CC - 1970 - 060 - Establish Priority for Grade Separation and Authorize Road Commissioner to Initiate Proceedings~J CITY OF ROSEMEAD RESOLUTION NO. 70-60 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD REQUESTING THAT THE PUBLIC UTILITIES COMMISSION CONSIDER AND ESTABLISH PRIORITY FOR THE GRADE SEPARATION ON LOWER AZUSA ROAD EAST OF ENCINITA AVENUE, AND AUTHORIZE THE COUNTY ROAD COMMISSIONER TO INITIATE PROCEEDINGS AND NEGOTIATE WITH ALL INTERESTED PARTIES FOR THE PROPOSED IMPROVEMENT. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES RESOLVE AS FOLLOWS: WHEREAS, the Legislature of the State of California, at its regular session of 1957, did enact legislation to add Section 1202.5 to the Public Utilities Code, and to amend Section 189 of and to add Sections 190 and 191 to the Streets and Highways Code, such legislation added to the laws of the State of California by Chapter 2091, Statutes of 1957; and WHEREAS, the Legislature of the State of California, at its regular session of 1959, did enact legislation to amend Sections 189 and 190 of the Streets and Highways Code, such legislation added to the laws of the State of California by Chapter 1763, Statutes of 1959; and WHEREAS, the Legislature of the State of California, at its regular session of 1967, did enact legislation to amend Sections 189 and 190 of the Streets and Highways Code, such legislation added to the laws of the State of California by Chapter 1403, Statutes of 1967; and WHEREAS, these said amendments and additions direct a separate fund for grade separations, in the amount of $5,000,000, be added to the budget of the State Division of Highways as a participating fund; and WHEREAS, the Cities of Rosemead and Temple City and the County of Los Angeles are desirous of constructing a grade separated crossing for Lower Azusa Road at the Southern Pacific Transportation Company east of Encinita Avenue; and WHEREAS, the construction of the said grade separation is an integral part of the improvement program of this important major highway. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Rosemead hereby requests the California Public Utilities Commission to consider this project under the provisions of the above legislation and establish a priority for its construction. BE IT FURTHER RESOLVED that a copy of this resolution be sent to the California Public Utilities Commission. BE IT FURTHER RESOLVED that the County Road Commissioner be and he is hereby.authorized to initiate proceedings to the State Public Utilities Commission for the proposed improvement and negotiate with all interested parties for the proposed improvement.
