PC - Minutes - 08-01-22Minutes of the PLANNING COMMISSION MEETING August 1, 2022 The regular meeting of the Planning Commission was called to order by Commissioner Lopez at 7:00 p.m PLEDGE OF ALLEGIANCE —Commissioner Lopez INVOCATION — Commissioner Lopez ROLL CALL — Commissioners Escobar, Lopez, and Ung. Chair Berry was absent. (Due to Chair Berry's absence, Commissioner Lopez acted as Chair.) STAFF PRESENT — Interim Community Development Director Wong, City Attorney Gutierrez, Planning & Economic Development Manager Valenzuela, Associate Planner Lao, Assistant Planner Wong, and Commission Liaison Huang ADMINISTRATION OF OATH OF OFFICE — Commission Liaison Huang administered the Oath of Office to re -appointed Commissioner Lana Ung, and newly appointed Commissioner Emma Escobar. COMMISSION REORGANIZATION — Chair and Vice -Chair will be elected Planning & Economic Development Manager Valenzuela recommended to move the Commission Reorganization to a future meeting when Chair Berry and Vice -Chair Tang returns to the Planning Commission. Commissioner Lopez made a motion, seconded by Commissioner Ung to move the Commission Reorganization to a future meeting when all Commissioners are present. Vote resulted in: Ayes: Escobar, Lopez, and Ung Noes: None Abstain: None Absent: Berry Roll call vote resulted in 3 Ayes and 0 Noes. 1. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Gutierrez presented the procedure and appeal rights of the meeting. 2. PUBLIC COMMENTS FROM THE AUDIENCE There being no comments, Commissioner Lopez opened and closed the Public Comment period. 3. PUBLIC HEARINGS A. CONDITIONAL USE PERMIT 22.01 (CUP 22-01) — Lai C. La has submitted a Conditional Use Permit application, requesting to establish a massage services use located at 2111 San Gabriel Boulevard, Unit F (APN: 5279-008-032), in the Medium Commercial (C-3) zone. The proposed project would not increase the floor area of the existing building. Per Rosemead Municipal Code Section 17.16.020, approval of a Conditional Use Permit is required in order to establish a massage services use within a C-3 zone. PC RESOLUTION 22-04 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, Rosemead Planning Commission Meeting Minutes of August 1, 2022 Page 1 of 4 COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 22-01 FOR THE OPERATION OF A MASSAGE SERIVCES USE. THE SUBJECT SITE IS LOCATED AT 2111 SAN GABRIEL BOULEVARD, UNIT F (APN: 5279-008-032), IN A MEDIUM COMMERCIAL (C-3) ZONE. STAFF RECOMMENDATION - It is recommended that the Planning Commission adopt Resolution No. 22-04 with findings, and approve Conditional Use Permit 22-01, subject to the 27 conditions. Assistant Planner Wong presented the Staff Report Commissioner Lopez opened the Public Hearing Commissioner Escobar noted that all zoning requirements are met, parking is satisfied, there are no exterior modifications to the existing unit and the conditions of approval are standard for a CUP, so she had no further questions. Commissioner Lopez asked how many massage parlors are in the City, and how many within the vicinity of this location. Assistant Planner Wong responded it will be seventeen, including this location. He referred to the map of massage establishments and stated there is one off Klingerman Street and San Gabriel Boulevard, which is relatively in proximity. Commissioner Lopez inquired if there were any safety concems around the massage businesses which required the police to step in. Assistant Planner Wong expressed that the Sherriff Investigator had suspected some locations of improper activities and Code Enforcement has gone out to inspect the site. Commissioner Lopez further expressed his concern about the suspicious activities around the massage business types. He inquired if there were any suspicious activities at the other massage parlor closest to this location. Assistant Planner Wong answered no suspicious activities were reported from the existing massage parlor closest to this location. Seeing no additional questions, Commissioner Lopez open the public testimony portion of the public hearing. He asked if there was anyone who would like to speak on this matter and if we received any written comments. Commission Liaison Huang responded that there are no public comments for this item. There being no public comment, Commissioner Lopez closed the public comment period. ACTION: Commissioner Ung made a motion, seconded by Commissioner Escobar, to adopt Resolution No. 22-04 with findings, and approve Conditional Use Permit 22-01, subject to the 27 conditions. CONDITIONAL USE PERMIT 22-02 (CUP 22.02) — Wing Yee Lam has submitted a Conditional Use Permit application, requesting to establish a massage services use located at 9011 Garvey Avenue, Unit B (APN: 8595-011-009), in the Medium Commercial (C-3) zone. The proposed project would not increase the floor area of the existing building. Per Rosemead Municipal Code Section 17.16.020, approval of a Conditional Use Permit is required in order to establish a massage services use within a C-3 zone. Commissioner Ung noted that this new massage establishment would be across the street from an existing massage parlor and questioned if there are any restrictions for massage establishments within a certain vicinity of each other. Assistant Planner Wong stated no, we do not have any restrictions listed in our Municipal Code. Commissioner Lopez inquired if there were any safety concerns or police reports around this massage business. Assistant Planner Wong answered there were no incidents. He stated he had spoken with the Chief of Police about police activity close by as it is adjacent to the existing massage parlor, and no concerns were reported in the area as well. Commissioner Lopez inquired if there is a limit to the amount of massage parlors allowed within City limits. He questioned if they could establish the business as long as we approve the item. Assistant Planner Wong stated as long as they meet the findings, there is no limit in the City. Commissioner Lopez questioned if Public Safety conducts routine check-ups on massage establishments or if it's on call needed basis. Assistant Planner Wong explains that it can be a combination of both and can be complaint driven and the Code Enforcement Division does occasionally make rounds to inspect the sites. Seeing no additional questions, Commissioner Lopez opened the public testimony portion of the public hearing. He asked if there was anyone who would like to speak on this matter and if we received any written comments. Other than the public comment listed in the Staff Report, Commission Liaison Huang responded there are no additional public comments for this item. There being no public comment, Commissioner Lopez closed the public comment period. MATTERS FROM STAFF Planning & Economic Development Manager Valenzuela congratulated Commissioner Ung on her re -appointment, welcomed Commissioner Escobar to the Planning Commission and introduced Interim Community Development Director Stan Wong. 6. MATTERS FROM THE CHAIR & COMMISSIONERS Commissioner Ung inquired about the property on Garvey Avenue and Del Mar Avenue Planning & Economic Development Manager Valenzuela explained that the developer is working with staff on a new project. She added they will no longer proceed with the previous project that was approved by the Planning Commission and City Council, but instead, a project will be developed that meets the Garvey Avenue Specific Plan. Commissioner Lopez inquired about the project on Garvey Avenue and Delta Avenue. Planning & Economic Development Manager Valenzuela shared that the project is going very well as they were able to lease out the first floor of the commercial portion as an adult health center, received final approval, and most of the tenants are moved into their apartments. Commissioner Lopez expressed that ifs great to see things moving along. 7.
