: Within the City of Rosemead, Delta Avenue runs north and south and is considered a local road by the California Road Functional Classification Map, with a prima facie speed limit of 25 MPH. Delta Avenue is approximately 35 -feet wide with one travel lane in each direction and no marked center line. Parking is available on the east and west side of Delta Avenue except where red curb is marked and during street sweeping. Earle Avenue is approximately 36 -feet wide with one travel lane in each direction and no marked center line. Parking is available on the east and west side of Earle Avenue except where red curb is marked and during street sweeping. This segment of Earle Avenue travels through medium density residential zoning and towards open space zoning per the Rosemead General Plan. The owner has stated that customers come in to make car payments or to look at vehicles for purchase. From the sign on the gate the business is open from Tuesday through Saturday between 1:00 pm to 5:00 pm and closed on Sundays and Mondays. Based on statements in the earlier staff reports (2017 and 2016) the business owner has stated that employees park on-site and customers are required to park off-site. This has not been re -confirmed with the business owner. There is approximately 29' (feet) of space (1 car length) between the property's two gates/driveways and approximately 49' (feet) (2-3 car lengths) of space in front of 8424 Garvey Avenue (request location) and 8438 Garvey (direct neighbor to the east, an automotive car repair shop). Between the 8438 Garvey Avenue (automotive car repair shop) and the 8440 Garvey Avenue (mattress station) is another 30' (feet) of available curb parking. Per the City of Rosemead Planning Department and the building records, 8424 Garvey Avenue (request location) was approved for a vehicle center that consists of an automotive repair, a body shop, and used auto sales. The use was approved without a Conditional Use Permit, and is considered legal -nonconforming, as auto body shops are no longer permitted in the C-3 zone. 8424 Garvey Avenue shall maintain the onsite parking as the use can cannot be expanded due to its non -conforming status. Figure 4: Observed Curb Conditions at 8424 Garvey Avenue 438 Garvey AvePUFFWcaln � (Blue Star Automotive, an automotive car repair - FIELD REVIEW: PARKING STUDY ANALYSIS AND OBSERVATIONS ALONG GARVEY AVENUE In response to this request for time limited parking in front of 8424 Garvey Avenue as well as a request for green curb in front of 8408 Mixed Use facility a parking occupancy count was taken during 1 weekday on Thursday April 14, 2022. A parking occupancy study was completed on Thursday, April 14, 2022, along Garvey Avenue between Earle Avenue and Delta Avenue along the south side of the curb. Parked vehicles were observed over a six -hour period, in which the number of vehicles that were parked between 9:00 am to 3:00 pm were counted. Figure 5 below shows the existing curb measurements and color painted along the north side of Garvey Avenue where the observation took place. Table 1 indicates the number of vehicles that parked along the south curb of Garvey Avenue. Per Table 1, parking along the south side of Garvey Avenue was observed to be at capacity between the hours of 10:00 am to 2:00 pm, with most cars staying the entire time and not following or observing the posted 2 -hour parking limit signs. I Page b or 12 PARKING REVIEW: GREEN CURB INSTALLATION REQUEST AT 8424 GARVEY AVENUE analysis the vehicles parked during the observation did not obey the 2 -hour parking limits, with many of the vehicles parked for more than 2 hours. It is recommended to inform Parking Enforcement to spot check parking spaces along Garvey Avenue where there is posted time limited parking restrictions. CITY OF ROSEMEAD PAINTED CURB POLICY In the City of Rosemead, the city municipal code distinguishes parking regulations for time -sensitive parking. The policy for time sensitive parking and colored or green curb in the City of Rosemead is as follows: 'Rosemead Municipal Code —Traffic Local Ordinance 10.12.060 - Two-hour parking. The streets or portions of streets specified in this section are designated for two-hour parking during the hours of nine a.m. to six p.m. on any day other than Sundays or holidays and when signs are erected giving notice thereof, no vehicle shall be parked and permitted to remain within the designated area for a period of time longer than two hours, except as above stated. When appropriate markings have been installed by the City Traffic Engineer delineating spaces for parking parallel and adjacent to the curbs of such streets or portions of streets, vehicles shall be parked within the spaces so delineated: 10.12.070 - Twenty -minute parking. The streets or portions of streets specified in this section are designated for twenty (20) minute parking and when signs are erected and the curb painted green giving notice thereof, no vehicle shall be parked and permitted to remain within the designated area for a period of time longer than twenty (20) minutes. 