PRESENT: Mayor Low, Council Members Armenta, Clark, and Tang ABSENT: Mayor Pro Tem Dang PLEDGE OF ALLEGIANCE was led by Council Member Tang INVOCATION was led by Council Member Clark STAFF PRESENT: City Manager Kim, City Attorney Richman, Assistant City Manager Bruckner, Director of Finance Chua, Director of Parks an4Recreation Boecking, Director of Public Works Chung, and City Clerk Hernandez 1. PUBLIC COMMENT Mayor Low opened for Public Comment, There being no comments, closed the Public Comment. 2. PRESENTATIONS A. Introduction -of New City Staff Assistant City Manager, Michael Bruckner; Finance Director, Bryan Chua; and Parks and Recreation Supervisor Roman Rodriguez City Manager Kim introduced the newly hired Assistant City Manager, Michael Bruckner. Assistant City Manager Bruckner thanked City Manager Kim and the City Council for the opportunity to work and serve the Rosemead community. The City Council welcomed Assistant City Manager Bruckner to the Rosemead family. City Manager Kim introduced the newly hired Director of Finance, Bryan Chua. Director of Finance Chua thanked the City Council and City Manager for welcoming him to the Rosemead Team. City Council welcomed the Director of Finance to the Rosemead family. Director of Parks and Recreation Boecking introduced the newly hired Park Supervisor, Roman Rodriguez. Rosemead City Council Regular Meeting AGENDA ITEM 5.11 Minutes of June 28, 2022 Page 1 of 9 Parks and Recreation Supervisor Rodriguez thanked the City Council for the opportunity to work with the staff and the Rosemead community. The City Council welcomed the Parks and Recreation Supervisor and said they look forward to working with him. The City Council presented a plaque of appreciation to outgoing Interim Director of Finance Paula Chamberlain, for her service to the City for over a year and four months. Mayor Low praised and thanked Mrs. Chamberlain for helping the City during challenging times. Mrs. Chamberlain thanked the City Council for the opportunity to serve the community. Council Member Clark thanked Mrs. Chamberlain for her service and thanked the Finance team for placing the City in the top 15 for Fiscal Stability recognition out of 471 cities. Council Member Armenta commended Mrs. Chamberlain for helping clean up and improve many areas in the Finance Department. Council Member Tang thanked Mrs. Chamberlain for her leadership and for serving the City. B. Announcement of Recipients of the Republic Services 2022 Rosemead Scholarship Program Susan Ayala, Municipal Manager with Republic Services, stated each year, five City of Rosemead residents who are college -bound high school seniors submitted an essay on the importance of recycling, global comparatives of diversion programs, and sustainable solutions to combating contamination issues. The following five winners were presented with a $1,000 scholarship. • David Gallardo • Jasmine To • Johanna Sycip • Kalia Wong • Lyonson Enriquez-Pott The City Council presented certificates of recognition and In -n -Out gift cards to the winners for their commitment to continuing their higher education. Mayor Low congratulated the winner recipients and wished them the best in their future endeavors. Council Member Armenta congratulated the winners on their accomplishments and focus during the pandemic. Looks forward to seeing them come back and serve their communities. Also, recognized the parents for supporting their children. Council Member Tang noted he felt inspired by the aspiration of the students to become leaders in their community. 3. PUBLIC HEARING - None 4. CONSENT CALENDAR Mayor Low opened for public comment for items in the Consent Calendar City Clerk Hernandez read a comment submitted by resident Barbara Murphy on item G, expressing concerns with the City allocating $16,800 for clean-up at the SCE Property at the intersection of Mission Drive, Walnut Grove Avenue and Wells Avenue. SCE changed its policy regarding leasing its vacant properties from a 30 -year lease to a five-year, lease. This caused the California Department of Parks and Recreation to not firad the grant to create a park at this location. The $16,800,00 allocated for clean-up was contingent on getting the grant funding. Since that is no longer viable, the taxpayers shouldn't have to pay to clean the SCE property. Claims and Demands Resolution No. `2022-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $706,034.67 CHECKS NUMBERED 111450 THROUGH NUMBER 111562, DRAFTS NUMBERED 5811 THROUGH NUMBER 5822 AND EFT NUMBERED 51119 THROUGH NUMBER 51139 INCLUSIVELY Recommendation: Adopt Resolution No. 2022-43. Consideration of Resolution No. 2022-42 Reauthorizing the Need for Teleconferencing Option for City Council and Commission Meetings Pursuant to Assembly Bill No. 361 The City Council will consider reinstating provisions of Assembly Bill No. 361, providing an alternative to the public meeting, teleconferencing requirements of Government Code Section 54953(b)(3) as long as there is a state of emergency, and the Legislative Body makes certain findings regarding the state of emergency. Resolution No. 2022-42 makes the required findings under AB 361, and if adopted, it will allow the City to reinstate teleconference accessibility for public meetings to help mitigate the current increase in community transmission of COVID-19. Recommendation: That the City Council adopt Resolution No.2022-42, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AUTHORIZING THE NEED FOR TELECONFERENCING 'OPTION FOR CITY COUNCIL AND COMMISSION MEETINGS PURSUANT TO ASSEMBLY BILL NO. 361 AND MAKING FINDINGS AND