A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD REQUESTING THE STATE
BOARD OF EQUALIZATION TO PERMIT CERTAIN
RECORDS TO BE EXAMINED PURSUANT TO SECTION
7056 OF THE REVENUE AND TAXATION CODE
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, the City of Rosemead has heretofore
entered into a contract with the State Board of Equalization
of the State of California for the collection by said Board
of sales and use taxes under the Bradley-Burns Uniform Local
Sales and Use Tax Law, and
WHEREAS, saiid City requires certain information
from the sales and use tax records of said Board pertaining
to sales and use taxes collected for said City in order to
carry out certain duties, functions and proceedings incident
to the municipal government administered by said City,
NOW, THEREFORE, the City Council of the City of
Rosemead hereby RESOLVES as follows:
SECTION 1. The City Council of said City hereby
request the State oard of Equalization to permit the City
Administrator of the City of Rosemead, as Deputy Tax Collector
of said City, to examine any and all sales and use tax records
of said Borad pertaining to sales and use taxes collected
for the City of Rosemead pursuant to the contract between the
Board and said City. The records of said Board with respect
to businesses situated outside of but in proximity to the
city limits of the City of Rosemead are hereby found and
determined by the City Council to pertain to sales and use
taxes collected by the Board for the City pursuant to such
contract and are included within the scope of the request
herein made.
SECTION 2. The:City Administrator of the City of
Rosemead is-FiereU-y appointed and designated,as Deputy Tax
Collector of the City of Rosemead for all pdrposes of this
resolution, and said State Board of Equalization, its officers
and agents, are authorized and requested to permit said City
Administrator to inspect and examine said records from time
to time without any further resolution or regquest from the
City Council, until notified of rescission, revocation of
modification of this resolution.
SECTION 3. Information obtained by said City
Administrator pursuant to this resolution shall not be made
public, nor shall such information be disclosed by said City
Administrator to anyone other than duly elected or appointed
officers or employees of the City of Rosemead acting within
the course and scope of their duties.,
