CC - 1960 - 60 - Regulating Public Dancingr-O f~ RESOLUTION NO. 60-`60 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ORDERING, CALLING AND. PROVIDING FOR A SPECIAL ELECTION TO BE HELD IN SAID CITY ON NOVEMBER 8, 1960, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS OF SAID CITY A PROPOSAL REGULATING PUBLIC DANCING IN CERTAIN ESTABLISHMENTS WITHIN THE CITY OF ROSEMEAD AND REQUESTING THE BOARD OF SUPERVISORS OF LOS ANGELES COUNTY TO CONSOLIDATE SAID ELECTION WITH THE GENERAL STATEWIDE ELECTION TO BE HELD ON SAID DATE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: Section 1. That a special e is hereby called and ordered to b on Tuesday, November 8, 1960, for to the electors of said city the-: ing ordinance should be adopted: "THE PEOPLE OF ROSEMEAD DO ORDAIN AS FOLLOWS: Section 1. No person shall open, conduct or operate a pa p-tic dance or participate in or allow public dancing in any place in the City of Rosemead where alcoholic beverages are sold, served, given or furnished, except as herein provided, or other than in or at a dine and dance restaurant as herein defined, and unless all the following conditions and requirements are complied with and exist: (A) Music for dancing is furnished by not less than two live muscians; (B) There is a dining area furnished and equipped to accommodate at least sixty;persons seated at dining tables at one time, (C) There is a separate dance floor having a minimum unobstructed area of two hundred square feet; (D) The building in which such dance or dances will be held is on property zoned for commercial or industrial use under the provisions of the Rosemead Municipal Code; (E) A valid license has been issued in accordance with°provisions of the Rosemead Municipal Code authorizing such dancing; (F) Off street parking shall be provided a number of parking spaces equal to at least of the number of persons who may be seated at tables at one time. lection be held and the same e held in the City of Rosemead the purpose of submitting - question whether the follow- with one fourth dining. • "Section 2. Section 3. The provisions of this ordinance shall not appiy to any charitable, religious,.fraternal or similar non-profit organization. Section 4. Any provisions of the Rosemead Municipal CocTe n iconflict herewith are hereby repealed." Section 2. That.said proposal shall be designated on the ballot or said election as Rosemead Proposition A; that said ballot shall in addition to any other matter required by law contain the following: :PROPOSITION A. Shall the ordinance regulating : :public dancing in certain establishments in YES :the City of Rosemead be adopted? NO A cross placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 3. That the Board of Supervisors of Los Angeles. County icy requested to consolidate said special election with the general statewide election to be held on November 8, 1960, and it is further requested that the measure appear on the ballot for said statewide election in the manner and form herein- above set forth. Section 4. That the City Clerk is hereby directed to give notice o such election in the manner required by law and to file certified copies of this resolution with the Board of Supervisors and County Clerk of the County of Los Angeles at least sixty days prior to the date of such election.
