CC - Item 4E - Amendment to the Storm Water Catch Basin Upgrade Project ContractROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: BEN KIM, CITY MANAGER DATE: JULY 25, 2023 SUBJECT: AMENDMENT TO THE STORM WATER CATCH BASIN UPGRADE PROJECT CONTRACT SUMMARY In May 2021 the City Council awarded a contract for a Storm Water Catch Basin Upgrade project to United Storm Water, Inc. Due to the project scope of work including work that would affect catch basins owned by Los Angeles County Department of Public Works (LACDPW) the City was required to obtain a permit from LACDPW. The permit process took over one year to complete and work began thereafter in late 2022. An amendment to extend the term of the contract is needed to proceed with processing payments to the Contractor. Staff recommends that the City Council authorize the City Manager to sign and execute an amendment to extend the term of the agreement. DISCUSSION A Notice Inviting Bids was published in local newspapers and trade publications for the Storm Water Catch Basin Upgrade Project on March 18'' and March 25d, 2021.On May 11, 2021, United Storm Water, Inc. (Contractor), was awarded the contract in the amount of $182,573.00. The project consisted of the installation of approximately 256 full trash capture Connector Pipe Screen (CPS) devices at various storm drain catch basins located in the City. An estimated 221 catch basins were identified as LACDPW owned. LACDPW requires that the City obtains a permit for work affecting their catch basins. Staff and the Contractor began the permit process to obtain a permit from LACDPW for the project in August 2021. The permit was issued by the County in September 2022. Construction for the project began in October 2022 and was completed in May 2023. The work resulted in the installation of 132 CPS units within the City. During the course of construction there were various locations throughout the City where CPS units were unable to be installed. There will be a need for a future project (Phase II) to install trash capture devices on the remaining catch basins without devices in the City. An amendment to extend the term of the agreement to June 30, 2023 is needed to proceed with processing payment to the Contractor for work that has been completed. AGENDA ITEM 4.E City Council Meeting July 25, 2023 Page 2 of 2 ENVIRONMENTAL REVIEW The proposed work involves the minor alteration of existing drainage facilities; therefore, the project is Class I Categorically Exempt pursuant to the California Environmental Quality Act (CEQA). STAFF RECOMMENDATION It is recommended that the City Council: Authorize the City Manager to sign and execute an amendment to the Storm Water Catch Basin Upgrade Project Contract; and 2. Find that the Project is Class 1 Categorically Exempt pursuant to the California Environmental Quality Act (CEQA). FINANCIAL IMPACT None. STRATEGIC PLAN IMPACT The project is consistent with the Strategic Plan's guiding principal for fiduciary responsibility of providing for transparency in financial management of City's finances and providing quality of life enhancement. This FIRST AMENDMENT ("Amendment') is made and entered into this_ day of 2023 ("Effective Date"), by and between the City of Rosemead, a municipal organization, organized underthe laws of the State of California with its principal place of business at 8838 East Valley Blvd., Rosemead, California 91770 ("City") and United Storm Water, Inc. with its principal place of business at 14000 E. Valley Blvd., Industry, CA 91746 ("Contractor"). City and Contractor are sometimes individually referred to herein as "Party" and collectively as "Parties." WHEREAS, City and Contractor entered into an agreement on June 9. 2021, for the Storm Water Catch Basin CPS Unit Upgrade Project (the "Agreement'); and WHEREAS, this Agreement was set to expire on December 31. 2021; and WHEREAS, City and Contractor may mutually agree to extend the term of this Agreement to June 30, 2023; and NOW, THEREFORE, the Parties agree as follows: SECTION 1. The Agreement shall be amended as provided below. SECTION 2. Section 3.1.2 of the Agreement shall be amended to read as follows: 3.1.2 Term. The term of this Agreement shall be from Effective Date shown above to June 30, 2023, unless earlier terminated as provided herein. Consultant shall complete the Services within the term of this Agreement and shall meet any other established schedules and deadlines. SECTION 3. All other terms, condition, and provisions of the Original Agreement not in conflict with this Addendum, shall remain in full force and effect. SECTION 4. The City Clerk shall certify to the adoption of this Addendum and hereafter the same shall be in full force and effect. United Storm Water Inc.
