The special meeting of the Rosemead City Council was called to order by Mayor Low at 6:01 p.m.,
in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California.

Mayor Low opened the Public Comment period.
Tania Castaneda, Municipal Relationship Manager, Republic Services, shared about a
new education program that Republic Services is partnering with a nonprofit to support
at home educators that offers free educational resources for pre -K through 12' grade,
which will incorporate recycling and sustainability education. The curriculum contains
step-by-step lesson plans with supporting teaching materials, including classroom
activities, videos, handouts, virtual field trips and completion certificates.
City Clerk Hernandez read a Public Comment sent via email from Katrina Lacema,
Asian Pacific Resource Center Librarian, Rosemead Library, wished everyone a happy
Asian Pacific American Heritage month. Stated the Library has an exciting slate of virtual
programs to celebrate throughout May: Saturday, May 151h — A Beginners Guide to
Cooking Sushi Workshop; LA County Library partnered with the Music Center:
Performing Arts Center of Los Angeles for a series of cultural dance and music
performances; and to close off the month, we have invited youth led nonprofit Chinatown
Alley Way Tours to conduct a Minecraft Tour of San Francisco's Chinatown, the oldest
Chinatown in the U.S. She encouraged the community to visit the Library's website for
more information on the programs offered.

3. PRESENTATIONS
A. Introduction of Newly Appointed Chief of Police Lieutenant Joe Hernandez
Captain Reyes, Los Angeles County Sheriff's Department, introduced LASD
Lieutenant Joe Hernandez as Rosemead's new Chief of Police.
Chief of Police Hernandez stated he is honored; thanked the Council for this
opportunity and looks forward to serving the community diligently while
enhancing its partnership.
The Council congratulated Chief Hernandez on his appointment and welcomed
him to his role.
B. Declaring the Week of May 16-22, 2021, as "National Public Works Week" in the
City of Rosemead
Acting Director of Public Works Ansari received the Proclamation on behalf of
the Public Works Department.
The Council thanked Public Works for all their hard work behind the scenes to get
everything done between planning, logistics, physical labor, etc.

C. Declaring the Month of May as "Asian American and Pacific Islander Heritage
Month" in the City of Rosemead
Mayor Low stated she is happy to present this Proclamation to recognize the Asian
American and Pacific Islander heritage. Indicated she asked the City Clerk to check
if her fellow Council Members were okay with having their signature added to this
proclamation; noted Council Member Clark approached her before the meeting
with concerns.
Council Member Clark indicated she is not opposed to this Proclamation as she has
four wonderful Asian grandkids; noted she signed the other proclamation for the
anti -hate crimes against Asian Americans and Pacific Islanders. Stated she is taking
this opportunity as we need a standard of what is considered okay to declare in
the city.
Mayor Low asserted this item is a proclamation and not being voted on; asked the
City Attorney if it would be appropriate to have the City Clerk check with each
Council Member prior to the meeting if they are okay with having their signature
included on the respective proclamation.
City Attorney Richman responded in another city we had concern of a Brown Act
violation, specifically how these proclamations get on an agenda? If you want to
have something more formal, you can do so or you can continue the current process.
It is her understanding that the issue is not with the proclamation at hand, but
rather the proclamation process itself. It would be more appropriate for Council to
agendize this so they can have a more substantiative discussion on the proclamation
process.
Mayor Low asked if staff could agendize discussion of the proclamation process at
a future meeting; checked it' Council Member Clark was ok with supporting this
proclamation at this time.
Council Member Clark replied yes, its fine to include her signature on the
proclamation.
Council Member Ly opined the beautiful thing about Rosemead is our diversity;
stated it is important to acknowledge, understand, and celebrate the diversity
through our various events such as the Moon festival, Fourth of July, etc. Those
events do not bring in one specific community, but rather the whole community.
Council Member Armenta stated it is unfortunate what the AP! community is going
through. It is important for us to become more culturally aware and making sure
that no culture or ethnicity is left out. We need to embrace all heritages.
Mayor Pro Tern Dang thanked Mayor Low for bringing this proclamation to light;
stated he is honored to have his signature on this proclamation as Asian Americans
have contributed so much with their vibrant culture and heritage.

