PC - Minutes - 11-06-23Minutes of the PLANNING COMMISSION MEETING November 6, 2023 The regular meeting of the Planning Commission was called to order by Vice -Chair Escobar at 7:01 PM PLEDGE OF ALLEGIANCE — Commissioner Lopez INVOCATION — Vice Chair Escobar ROLL CALL — Commissioners Lopez, Tang, Ung, Vice -Chair Escobar. Chair Berry was absent. STAFF PRESENT — Deputy Director of Community Development Valenzuela, Assistant Planner Do, Commission Liaison Lam Meeting resumed at 7:01 pm. City Attorney Stephanie Gutierrez is joined via Zoom. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Stephanie Gutierrez presented the procedure and appeal rights of the meeting. 2. PUBLIC COMMENTS FROM THE AUDIENCE There being no comments, Vice -Chair Escobar opened and closed the Public Comment period. 3. PUBLIC HEARINGS A. TENTATIVE PARCEL MAP (TPM) 84156 - Kiet Tran has submitted a Tentative Parcel Map application to subdivide one existing parcel into two parcels. The applicant is proposing to demolish two existing single- family dwellings onsite for future residential purposes. The project site is at 3901 Delta Avenue and is in the Single -Family Residential (R-1) zone. Per Rosemead Municipal Code Section 16.08.030, "no person shall subdivide any real property, improved or unimproved, or any portion thereof, shown on the latest adopted county tax roll as a unit, or as contiguous units, into four or fewer parcels for the purpose of sale, transfer or encumbrance, whether immediate or future, until a final map thereof has been filed and approved in accordance with the requirements of this chapter, or in accordance with the requirements for a subdivision of the State Subdivision Map Act, Government Code § 66410 et seq." CEQA - MCA 23-02 is not a project pursuant to California Environmental Quality Act (CEQA) Guideline 15378, because the activity undertaken involves general text amendments that would not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment and does not meet the definition of a "Project" under CEQA. The proposed Code Amendment is also exempt from CEQA under Section 15061(b)(3) of the CEQA Guidelines because CEQA only applies to projects which Rosemead Planning Commission Meeting Minutes of November 6, 2023 1 of 4 have the potential for causing a significant effect on the environment. It can be seen with certainty that there is no possibility that the text amendments will have a significant effect on the environment. Deputy Director Valenzuela introduced Assistant Planner Do to the Planning Commission Assistant Planner Do presented the staff report. Vice -Chair Escobar asked the Commission if there were any questions. Commissioner Tang asked if an applicant wants to subdivide a property, what are the City's requirements or qualifications for a subdivision. Assistant Planner Do answered the City has two primary requirements, one being the minimum lot area and the second being the lot width. She added, for the minimum lot area in the R-1 zone, the City requires that the minimum be 6,000 square feet and the minimum lot width is 50 feet. Commissioner Tang further inquired if there any interest from the applicant to also submit plans for development and questioned if they had development plans. Assistant Planner Do replied that she will defer that question to the applicant's representative. She said they are planning to develop the property based on residential usage. Commissioner Tang commented that he knows a lot of developers purchase a lot of properties to subdivide to sell the properties separately to make a profit. He added, often, the property purchased goes for long periods of time without being developed, which causes zero housing for that lot. No comments or questions from Commissioner Ung Commissioner Lopez questioned the intentions of this development. He questioned the purpose of purchasing this lot and knocking down two single-family dwellings units. Vice -Chair Escobar opens the floor to the applicant representative. The applicant's representative, Project Civil Engineer and Surveyor Jack Lee, stated with this tentative map, the owner wants to know if the property can be subdivided before submitting architectural plans for future development. He added, the architect is currently out of town, so he cannot be here to answer questions. He also added, the owner wants to ensure the property can be subdivided and if they are able to submit to the Building Division. Commissioner Tang commented that he understands that the owners want to ensure that subdivisions are allowable before they make the development plans, however, staff is open to submitting them both at the same time. He said it's a more efficient process, so that you do not have to go to two commission meetings. He added that he's just curious why that is the case. Mr. Lee commented that he does not know and believes that is the intention of the of the owner. There being no additional questions or public comment, Vice -Chair Escobar closed the hearing period. Vote resulted in: Ayes: Escobar, Lopez, Tang, and Ung Noes: None Abstain: None Absent: Berry Roll call vote resulted in 4 Ayes and 0 Noes 1 Absent. 4. CONSENT CALENDAR A. PC MINUTES 10.02.23 Commissioner Tang made a motion, seconded by Commissioner Lopez, to approve PC Minutes 10-2-23 as presented. Vote resulted in: Ayes: Escobar, Lopez, Tang, and Ung Noes: None Abstain: None Absent: Berry Roll call vote resulted in 4 Ayes and 0 Noes and 1 Absent. 5. MATTERS FROM STAFF No matters from Staff. 6. MATTERS FROM THE CHAIR & COMMISSIONERS Commissioner Tang praised City staff on the City's Halloween event. Commissioner Lopez commented on the growing issue of homelessness under the Rosemead bridge, towards the west side. Deputy Director Valenzuela answered that the City Manager is aware of the issues and is working on that issue. Commissioner Lopez further commented that number of homeless people are growing rapidly and is very concerning. Deputy Director Valenzuela replied that the City Manager is on top of these growing issues and is working on getting the site cleaned.
