CC - 1965 - 91 - Vacate a Portion of Whitmore StRESOLUTION N0. 65-91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD EXPRESSING THE INTENTION TO VACATE A PORTION OF WHITMORE STREET AND SETTING THE TIME AND PLACE FOR A PUBLIC HEARING THEREON. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Rosemead hereby elects to proceed under and pursuant to the provisions of Division 9, Part 3 of the Streets and Highways Code of the State of California, and hereby declares its intention to order the vacation of a portion of Whitmore Street within the City of Rosemead as delineated and shown on the map and plan on file in the office of the City Clerk of the City of Rosemead, particularly described as follows: That portion of Whitmore Street, formerly unnamed street, 40 feet wide, as shown on map of E. J. Baldwins First Subdivision, in the City of Rosemead, County of Los Angeles, State of California, re- corded in Book 66, pages 94 and 95, of Miscellaneous Records, in the office of the Recorder of said county, and that portion of Whitmore Street, as shown on and dedicated by map of Tract No. 20264, in said city, recorded in Book 541, pages 28 and 29, of Maps, in the office of said recorder, which li,e within the following described boundaries: Beginning at the northerly terminus of the straight line in the westerly boundary of Lot 38, said tract, for the purpose of this description said straight line has a bearing of North 14 26'15" West, said northerly terminus being the beginning of a curve concave to the east, tangent to said straight line and having a radius of 100 feet; thence northerly along said curve through a central angle of 1053'01" a distance of 3.29 feet; thence North 12°33'14" West 27.89 feet to the beginning of a curve concave to the southwest, having a radius of 55 feet, tangent to said last mentioned course and tangent to a line parallel with and 55 feet northerly, measured at right angles, from the straight line in the northerly boundary of said lot; thence northwesterly along said last mentioned curve 50.92 feet to the northerly line of Whitmore Street, 50 feet wide, as shown on map of said tract; thence easterly along said north- erly line to the southwesterly boundary of that certain 75 foot strip of land described in deed to Los Angeles County Flood Control District, for Rubio Wash, recorded on August 13, 1936, in Book 14285, page 386, of Official Records, in the office of said recorder; thence southeasterly along said southwester- ly boundary to the northeasterly corner of said lot; thence westerly, southwesterly and southerly along the northerly, northwesterly and westerly boundaries of said lot to the point of beginning. For further particulars as to the extent of said proposed vacation, reference is made to the map and plan on file and open to public inspection in the office of the City Clerk. Section 2. The City Council has determined that the public convenience and necessity require the reservation of permanent easements and rights of way for ingress and egress to Rubio Wash for channel maintenance and for all existing franchises and renewals thereof pursuant to Streets and Highways Code Sections 8330 and 8331. Section 3. The hour of 8:00 P.M. on the 28th day of December, at 8815 East Valley Boulevard in the City of Rosemead, County of Los Angeles, State of California, is hereby designated as the time and place for the public hearing in connection with this matter and all persons interested in or objecting to the proposed vacation may appear and be heard. Section 4. The City Clerk is directed to post notices of said proposed vacation conspicuously along the line of that portion of Whitmore Street proposed to be vacated at least ten days before the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8322 of the Streets and Highways Code of the State of California. Section 5.