C. Approval of the FY 2021-2022 Annual Action Plan as Required by the Community
Development Block Grant (CDBG), Home Investment Partnerships (HOME), and
Community Development Block Grant — Coronavirus (CDBG-CV3) Programs
At the April 27, 2021 meeting, the City Council conducted a public hearing on the
proposed FY 2021-2022 Annual Action Plan and directed staff to adjust the
CDBG-CV3 funding allocation to support Family Promise as a social service
activity. After the meeting, Staff followed up with Family Promise on next year's
service estimates and updated CDBG-CV3 carryover and is recommending a
CDBG-CV3 allocation of $15,000 for FY 2021-2022.
Recommendation: That the City Council take the following actions:
Approve the FY 2021-2022 Annual Action Plan including CDBG, HOME, and
CDBG-CV3 funding recommendations, and authorize the submittal of the
Annual Action Plan to the U.S. Department of Housing and Urban
Development (HUD);
2. Authorize the City Manager to execute all appropriate and necessary documents
to receive funding and implement approved use and make necessary budget
adjustments based on HUD's final allocation amount; and
3. Authorize the City Manager to execute sub -recipient agreements with the non-
profit organizations receiving CDBG, HOME, and CDBG-CV3 allocations in
the Annual Action Plan.
ITEMS PULLED FOR SEPARATE DISCUSSION
D. Storm Water Catch Basin CPS Unit Upgrade Project No. 49011 — Award of
Contract
As part of the City's Fiscal Year 2019-2020 Capital Improvement Program, the
City Council approved the Storm Water Catch Basin CPS Unit Upgrade Project.
The project consists of retrofitting two hundred fifty-six (256) storm water catch
basins with trash capture devices to prevent infiltration of trash from the stormwater
system to the waterways. The project is funded with Safe, Clean Water Program
(SCWP) Funds in the amount of $210,000.
Recommendation: That the City Council take the following actions:
1. Approve the plans and specifications for the Storm Water Catch Basin CPS Unit
Upgrade Project — Project No. 49011; and
2. Authorize the City Manager to enter into a contract with United Storm Water,
Inc., for the bid amount of $182,573.00. In addition, authorize an amount of
$18,257.30 (10%) as a contingency to cover the cost of unforeseen construction
expense, for a total amount of $200,830.30.

Council Member Armenta pulled this item, expressing concern that there was
only one bid submitted, which she finds hard to believe when the contract is for
a total amount of $200,830.30. Stated MS4 is coming, and we need to be in
compliance; noted that she does the Water Policy for the Senator, and pointed
out that there are many companies going out bidding to assist cities to ensure
they're compliant. Inquired how this bid was advertised and if other contractors
were invited to participate? Also, asked if there was any indication why there
was only one bid submitted?
Acting Public Works Director Ansari responded normal procedure of public
bidding was followed by staff; informed Council that a Notice of Inviting Bid
was published March 18th and 25th. Stated there was no indication why only
one bid was received - it does happen, but not often; opined I agree it is
important to have multiple bids submitted as it keeps everyone honest.
Mayor Low asserted the key thing is that staff followed our normal bidding
procedures.
Council Member Armenta emphasized we want to ensure we are being
transparent.
Council Member Clark asked if our procedure was only to advertise in the trade
publications and not to reach out directly to contractors.
Mr. Ansari replied staff does not pick -11p the phone and call contractors to
invite them to participate; reiterated that staff followed proper bidding
procedures of publishing in the local newspaper and trade publications.
ACTION: Moved by Council Member Ly and seconded by Mayor Pro Tern
Dang to take the following actions:

6. MATTERS FROM CITY MANAGER & STAFF
A. Garvey Park Youth Center

At the direction of the City Council and as part of the Rosemead 2018-2020
Strategic Plan, staff was asked to evaluate the potential to locate a youth program
at Garvey Park with usage of the current City facility with Parks & Recreation staff.
Staff has identified the potential expansion of youth programs and usage of the
current facility beginning next fiscal year 2021-2022.
Recommendation: That the City Council discuss and provide feedback and further
direction.
Director of Parks and Recreation Boecking stated that the Garvey Park Facility
currently has a reception/registration area, a large multi-purpose room, a smaller
multi-purpose room with a single restroom and shower, one storage room, staff
break room, one set of restrooms, and two office spaces. The facility is currently
utilized by the Parks and Recreation Department as a hub for various youth and
adult programs, events and activities. Parks and Recreation would like to continue
expanding youth programs and renovate the current facility with a focus on
developing a Youth Center. A Youth Center would create a safe environment for
all Rosemead' s youth to experience activities and programs that will enhance their
physical, mental, and social well-being. Mr. Boecking indicated the facility closed
in March 2020 due to the pandemic; discussed programs & amenities currently
offered at the facility, as well as the expansion of youth programs including Camp
Rosemead and Camp in a Box.
Mr. Boecking stated the proposed expansion of Youth Programs at Garvey Park
Youth Center will include in the Rec. Room (Multi-purpose Room): an additional
Playschool site, Afterschool Recreation, Contract Classes/Workshops. As well as
converting the small multi-purpose room into the Clubhouse for a safe space for
youth participants to utilize various activities such as homework assistance,
computer lab, gaming consoles, W's, access to sports facilities, physical fitness and
social networking activities. The Youth Enrichment Programs for teens will include
Employment Workshops, Jr. Lifeguard Program (incorporate Splash Aquatic
Center), Jr. Cadet and/or Jr. Fire Academy Program with local Sheriffs and Fire
Department, Youth Employment Program - Recreation Aide funded by CDBG,
and the Youth Council Program. Mr. Boecking asserted that $266,200 is currently
budgeted in the General Recreation cost center, in the General Fund for FY 2020-
21. The budgeted amount will cover the additional staff cost that is required to
expand the youth programs at Garvey Park. The amount of $200,000 is allocated in
the Capital Improvement Project for FY 2020-21. If project has unspent funds at
the end of the year FY 2020-21, the funds will be carried over to FY 2021-22. The
amount allocated would be utilized for the renovation of the current facility.
Council Member Ly indicated he asked Mr. Boecking to present the Youth Center
so that Council had an opportunity to discuss it further; noted that Council Member
Armenia has worked closely with the Parent Engagement Institute.
' Mayor Low expressed she is impressed with how Mr. Boecking is utilizing the
funds and is excited to see it come to fruition.

Mayor Pro Tern Dang congratulated Mr. Boecking on the detailed presentation and
indicated support for the expansion of the facility and its programs.
Council Member Armenta stated as Council Member Ly noted I have been working
with the Parent Engagement Institute; explained she saw that the clubhouse,
the former Public Works facility, was not in use and suggested using it for the
Parent Engagement Institute' s purposes; expressed she is surprised to learn this
information as none of this was discussed when we met with City Manager
Molleda. If this was really in the works back then, I wouldn't have wasted my time.
Mrs. Armenta indicated she had a discussion with Council Member Ly who
indicated we could find a win-win situation for the youth center and the Parents
Engagement Institute. Inquired if the Jess Gonzalez Sports Complex will still be
utilized for youth programs.
Director of Parks and Recreation Boecking replied some of our clinics in the Spring
session were moved to the Sports Complex due to available space and the fact that
the basketball clinic has to be played on concrete. We moved it there because we
can secure the parking lot and were able to put temporary basketball rims onto the
court since the gym is not accessible due to COVID. Once we are able to open up,
those programs will move back to the gym and park area where they were prior to
COVID.
Council Member Armenta asked if Mr. Boecking knew why the preschool was
closed at that location?
Mr. Boecking stated I believe from speaking to staff that attendance had dropped,
so it was transferred to Garvey Center and kept the program at Rosemead Park.
Council Member Armenta inquired if the rec/supervisor office was kept in tac or
was reconfigured when we made the Garvey restrooms renovations.
Mr. Boecking responded there is a small storage and office area that could be used
as a staff office, but not enough room to do activities in there.
Council Member Armenta thanked Mr. Boecking for clarifying the reason why the
clubhouse is being utilized for youth programs; expressed a lot of time could have
been saved if this information had been provided at our initial discussion with the
City Manager.
Council Member Clark echoed Council Member Armenta's sentiment, at our last
meeting, the issue of Garvey Park was brought up by the Parent Engagement
Institute; asked if there is any way to have both at the facility or is one precluding
the other?
Director of Parks and Recreation Boecking replied we are all about partnerships,
so he would be happy to look in to how we could partner with the Parent
organization.

