PC - Minutes - 12-04-23Minutes of the PLANNING COMMISSION MEETING December 4, 2023 The regular meeting of the Planning Commission was called to order by Chair Berry at 7:00 PM PLEDGE OF ALLEGIANCE — Commissioner Ung INVOCATION — Commissioner Lopez ROLL CALL — Commissioners Lopez, Ung, Vice -Chair Escobar, Chair Berry. Commissioner Tang was absent. STAFF PRESENT — Director of Community Development Wong, Deputy Director of Community Development Valenzuela, Associate Planner Lao, Assistant Planner Do, and City Clerk Hemadez 1. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Justin Tamayo presented the procedure and appeal rights of the meeting. 2. PUBLIC COMMENTS FROM THE AUDIENCE There being no comments, Chair Berry opened and closed the Public Comment period. 3. PUBLIC HEARINGS A. MINOR EXCEPTION (ME 23.09) — Jiaxing Chen has submitted a Minor Exception application, requesting to construct a 2,341 square -foot single-family dwelling unit with an attached, 430 square -foot, two -car garage on a parcel with a 916 square -foot, legal nonconforming single-family dwelling unit. To meet off-street parking requirements for the legal nonconforming dwelling unit, the applicant is also proposing two new one -car garages. The existing dwelling unit is nonconforming due to the existing 3'-2" side yard setback (minimum 5'- 0" side yard setback required) along the north property line. The project site is at 2722 Earle Avenue in the Light Multiple Residential (R-2) zone and consists of one parcel (APN: 5283-003-013) that totals 9,750 square feet. Per Rosemead Municipal Code Section 17.142.020(B)(1), the granting of a Minor Exception application is required before the Planning Commission for new structures constructed on a lot where nonconforming structures exist and for the enlargement of an existing legal nonconforming structure. CEQA — Section 15303 of the California Environmental Quality Act guidelines exempts projects consisting of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Accordingly, Minor Exception 23-09 is classified as a Class 3 Categorical Exemption, pursuant to Section 15303 of California Environmental Quality Act guidelines. Rosemead Planning Commission Meeting Minutes of December 4, 2023 1 of 5 STAFF RECOMMENDATION — It is recommended that the Planning Commission ADOPT Resolution No. 23- 07 with findings (Exhibit "A"), and APPROVE Minor Exception 23-09, subject to the 52 conditions outlined in Attachment "A" attached hereto. Assistant Planner Do presented the staff report Chair Berry opened the Public Hearing. Vice -Chair Escobar indicated that she had no questions as the project will meet parking requirements, the base of the fencing will be replaced, and the landscape will be rehabilitated. In addition, she stated that she agreed with the conditional of approvals from the Public Works Department to repair the sidewalk, curbs and gutter, and rehabilitate the street pavement to the center line. Commissioner Ung stated that she had no questions but commented that there is no real indication of where the new gas meter will be located. She hopes the location will conform to the existing code and the new meters will be hidden from the public -right-of-way. She also noticed that the residential unit in the center has stone veneer at the base and hopes that the new remodeled house will also include stone veneer at the base. Seeing no additional questions, Chair Berry asked if there were any public comments. There being no additional questions or public comment, Chair Berry closed the hearing period and requested for motion and a second. ACTION: Vice -Chair Escobar motioned to approve Resolution No. 23-07, Commissioner Ung seconded the motion to be approved. B. CONDITIONAL USE PERMIT (CUP) 23.03 — Frank Feng Wang has submitted an application fora Conditional Use Permit to re-establish an automobile sales and rental (no repair) use at 9510 Valley Boulevard (APN: 8593-001-042). The project site is located in the Medium Commercial with Design Overlay (C -3/D-0) zone. Since the previous automobile sales and rental (no repair) use has been discontinued for a period of over one year, approval of a Conditional Use Permit is required to re-establish an automobile rental and sales (no repair) use within the Medium Commercial with Design Overlay (C -3/D-0) zone. Per Rosemead Municipal Code Section 17.132.060(A), if the use authorized by any Conditional Use Permit shall become null and void and of no effect. Rosemead Planning Commission Meeting Minutes of December 4, 2023 2of5 CEQA — Section 15301 of the California Environmental Quality Act guidelines exempt projects consisting of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Accordingly, Conditional Use Permit 23-03 are classified as a Class 1 Categorical Exemptions, pursuant to Section 15301 of California Environmental Quality Act guidelines. STAFF RECOMMENDATION — It is recommended that the Planning Commission ADOPT Resolution No. 23- 09 with findings (Exhibit "A"), and APPROVE Conditional Use Permit 23-03, subject to the 30 conditions outlined in Attachment "A" attached hereto. Chair Berry opened the Public Hearing. Commissioner Ung commented that due to the previous use as an auto sale lot, she believes it is a good use of the property. There being no additional questions or public comment, Chair Berry closed the hearing period and requested formation and a second. ACTION: Commissioner Ung motioned to adopt Resolution No. 23-09. CONDITIONAL USE PERMIT (CUP) 22.03 Alex Huang on behalf of DK Garment International Corporation has submitted an application for a Conditional Use Permit to establish a Garment Manufacturing use at 8623 Garvey Avenue Units A and B (APN: 5289-004-035). The project site is located in the Light Manufacturing and Industrial (M-1) zone. Per Rosemead Municipal Code Section 17.16.020, approval of a Conditional Use Permit is required to establish Garment Manufacturing use within the M-1 zone. CEQA - Section 15301 of the California Environmental Quality Act guidelines exempt projects consisting of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Rosemead Planning Commission Meeting Minutes of December 4, 2023 3of5 STAFF RECOMMENDATION - It is recommended that the Planning Commission ADOPT Resolution No. 23- 08 with findings (Exhibit "A"), and APPROVE Conditional Use Permit 22-03, subject to the 31 conditions outlined in Attachment "A" attached hereto. Chair Berry opened the Public Hearing. Commissioner Ung commented that the auto repair business adjacent to the building is utilizing most of the parking lot. The City Code Enforcement will be working with the owner to maintain the parking spaces that are allotted for DK Garment. Commissioner Lopez asked how many parking spaces are allowed for DK Garment Associate Planner Lao answered the total Plaza requires forty-two (42) parking spaces. They will have a surplus of thirteen (13) spaces and DK Garment will require eleven (11) spaces. Commission Lopez commented on how they would determine which parking space is for the auto repair shop and DK Garment. Associate Planner Lao replied that there is currently no parking management plan for the Plaza. It will be first come, first serve. Commission Lopez commented that employees will have to park on the street if they don't arrive on time, especially if there are multiple business in that lot. Deputy Director Valenzuela commented that the property owner and tenants would typically have a lease agreement where they allocate a certain amount of parking spaces for each unit and where each space is located. In this case, staff is not sure if the property owner and the tenant have a lease agreement for assigned parking spaces. Chair Berry invited the applicant to speak. The applicant, David Wang stated his name and clarified that there will be assigned parking for DK Garment employees. There being no additional questions or public comment, Chair Berry closed the hearing period and requested for motion and a second. ACTION: Commissioner Ung made a motion to adopt PC Resolution 23-08. Chair Berry seconded the motion. MATTERS FROM STAFF Deputy Director Valenzuela commented that the City will have their Annual Christmas Tree lighting tomorrow at 6:00 p.m. in the Civic Center. 6.