10.12.080 - Twelve -minute parking. The streets or portions of street specified in this section are designated for twelve (12) minute parking during the hours of nine a.m. to six p.m. on any day other than Sundays or holidays and when signs are erected and the curb painted green giving notice thereof, no vehicle shall be parked and permitted to remain within the designated area for a period of time longer than twelve (12) minutes. CALIFORNIA VEHICLE CODE (CVC) DEFINITIONS/GUIDELINES ON PAINTED CURBS The below section is from the California Vehicle Code (CVC) and defines the meaning of Painted Curbs per the CVC Section 21458 Painted Curbs. I Page 7 of 12 PARKING REVIEW: GREEN CURB INSTALLATION REQUEST AT 8424 GARVEY AVENUE (a) Whenever local authorities enact local parking regulations and indicate them by the use of paint upon curbs, the following colors only shall be used, and the colors indicate as follows: (1) Red indicates no stopping, standing, or parking, whether the vehicle is attended or unattended, except that a bus may stop in a red zone marked or signposted as a bus loading zone. (2) Yellow indicates stopping only for the purpose of loading or unloading passengers or freight for the time as may be specified by local ordinance. (3) White indicates stopping for either of the following purposes: (A) Loading or unloading of passengers for the time as may be specified by local ordinance. (B) Depositing mail in an adjacent mailbox. (4) Green indicates time limit parking specified by local ordinance. (5) Blue indicates parking limited exclusively to the vehicles of disabled persons and disabled veterans. (b) Regulations adopted pursuant to subdivision (a) shall be effective on days and during hours or times as prescribed by local ordinances. CALIFORNIA MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES (CAMUTCD) DEFINITIONS/GUIDELINES ON CURB MARKINGS The below section is from the California Manual on Uniform Traffic Control Devices (CAMUTCD) and defines the meaning of Curb Markings per the CAMUTCD Section 3B.23 Curb Markings. CAMUTCD 36.23 Curb Markings Standard: The color of curb markings shall conform to CVC 21458 quoted below: (a) Whenever local authorities enact local parking regulations and indicate them by the use of paint upon curbs, the following colors only shall be used, and the colors indicate as follows: (1) Red indicates no stopping, standing, or parking, whether the vehicle is attended or unattended, except that a bus may stop in a red zone marked or sign posted as a bus loading zone. (2) Yellow indicates stopping only for the purpose of loading or unloading passengers or freight for the time as may be specified by local ordinance. Typically applies to commercial vehicles to load or unload passenger or for freight deliveries. (3) White indicates stopping for either of the following purposes: (A) Loading or unloading of passengers for the time as may be specified by local ordinance. (B) Depositing mail in an adjacent mailbox. (4) Green indicates time limited parking specified by local ordinance. Typically for 20/30 minutes Rosemead Muni Code calls out 12 min or 20 minute parking for green curb. I Page 8 or 12 PARKING REVIEW: GREEN CURB INSTALLATION REQUEST AT 8424 GARVEY AVENUE CALIFORNIA VEHICLE CODE (CVC) DEFINITIONS/GUIDELINES ON DISABLED PARKING The below section is from the California Vehicle Code (CVC) and defines the meaning of Disabled Parking per the CVC Section 22511.5 Disabled Parking. Per the CVC, Persons with Handicapped Placards are able to park at a painted green curb or at a location designated with time restrictions for unlimited periods. CVC 22511.5 Disabled Parking (a) (1) A disabled person or disabled veteran displaying special license plates issued under Section 5007 or a distinguishing placard issued under Section 22511.55 or 22511.59 is allowed to park for unlimited periods in any of the following zones: (A) In any restricted zone described in paragraph (5) of subdivision (a) of Section 21458 or on streets upon which preferential parking privileges and height limits have been given pursuant to Section 22507. (B) In any parking zone that is restricted as to the length of time parking is permitted as indicated by a sign erected pursuant to a local ordinance. Persons with Handicapped Placards are able to park at a painted green curb or at a location designated with time restrictions for unlimited periods. (2) A disabled person or disabled veteran is allowed to park in any metered parking space without being required to pay parking meter fees. (3) This subdivision does not apply to a zone for which state law or ordinance absolutely prohibits stopping, parking, or standing of all vehicles, or which the law or ordinance reserves for special types of vehicles, or to the parking of a vehicle that is involved in the operation of a street vending business. (b) A disabled person or disabled veteran is allowed to park a motor vehicle displaying a special disabled person license plate or placard issued by a foreign jurisdiction with the same parking privileges authorized in this code for any motor vehicle displaying a special license plate or a distinguishing placard issued by the Department of Motor Vehicles. (Amended by Stats. 