DETERMINATIONS REGARDING THE SAME D. Crossing Guard Services Agreement and Annual Crossing Guard Cost Sharing Agreements with Rosemead and Garvey School Districts The proposed Agreement with All City Management Services, Inc. (ACMS) is for the annual crossing guard services near local public schools, and the proposed Agreements with Rosemead and Garvey School Districts are for cost-sharing (one-half between the City and each District) for crossing guard services. The total cost for providing Crossing guard services for both school districts is approximately $245,227.50 of which Rosemead School District's portion is approximately $57,219.75 and Garvey School District's portion is approximately $65,394.00. The City's portion ($122,613.75) is included in the City's proposed Fiscal Year 22-23 Budget. Recommendation: That the City Council take the following actions: Execute the Agreement with All City Management Services, Inc. for crossing guard services for Fiscal Year 22-23; and 2. Execute the cost sharing Agreements with Rosemead and Garvey School Districts for funding the crossing guard services for the Fiscal Year 22-23. Second Amendment to the Janitorial Services Contract On March 27, 2018, the City Council approved a three-year contract with Base Hill (formerly known as Jan Point) to perform routine janitorial services at various City facilities. On March 23, 2021, the City Council approved the First Amendment to the contract for a one-time Consumer Price Index (CPI) adjustment, the addition of COVID-19 disinfecting services and related costs, and a two-year extension to March 31, 2023. On February 14, 2018, prior Public Works staff prepared and advertised a Request for Proposal (RFP) for the janitorial services. The RFP included an electronic spreadsheet where the prospective bidders were required to input bid unit cost data to calculate their fee proposal. Due to formula errors in the spreadsheet, the total contract amount approved by City Council on March 27, 2018, was miscalculated and incorrect, resulting in an annual budget overage of $5,254 per year for the two-year extension term period. Due to the bid unit price calculation error, staff is requesting that the City Council approve the Second Amendment to the contract to include additional funding in the amount of $5,254 per year for a total annual amount not to exceed $280,207. Recommendation: That the City Council authorize the Second Amendment to the Base Hill contract to increase the annual compensation for the two-year extension period by $5,254 for each year for a total annual amount not -to -exceed $280,207. F. Professional Service Agreement — Printing and Mailing Services for Recreational Brochure The Recreation Brochure is the Parks and Recreation Department's program and activity guide. The City of Rosemead utilizes a provider to print and mail the brochure to Rosemead residents. Aspartof the FY 22-23 budget, City Council has allocated funding in the amount of $46,600 for the printing and mailing services. On, April 26, 2022, staff issued a Request for Proposal for the printing and mailing services and received one proposal. Staff recommends that the City Council approve the Professional Services Agreement with The Sauce Creative Services for a one-year terns for the printing and mailing of the Recreation Brochure. Recommendation: That the City Council approve the Professional Services Agreement with The Sauce Creative Services to provide printing and mailing services and authorize the City Manager to execute the agreement. G. First Amendment to Professional Services Agreement with Evergreen Landscaping for Landscape Maintenance Services On June 11, 2019, the City Council approved a three-year Agreement with Evergreen Landscaping to perform landscape maintenance services for an annual amount not -to -exceed $343,740. The existing Agreement with Evergreen Landscaping is set Rosemead City Council Regular Meeting Minutes of June 18, 1022 Page 5 of 9 to expire on June 30, 2022. Staff is requesting the City Council to authorize the First Amendment to include a one-year extension to the Agreement for landscape maintenance services to June 30, 2023, and an increase in compensation in the amount of $22,200 for additional landscape maintenance services for an annual not - to -exceed amount of $365,940. Recommendation: That the City Council authorize the First Amendment to the Evergreen Landscaping Agreement for a one-year extension (July 1, 2022 to June 30, 2023) for general scope of services per the original contract and increase the contract amount by $22,200 for additional landscape maintenance services for a new total annual amount not -to -exceed $365,940. Council Member Clark asked why the City was maintaining the Southern California SCE (SCE) property while there is no park. Director of Public Works Chung explained the City entered into a licensed agreement in September 2021 for five years. While pursuing a Federal Grant to create a new potential park that would cost about $7 million, the City entered a limited lease term with SCE. Although the grant did not go through, the license agreement was still in effect. Therefore, the City is responsible for the maintenance of the property for the remainder of the five years.;City staff continues to pursue other grants for a potential park at that same site. In aIdition„the staff is evaluating the reduction of the scope of work in the SCE property to use city funds to fund the park. Council Member Clark asked if Southern California SCE (SCE) still owned the property. Director of Public Works Chung clarified the property