Council Member Clark stated it was mentioned that painting would be needed for
the facility; shared years ago she wanted to volunteer to help alleviate costs at the
Garvey School District, and was told no by the Union; asked if it is possible/legal
for volunteers to assist with painting?
Council Member Armenta stated the Beautification Committee did a lot of painting
at Sanchez Elementary; opined it should be okay to only paint walls in a room, as
long as it is not construction modifications.
City Attorney Richman advised that typically you would put it out to bid when you
need a professional to paint if it is a bigger project. If you are volunteering to paint
a wall in a room, then it should be fine.
Council Member Ly stated there is always opportunities to figure out win-win
situations; opined staff did their due diligence with. this. At the end of the day,
you can't go wrong with the facility being used for the Parent Engagement Institute,
the Youth Center, or a combination of both.
Mayor Low expressed she doesn't see the harm in having options and then
discussing what works best for the community.
Council Member Armenta reiterated her comment had to do with the lack of
communication so that we could have shifted the way of thinking of bridging them
together or finding a different location.
Mayor Pro Tern Dang acknowledged that Council Member Armenta was simply
expressing she was caught off guard; suggested looking at another site for the
Parent organization as the facility already seems packed with the proposed
program.
Mayor Low directed staff to proceed with the youth center at the facility and to find
an alternative site for the Parent Engagement Institute.
B. COVID-19
This is a recurring item that will be on the agenda to update the City Council on
items related to COVID-19.
Recommendation: That the City Council discuss and provide further direction.
City Manager Molleda stated effective May 6", the County of Los Angeles
Department of Public Health updated the Reopening Safer at Work and ordered to
align with the Yellow Tier safety modifications of the State's Blueprint for a safer
economy. Fitness facilities, including private gymnasiums and dance studios, may
be open for outdoor and limited capacity indoor operations; the indoor occupancy
at gyms and fitness facilities is limited to 50% of indoor occupancy. The indoor
portions of museums may open to the public and are limited to 75% occupancy.

Indoor dining operations are permitted at 50% capacity. All family entertainment
centers are limited to 50% of maximum indoor capacity; movie theatres may remain
open, and each separate screening room is limited to 50% capacity. Amusement
and theme parks, as well as restaurants within these parks, can reopen to the public
at a maximum occupancy of 35%. Outdoor seated live events and performances can
reopen at a maximum of 67% occupancy. Shared as of yesterday, 29,614 residents
have been vaccinated, that is 64% of all Rosemead residents; as of today, there have
been 4,957 COVID-19 cases reported and 146 covid related deaths. Lastly the
office of Supervisor Solis reached out to partner with the city during one of our
Farmers' Market events to provide an opportunity for vaccinations on a walk-in
basis. The proposed date is May 241, staff will provide further details as the date
approaches.
MATTERS FROM MAYOR & CITY COUNCIL
A. Discussion and Consideration of a Resolution Expressing "A Vote of No
Confidence" in Los Angeles County District Attorney George Gascon
Council Member Steven Ly requested an item proposing a vote of no confidence in
Los Angeles County District Attorney George Gasc6n to be placed on the agenda
for consideration. The District Attorney (DA) is an elected county official
established by Government Code Section §26500-26543 and is responsible for the
prosecution of criminal violations of state law and county ordinances occurring
within the county in which they are elected. The Los Angeles DA's Office
prosecutes felony crimes and misdemeanor crimes in unincorporated areas and in
78 of the county's 88 cities, including the City of Rosemead.
The Los Angeles County DA's Office has a legal responsibility to execute laws
enacted by voters or the state legislature. These laws protect the public and uphold
prosecutorial policies. The DA also oversees investigation, apprehension, and
prosecution of these in court. Los Angeles County DA George Gasc6n was elected
as part of the November 3, 2020 General Election, capturing 54% of the Los
Angeles County vote. Since his December 7, 2020 swearing-in ceremony, he has
issued numerous special directives to reform criminal prosecutions in Los Angeles
County.
Recommendation: That the City Council take the following action:

