A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ROSEMEAO ASCERTAINING TK
GENERAL PREVAILING WAGE RATES.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD FINDS, DETERMINES
AND RESOLVES AS FOLLOWS:
Section 1. The general prevailing rate of per diem
wages in the City of Rosemead, for each craft; classification
or type of workman needed to execute public wc.rks or other
public contracts, are as follows:

Foreman: Receives not less than 501 per hour more than the
hourly rate of the highest classification over which
he has responsibility, except "Pneumatic Nailer."
The Union may elect at its option upon sixty day's written
notice, prior to May 1, 1967, to allocate up to a maximum of 101
per hour out of the following listed amount to each of the Health
and Welfare and Vacation Funds:

NOTE: Seven consecutive hours, excluding meal period, to begin at
7:00, 7:30 or 8:00 a.m. shall constitute a regular day's work
for which eight times the straight-time hourly rate shall be
paid on all shifts. Single shift premiums shall not apply on
tunnels less than 200 feet. The classification "Shifter" rec-
eives a 35C per hour differential over the highest classification
over which he has leadership.

All operators and oilers on equipment with booms of 80 to 100
feet including jib and pile-driving rigs with hammer leads of 80 to
100 feet, shall receive 15C per hour premium pay additional to the
regular rate of pay. Thereafter they shall receive an additional 10r
per hour premium pay additional to the regular rate of pay for each
additional 20 feet of boom, including jib.
It is agreed that two or more Engineer Operators will constitute
a complete operating crew on all Tower Crane equipment (American
Pecco, Bucyrus Erie, Mayco-Weitz, Linden and similar types), and they
shall receive 45t per hour premium pay in addition to the applicable
Universal Equipment Operator's rate of pay (Long Boom premium shall
not apply to this equipment).
Operators on all hoisting equipment with three drums or more,
shall receive 15C per hour premium pay additional to the regular
rate of pay.
Combination Mixer and Compressor Operators on Gunite Work shall
be classified as Concrete Mobile Mixer Operators.
Operators on equipment with scrapers or dragtype shovels in tan-
dem shall receive premium pay of $1.00 per hour above the regular rate,
other types of tandems excluding compactors, 50t per hour premium.
The necessity for the use of an employee as a Signalman shall
be determined by the Contractor. When used, he shall be an Engineer-
Oiler, as defined herein, who assists in giving or relaying signals by
mechanical means (also by means of hand signals on excavation work)
directly to the Operator of hoisting equipment only.
On a survey crew the Party Chief shall receive premium pay of
10t per hour above the regular rate.

PREVAILING WAGE RATES and EMPLOYMENT OF ALIENS
Sec. 1775 (Labor Code, State of California). FORFEITURE FOR PAYING LESS THAN PREVAILING RATE: RIGHTS OF
WORKMEN: STIPULATION IN CONTRACT: ACTION FOR RECOVERY BY DIVISION OF LABOR LAW ENFORCEMENT:

The contractor shall, as a penalty to the State or political subdivision on whose behalf the contract is made or awarded,
forfeit twenty-five dollars ($25) for each calendar day, or portion thereof, for each workman paid less than the stipulated pre-
vailing rates for such work or craft in which such workman is employed for any public work done under the contract by him or
by any subcontractor under him. The difference between such stipulated prevailing wage rates and the amount paid to each
workman for each calendar day or portion thereof for which each workman was paid less than the stipulated prevailing wage
rate shall be paid to each workman by the contractor, and the body awarding the contract shall cause to be inserted in the
contract a stipulation that the provisions of this section will be complied with.
To the extent that there is insufficient money due a contractor to cover all penalties forfeited and amounts due in ac-
cordance with this section, or in accordance with Section 1813 of this chapter, and in all cases where the contract does not pro-
vide for a money payment by the awarding body to the contractor, the awarding body shall notify, provided that in the case of
a workman claiming the difference between the prevailing wage rate and the amount paid him the awarding body has first
been given the notice mentioned in Section 1190.1 of the Code of Civil Procedure, the Division of Labor Law Enforcement
of such violation and the Division of Labor Law Enforcement, if necessary with the assistance of the awarding body, may main-
tain an action in any court of competent jurisdiction to recover the penalties and the amounts due provided for herein. Such
action shall be commenced not later than 90 days after the filing of a valid notice of completion in the office of the county
recorder in each county in which the public work or some part thereof was performed, or not later than 90 days after accep-
tance of such public work, whichever last occurs. No issue other than that of the liability of the contractor for the penalties
allegedly forfeited and amounts due shall be determined in such action, and the burden shall be upon the contractor to estab-
lish that the penalties and amounts demanded in such action are not due.
Out of any money withheld or recovered or both there shall first be the amount due each workman and if insufficient funds
are withheld or recovered or both to pay each workman in full the money shall be prorated among all such workmen. [Amend-
ed by Slats 1957 ch 397 § 1; Stats 1963 ch 467.§ 1.]
Sec. 1850 (Labor Code, State of California). ALIEN NOT TO BE EMPLOYED: Exceptions. No contractor or subcontractor or
agent or representative thereof shall knowingly employ or cause or allow to be employed on public work any alien, except in
cases of extraordinary emergency caused by fire, flood, or danger to life or property, except on work upon public military or
naval defenses or works in time of war, or except as otherwise provided in Sec. 1851.5.
Sec. 1851.5 (Labor Code, State of California). ALIENS WHO MAY BE EMPLOYED ON PUBLIC WORK. Aliens admitted to
the United States under the provisions of the Refugee Relief Act of 1953 may be employed on public work.
Secs. 1851 and 1652 (Labor Code, State of California) provide for recording and reporting the employment of aliens under the
above specified emergency conditions.
Sec. 1853 " (Labor Code, State of California). PENALTY FOR EMPLOYING ALIEN: Insertion of forfeiture provision in contract.
The Contractor or subcontractor to whom a contract for public work is awarded shall forfeit as a penalty to the State or political
subdivision on whose behalf the contract is awarded, ten dollars for each alien knowingly employed in the execution of the
contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of this
article. The awarding body shall insert in the contract a provision to this effect.
Under the provisions of the Labor Code of the State of California, the Board of Supervisors of Los Angeles County has as-
certained the prevailing rate of per diem wages in dollars, based on a working day of eight hours, for each craft or type of
workman or mechanic needed to execute any construction contract which may be awarded by the County of Los Angeles, to be
as follows and as detailed herein.
APPRENTICES - May be employed in conformity with Section 1777.5 of the California Labor Code.
RIGGERS - Same wage scale as craft to which rigging is incidental.
WELDERS - Same wage scale as craft to which welding is incidental.
FOREMEN- All foremen not herein separately classified shall be paid not less than 25¢ per hour more than the hourly equivalent
of the daily rate of the highest classification in which he has supervision in the six Basic Trades.
Provided that overtime rates, rate of pay for Saturdays, Sundays and holidays shall apply to those holidays as recognized
in the collective bargaining agreement applicable to the particular craft, classification or type of workman employed on the
project.
Provided that notwithstanding the general provision contained herein, Guards and Watchmen shall be paid one and one-
half times the prevailing rate for overtime (overtime shall be time worked -in excess of eight hours per day or forty hours per
week), and the straight prevailing rate for time worked on Saturdays, Sundays, and where such time does not constitute over-
time.
Except as otherwise specifically provided for painter classifications, the rates of per diem wages for each of the various
classifications of work shall be the hereinafter set forth prevailing rate of hourly wages plus the hourly equivalent of any em-
ployer payments for health and welfare, pension, vacation and similar purposes multiplied by eight. Eight hours shall con-
stitute a day's work; it being understood that in the event that workmen are employed less than eight hours per day, their
per diem wages shall be determined to be that fraction of the per diem wages herein established that the number of hours
of employment bears to eight hours.