2010, Ch. 478, Sec. 11. (AB 2777) Effective January 1, 2011.) DMV DISABLED PERSONS (DP) PLACARDS AND PLATES The section below is from the DMV and provides guidance on where individuals are permitted to park with a Disabled Persons (DP) Placard. Once you have a valid DP placard or DP License Plates, you may park: • In parking spaces with the International Symbol of Access (wheelchair symbol). • Next to a blue curb authorized for persons with disabilities parking. I Page 9 of 12 PARKING REVIEW: GREEN CURB INSTALLATION REQUEST AT 8424 GARVEY AVENUE • Next to a green curb (green curbs indicate limited time parking) for as long as you wish. • In an on -street metered parking space at no charge. • In an area that indicates it requires a resident or merchant permit. In addition to parking privileges, service stations must refuel a disabled person's vehicle at self-service rates unless the service facility has only one employee on duty. DMV Disabled Placards may not park: • In spaces marked with a crosshatched pattern next to a parking space with the International Symbol of Access (wheelchair symbol). These spaces are for wheelchair and wheelchair lift access. • Next to red curbs, which indicate no stopping, standing, or parking. • Next to yellow curbs, which are for commercial vehicles to load and unload passengers or freight. • Next to white curbs, which are for loading and unloading passengers or depositing mail in an adjacent mailbox. The applicant has contacted the City and indicated they will submit a General Curb and Marking Request Form and has requested that either the 29' space between his two gates be painted green or a portion of the 49' curb in front of the applicant's property at 8424 Garvey Avenue and their neighbor's at 8438 Garvey Avenue (Blue Star Automotive, an automotive car repair shop) be painted green. This request is not a traffic safety related request; therefore, it is at the direction of the City, Traffic Commission, and City Council on what type of parking and curb markings should be installed and enforced for this location. The City should determine if the standard parking area in front of the applicant's business needs to either be signed for loading and unloading or have green curb painted for passenger drop off/pick up and deliveries and if so, the City should determine the amount of the curb to be included for time restrictions. A review of the City's Curb Marking Policy as well as guidelines found in the CAMUTCD and CVC allow for the City to decide the viability of the installation of green curb or signage for loading and unloading passengers and freight in regard to the benefits and impacts to adjacent property owners. I Page 10 of 12 PARKING REVIEW: GREEN CURB INSTALLATION REQUEST AT 8424 GARVEY AVENUE RECOMMENDATIONS AND OPTIONS FOR THE CITY TO EVALUATE AND CHOOSE FROM: The City should consider each option and select which option they would like to implement. 2. CITY TRAFFIC COMMISSION TO ADVISE HOW THE CITY SHOULD PROCEED WITH THE REQUEST FOR LOADING ZONES/GREEN CURB IN FRONT OF THE 8424 GARVEY AVENUE PROPERTY. Option 1: Deny the request for green curb and leave the existing curb marking and time restricted parking as is. Option 2: Approve some portion in front of the applicant's property with green curb and determine at which location it should be installed (Option A or Option B as shown in Figure 6). It is assumed that 18' (feet) to 20' (feet) equates to 1 parking space. Please note that if green curb is installed this would mean that that segment will continually be for 20 minutes parking only. This can be either 1 space between the applicant's property and the neighbors (Option A) or 1 space between the two driveways (Option B). If the loading and unloading zone is to apply during certain hours on a weekday than to avoid confusion it is suggested that signs advising of 20 minute parking be posted and installed where the City desires, instead of painting the green curb. CAMUTCD 28.47: Guidance: Where only limited -time parking or parking in a particular manner are permitted, the signs shall have a green legend and border on a white background (Permissive Parking signs). If the parking restriction applies to a limited area or zone, the limits of the restriction should be shown by arrows or supplemental plaques. If arrows are used and if the sign is at the end of a parking zone, there should be either no arrows or a single -headed arrow pointing in the direction that the regulation is in effect. If the sign is at an intermediate point in a zone, there should be a double -headed arrow pointing both ways. The following are sample signage that can be considered.