is owned by SCE and leased totheCity to develop it; tberefore, the City agreed to maintain the seven -acre lot. Council Member Armenta stated since the license agreement was entered in 2021 for the potential of a park, which did not occur, she asked if that nullifies the license agreement, since the lot was not being used by the City. She stated that staff is still looking for grant opportunities and questioned why did the City have to maintain a lot where a park isnot being developed. She also added there have been issues with other SCE properties due to lack of weed abatement. Director of Ptiblic Works Chung explained the City entered into a license agreement with SCE for the lot during the planning stage of the park grant because it placed the City in the best position to apply for a grant. Unfortunately, the grant did not go through; however, the staff is still pursuing other grant opportunities. Meanwhile, the City is in a license agreement with SCE. Mayor Low asked if the license agreement stipulated that the City could only build a park and maintain the property under the agreement. Director of Public Works Chung affirmed and clarified that only a park could be built in the SCE lot. Rosemead City Council Regular Meeting Minutes of June 28, 2022 Page 6 of 9 Council Member Armenta asked if a park is never built, then could the City charge SCE for the maintenance of the lot. Director of Public Works Chung replied no. City Manager Kim explained there are different stages of any development. One of the most important stages of a project or potential project is site acquisition. He clarified that most grant applications require the applicant to have control and acquisition of a location. When there is no acquisition of a location when applying for a grant, it makes it more difficult to obtain a grant. He also noted that City staff was not abandoning the idea of the project but was actively looking for other funding sources for the potential park. The new potential park may not be grand as initially planned but like the Jay Imperial Park. While the City controls the property, The City assumes the maintenance responsibilities. Council Member Tang asked if there is an opportunity to craft the license agreement to be contingent, if a park is not built in the first two or three years, could the maintenance cost of the lot be shared while staff pursues grant opportunities. City Manager Kim explained that it really does not happen because SCE as the property owner, would have different opportunities. SCE could relinquish their property to anybody for any other project, such as a nursery. Council Member Armenta also noted it is a liability issue if the City shares maintenance costs`. Suppose there was a fire, wha would be held liable for the cost of repairs. City Manager Kim stated he would double-check on the language in the license agreement, but usually the responsibility for the site would be the City's, unless certain clauses in the license agreement would exempt the City from certain liability. Council Member Armentathanked City Manager Kim and Director of Public Works Chnng for including, the Savannah Cemetery in the scope of work for the landscaping maintenance services. She stated the cemetery is a historical landmark in California and the Savannah Association appreciated the City's assistance with the landscape maintenance. MATTERS FROM CITY MANAGER & STAFF A. COVID-19 Update This is a recurring item that will be on the agenda to update the City Council on items related to COVID-19. City Manager Kim reported that the Department of Public Health continues to require masks on all four forms of public transportation within the County. The City of Rosemead currently has 12,020 positive COVID-19 cases and 190 deaths. 90% of Rosemead residents have at least one dose of the COVID-19 vaccine, and 83.3% of Rosemead residents are fully vaccinated. In partnership with Wealth by Health will provide a COVID-19 vaccination clinic at the Rosemead Community Recreation Center (RCRC) Sunday, July 17. In partnership with Chinatown Services Center, the City of Rosemead will provide a COVID-19 'vaccination clinic at RCRC on Wednesday, July 20. City employees and the public no longer require masks at City facilities, but it is highly recommended. Staff continues to monitor all health and safety protocols and recommended protocols by the County of Los Angeles Health Department to prevent the spread of the virus among City staff and community members. Recommendation: That the City Council discuss and provide further direction. 6. MATTERS FROM MAYOR & CYTY COUNCIL A. Council Comments Council Member Tang stated he was delighted to see the new City staff joining the Rosemead Team and conimWed City Manager Kim for his efforts in quickly putting a full team together. Council Member Armenta reported she attended the National Association of Latino -Elected Officials conferenin Chicago. She noted the educational sessions included toffs on infrastructure, moving on from COVID Pandemic, innovative thinking, and a special guest speaker Vice -President Kamala Harris. Added, she looked forward to participating in the 4`h of July festivities after a two-year hiatus due to the pandemic. Council member Clark mentioned that for the first time, she would miss the 4`h of July parade due travels with her family out of town. She wished the City a good 4th of July celebration and commended the staff for their hard work. Mayor Low also agreed the community was looking forward to the 4th of July celebrations after two years of not having a parade, carnival, and fireworks.
