RESOLUTION NO. 66-49
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD AUTHORIZING THE ACQUISITION OF EASEMENTS
FOR NECESSARY RIGHTS-OF-WAY AND FEE SIMPLE ABSOLUTE
OWNERSHIP FOR ROAD PURPOSES IN CERTAIN PROPERTIES
AND ORDERING EMINENT DOMAIN PROCEEDINGS.
WHEREAS, the public interest and necessity of the
people of the City of Rosemead do require the improvement of
the intersection of Rosemead Boulevard and Marshall Street
and the acquisition of additional property and right-of-way
on Marshall Street 'so as to widen Marshall Street to better
accommodate the flow of vehicular traffic on said street, and
to further improve the alignment of Marshall Street west of
Rosemead Boulevard with Marshall Street east of Rosemead
Boulevard; and for that purpose and for such public use, it
is necessary for the City of Rosemead to acquire an easement
in, upon, over and across Parcels One, Two and Three hereof
and the fee simple absolute interest in Parcel Four, by condem-
nation. The real property, located in the City of Rosemead,
County of Los Angeles, State of California is more particularly
described as follows:
PARCEL ONE:
The northerly 25.00 feet, measured at right
angles, of the East half of Lot 3 of Tract No.
2277, in the City of Rosemead, County of Los
Angeles, State of California, as per map recorded
in Book 31, page 56, of Maps, in the Office of
the County Recorder of said County.
PARCEL TWO:
The northerly 25.00 feet, measured at right
angles, of the West half of Lot 3 of Tract No.
2277, in the City of Rosemead, County of Los
Angeles, State of California, as per map recorded
in Book 31, page 56, of Maps, in the Office of the
County Recorder of said County.
PARCEL THREE:
The northerly 25.00 feet, measured at right
angles, of Lot 4 of Tract No. 2277, in the City
of Rosemead, County of Los Angeles, State of
California, as per map recorded in Book 31, page
56, of Maps, in the Office of the County Recorder
of said County.

PARCEL FOUR:
Lot 5 of Tract No. 2277, in the City of Rosemead,
County of Los Angeles, State of California, as per
map recorded in Book 31, page 56, of Maps, in the
Office of the County Recorder of said County. Except
therefrom, that portion thereof, described as follows:
Beginning at the intersection of the northerly
line of said lot with a line which is parallel with
and listant 20.00 feet westerly, measured at right
angles, from thm easterly line of said lot; thence
along said parallel line, South 10 00' 15" East 17.00
feet; thence northwesterly in a direct line to a
point in said northerly line, distant thereon South
890 08' 45" West 17.,00 feet from the point of begin-
ning; thence North 890 08' 45" East 17.00 feet to
the point of beginning.
NOW, THEREFORE, the City Council of the City of
Rosemead does hereby resolve as,follows:
Section 1. That the improvement at the oT-Vo-semead Boulevard and Marshall Street,
and the acquisition of an easement in, upon, over
and across Parcels One, Two and Three of the real
property, and the fee simple absolute interest in
Parcel Four for public purposes is a use authorized
by law.
Section 2. That the public interest and
necessity y require the improvement of said Marshall
Street.
Section 3. That the above-described parcels
of lanT are necessary for such purposes.
Section 4. That such proposed improvement of
said Marshall Street is located in a manner which
will be most compatible with the greatest public
good and the least private injury. That the certain
parcels of land above described be condemned for a
public purpose, namely for the improvement at the
intersection of Marshall Street and Rosemead Boulevard,
for public road and highway purposes, and the City
Attorney of the City of Rosemead is hereby wirected
to institute eminent domain proceedings in the Surperior
Court of the State of California for:the County of Los
Angeles for the condemnation of the parcels of land
above-described for public road and highway purposes,
and to take all steps necessary for the condemnation
of said parcels of land in the name of the City.
Section 5, That the public interest and neces-
sity require he taking of immediate possession of the
parcels of property and the City Attorney is directed
to institute proceedings for the taking of immediate
possession and the use of the property herein ordered
to be acquired, upon complying with the require-
ments of the law applicable thereto.
