CC - 1961 - 01 - Establishing Rosemead Street Lighting DistrictRESOLUTION NO. 61-1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING THE ROSEMEAD STREET LIGHTING DISTRICT AND ORDERING STREET LIGHTING IMPROVEMENT THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City Council heretofore on November 29, 1960, or erne tTe making and filing of a report pursuant to the provisions of Part 1 of Division 14 of the Streets and Highways Code of the State of California. Section 2. On December 13, 1960, pursuant to said order of ti'-Fe pity Council and to the provisions of Part 1 of Division 14 of the Streets and Highways Code, a written report was filed with the City Clerk relating to a proposed street lighting improvement and the formation of a street lighting district. Section 3. On December 13, 1960, said City Council duly adopted Resolution No. 60-86, being a resolution of intention to order the proposed street lighting improvement and to form a street lighting district comprising the area proposed to be assessed for such improvement. Section 4. On December 13, 1960, said City Council duly adopted Resolution No. 60-87, appointing a time and place for the hearing of protests in relation to the proposed street lighting improvement and formation of the proposed street light- ing district. Section 5. Notice of the time and place for hearing such protests was duly published and posted pursuant to said Resolution No. 60-87 and to the provisions of Chapter 5 of Part 1 of Division 14 of the Streets and Highways Code. Section 6. At the time and place appointed therefor, said City ounce considered and passed upon all protests filed and denied any such protests and said City Council thereupon acquired jurisdiction to proceed with the improvement. Section 7. it is hereby ordered that the improvement proposed in a report and Resolution No. 60-86 adopted by the City Council of the City of Rosemead on December 13, viz, the installation, maintenance, operation, repair., supervision and all other services and work necessary for the effective operation of a street lighting system, together with all necessary appli- ances and appurtenances thereto, be made. Section 8. A street lighting district is hereby formed and established to be designated as the Rosemead Lighting District, the boundaries of which district are described as follows: Beginning at the northwesterly corner of Lot 17 of the Baldy View Tract, as shown on map recorded in Book 12, page 191 of Maps, in the office of the Recorder of the County of Los Angeles; thence easterly along the boundary of the City of Rosemead, as same existed on December 13, 1960, and following the same in all its various courses and curves to the point of beginning. Section Zonesare hereby created and established within sai district and are designated by number as Zones 1, 2, 2A, 3, and 4. The boundaries of each of such zones are hereby fixed and described as set forth on Exhibit "A" attached hereto and made a part hereof. Section 10. The estimated cost of the proposed improve- ment for tTe portion of the year from date hereof to June 30, 1961, is determined to be $36,853.00. That portion of such cost within each zone is as follows: Zone 1 $23,977.00 Zone 2 $ 5,003.00 Zone 2A $ 191.00 Zone 3 $ 0.00 Zone 4 $ 7,682.00 The estimated cost of the proposed improvement for the first fiscal year of the district commencing July 1, 1961 and ending June 30, 1962 is determined to be $27,212.00. That portion of such cost within each zone is as follows: Zone 1 $ 5,467.00 Zone 2 $ 5,999.00 Zone 2A $ 382.00 Zone 3 $ 0.00 Zone 4 $15,364.00 Section 11. The City shall bear portions of the estimated cost as follows: For the portion of the year ending June 30, 1961: 100% of the cost of maintenance and operation of the existing facilities and 50% of the costs of any installation as follows: Zone 1 $12,159.50 Zone 2 $ 2,428.00 Zone 2A $ 191.00 Zone 3 $ 0.00 Zone 4 $ 7,682.00 The remainder of such estimated costs shall be borne by each zone. For the first fiscal year beginning July 1, 1961 and ending June 30, 1962 the City shall bear none of the estimated costs and the several zones shall bear 100% of the costs within such zones. Section 12. The general fund of the City of Rosemead is hereby esi-gnated for the payment of any costs to be borne by the City hereunder. The City shall advance to the district from said general fund the portion of the costs chargeable to the District and the various zones thereof until the receipt of funds by the district from taxes assessed within said district. Section 13. It is ordered that the portion of the estimate cotes proposed to be borne by the district and each zone therein be paid by special assessment taxes levied upon all the lands, exclusive of improvements, within the respective zones within such district, except lots or parcels of land belonging to the United States of America, or to the State of California, or to the County of Los Angeles, or to the City of Rosemead, or to any school district-or public agency, in use in the performance of any public function. - 2 - Section 14. The proposed improvement shall continue for a period ten years commencing on January 4, 1961 and ending on January 4, 1971. The maintenance and servicing to be furnished by the City shall commence on January 4, 1961 and end on June 30, 1961. Section 15. The City Clerk is directed to file a certified copy of this resolution, together with a map or plat of the District created herewith with the County Assessor of Los Angeles County and with the State Board of Equalization.
