A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD ORDERING THE VACATION OF
A PORTION OF NEWBY AVENUE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, the City Council of the City of Rosemead did on
January 10, 1967 adopt Resolution No. 67-2 entitled "A Resolution
of the City Council of the City of Rosemead Expressing the Intention
to Vacate a Portion of Newby Avenue and Setting the Time and Place
for a Public Hearing Thereon"; and
WHEREAS, the said City Council did hold a public hearing
thereon on February 14, 1967 at 8:00 p.m. at 3018 Charlotte Avenue,
City of Rosemead, State of California, at which time said Council
did hear all evidence offered by persons interested in said vacation;
and
WHEREAS, the City Council of the City of Rosemead does hereby
find that the portion of Newby Avenue as described and referred to
in said Resolution No. 67-2 is unnecessary for present or prospective
public street purposes,
NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL
OF THE CITY OF ROSEMEAD AS FOLLOWS:
Section 1. That certain portion of Newby Avenue described
Exhibit 7-attached hereto and made a part hereof, shall be and
is hereby vacated, subject to the reservations and exceptions
provided in Section 2 hereof.
Section 2. The City Council has determined that the public
convenience ancT necessity require the reservation of permanent ease-
ments and right of way for all existing franchises and renewals
thereof pursuant to Streets and Highways Code Sections 8300 and 3311,
and such permanent easements and rights of way are hereby reserved
and excepted.
Section 3. That the City Clerk of the City of Rosemead shall
cause a cert- ifi~ copy of this Resolution and order to be recorded
in the office of the Recorder of the County of Los Angeles.
PASSED, APPROVED and ADOPTED this 14th day of February, 1967.
