CC - 1970 - 048 - Meeting of City Selection Committee of Southern CA Rapid Transit DistrictRESOLUTION NO. 70- 48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CALLING FOR A MEETING OF THE CITY SELECTION COMMITTEE OF THE SOUTHERN CALIFORNIA RAPID TRANSIT DISTRICT. THE CITY COUNCIL OF THE CITY OF ROSEMEAD HEREBY RESOLVES AS FOLLOWS: Section 1. The Southern California Rapid Transit District law, and in particular Public Utilities Code Section 30,209, specifically provides that if the term of office of a City Councilman terminates, and such City Councilman is serving as a member of the City Selection Committee and as a member of the Board of Directors of the Southern California Rapid Transit District, a vacancy is automatically created in his office as a member of the City Selection Committee and also as a member of the Board of Directors of the Southern California Rapid Transit District. Section 2. The Southern California Rapid Transit District law, and in particular Section 30,221 of the Public Utilities Code, provides that whenever a vacancy occurs in the members of the Board of Directors of the District appointed by the City Selection Committee, the same shall be filled by the City Selection Committee, and such City Selection Committee shall meet within thirty days following the occurrence of such vacancy, to appoint a Director to fill the vacancy. Section 3. The Southern California Rapid Transit District law, and in particular Section 30,221 of the Public Utilities Code, provides that the Board of Directors of the District shall deter- mine promptly the time and place of the meeting of the City Selec- tion Committee in order to fill such vacancy, and requires the Board of Directors of the District to give the members of the City Selection Committee at least ten (10) days' notice of such meeting. Section 4. It appears that on April 14, 1970, a vacancy was automatically created on the Board of Directors of the District, by virtue of the termination of the term of office of Director Gleckman as a member of the City Council of the City of West Covina. It,further appears that notwithstanding the occurrence of such vacancy on the Board of Directors, said Board of Directors has not discharged its mandatory duty under the statute to determine the time and place of the meeting of the City Selection Committee, and to give notice of such meeting, in order that said vacancy may be filled. Section 5. The City Council of the City of Rosemead, constituting an appointing body as defined in the Southern California Rapid Transit District law, hereby calls upon the Board of Directors of the Southern California Rapid Transit District, to forthwith set the time and place of meeting of the City Selection Committee on the first date permissible under the law, and to give the members of the City Selection Committee at least ten (10) days' notice thereof, in order that said City Selection Committee may fill said vacancy on the Board of Directors, or, that said Board of Directors forthwith report to all members of the City Selection Committee why it has not done so. -1- 9 0 Section 6. The City Clerk of the City of Rosemead is hereby directed to transmit a certified copy of this Resolution forthwith to the Board of Directors of Southern California Rapid Transit District, and to further transmit copies of this Resolution to each City Council of each City within the Southern California Rapid Transit District, other than the City of Los Angeles.