City Manager Molleda presented the Staff Report.
Council Member Ly stated in difficult times like these with the recent hate crimes,
it is imperative to have strong community policing and partnership with those that
are enforcing the law, which comes down to the police and the prosecutors that help
execute the will of the people. Opined the problem is District Attorney Gascon has
not been doing that; he has put communities such as ours at risk by not enforcing
the laws, our most vulnerable are not protected and is allowing the opportunity for
recidivism to increase. The fact that he is trying to push the idea of having an
adversarial relationship with our police force is insulting. Mr. Ly implored Council
to consider adopting this resolution expressing a vote of no confidence in Gascon
to send the message that the City of Rosemead wants to ensure the laws of the land
are enforced.
Council Member Clark concurred with Council Member Ly; stated she has Asian
family members concerned with everything going on. Orated that Gascon seems to
have a different idea and is not willing to enforce the will of the people because
these perpetrators know they can get away with it. Noted he is not respecting the
voters' wishes as there were two issues on the ballot - the voters voted to keep the
bail system and the death penalty, which he threw out.
Council Member Armenta shared that she finds it interesting that our current
District Attorney was a former Police Officer, noting a legal background is not
required as long as he has the majority of votes. She expressed that she understands
that some people are wrongfully convicted; however, the District Attorney is not
taking into consideration the lives that have been damaged by the criminals and we
have to look at the rights of the victims as well.
Mayor Pro Tern Dang stated he echoes the same sentiments as his Council
colleagues; expressed support for the resolution as Gascon is essentially tying the
hands of our law enforcement and wasting their resources.
Mayor Low indicated she hates to have to express a vote of no confidence in
anyone, but it .is warranted here; agreed with Council Member Armenta that people
should have the right to feel safe and that seems to have disappeared. It is
disheartening that our law enforcement work so hard to catch these criminals but
then the court system frees them without any consequences and allows them to
continue to do bad things that hurts the community. It is our duty as civic leaders
to step up and say we do not agree with the way Gascon operates.

This item is presented to the City Council at the request of Council Member Steven
Ly. The current consolidated disposal services agreement expires on July 31, 2023.
Recommendation: That the City Council discuss and provide further direction.
Council Member Ly stated this item was inadvertently placed on tonight's agenda
and will be tabled for a future meeting.
C. Council Comments
Council Member Armenta thanked staff and the Public Works Department for their
efforts with the Community Garden grand opening; highlighted the partnership the
city has with CultivaLA. Inquired about the status of the $2 million funding that
Senator Rubio secured for the lighting and maintenance.
City Manager Molleda responded we already had the funding but prior to the Senate
Bill that Senator Rubio pushed for us, we were limited to only using it for lighting.
Now we are able to use it for multiple Parks and Recreation items; indicated that
list will come to Council at an upcoming meeting.
Council Member Armenta clarified the Senator did not generate the funding
specifically for Rosemead; explained the funding that was held captive, and she
simply helped us tap into it with this bill.
Council Member Armenta stated on May 01, she sent an email to City Manager
Molleda asking for an update on the Parent Engagement Institute and the other was
if she had a chance to respond to a former resident but whose parents still live in
Rosemead and were interested in bringing in a health event; expressed it is
disheartening that she had not received a response for six days and was told she did
not receive a response sooner because it was a busy week. She opined I hate to have
to continue bringing this up during my Council comments but will continue to do
so every single time the City Manager is insubordinate and disrespects me by
not responding. Thanked the Mayor for trying to mitigate the situation by directing
the City Manager to at least send an acknowledgment email response. Reiterated
she would like to express no confidence in the City Manager. We will see if things
change but is not very hopeful. It is such a shame to be treated in such a manner as
an elected official as it is hindering my capacity as a Council Member to serve the
community. Emphasized she will always strive to be the voice of residents and
business members.
Mayor Low stated the Community Garden opening was a successful event and is
looking forward to taking some lessons in gardening.

Mayor Pro Tem Dang noted he spoke with the gentleman from CultivaLA at the
Community Garden event about having compost there during the tilling process;
asked Director of Parks and Recreation Boecking if he could follow up with
CultivaLa on the request.
8. ADJOURNMENT
Mayor Low adjourned the meeting at 8:50 p.m. The next regular scheduled meeting will
be held May 25, 2021, in the Rosemead City Hall Council Chamber.
