CC - 1967 - 102 - Maintenance District No. 1CITY OF ROSEMEAD RESOLUTION NO. 67-102 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF BEAUTIFICATION IMPROVEMENTS ON VALLEY BOULEVARD (IMPROVEMENT DISTRICT NO. 1) IN SAID CITY: DECLARING ITS INTENTION TO ORDER THAT THE EXPENSES OF MAIN- TAINING AND OPERATING THE IMPROVEMENTS ON VALLEY BOULEVARD SHALL BE ASSESSED UPON THE REAL PROPERTY LYING WITHIN SAID IMPROVEMENT DISTRICT NO. 1 (MAINTENANCE DISTRICT NO. 1), IN SAID CITY: DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE CENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPEN- SES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID !,JOR1<, OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH, AND GIVING NOTICE THEREOF. The City Council of to City of Rosemead, pursuant to the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows: DESCRIPTION OF WORK Section 1. That the public interest and convenience require an 3 itis the. intention of the City Council of the City of Rosemead, California to order the following work to be done all along Valley Boulevard in the City of Rosemead, to wit: The construction and installation of salted, coated concrete sidewalks, and exposed aggregate sidewalks; special landscaping, including trees, ground coder, landscape lighting and irrigation syste-n where appropriate, bouquet canyon stone walls, trash containers and bus benches; widening and paving of Valley Boulevard and installation of new curbs and gutters, where necessary. The City Co:_ncil of the City of Rosemead further declares that the public interest and convenience require and it is the intention of the City Council of the City of Rosemead, California to order that the expenses of maintaining and operating the sidewalks, curbs, gutters, and any improvements which may be constructed under Improvement District No. 1, shall be assessed, either in whole or in part, upon the real property lying within said Improvement District No. 1. PLANS, PROFILES, DRAVIIiJGS AND SPECIFICATIONS Section. 2. All of the said work and improvements to be done shall a cnstructed upon the grades, along the lines, between the points of dimensil-ns, at the places in the manner shown on the plans, profiles, drawings; and specifications for the con- struction of said improvements; which plans, profiles, drawings, and specifications are on file in the office of the City Clerk, contained in the file known as "improvement-Maintenance District Nos. 1," and to which plans, profiles, drawings and specifica- tions heretofore approved by the City Council of the City refer- ence is hereby made for a further and more particular description of said work, and they shall govern as to all details. DESCRIPTION OF IMPROVEMENT DISTRICT AND MAINTENANCE DISTRICT Section 3. As the contemplated work and improvement, and the maintenance and operation thereof, in the opinion of the City Council, is of more than local or ordinary benefit, the City Council hereby makes the expenses of said work and improvements chargeable upon a district, which district the City Council hereby declares to be the district benefited by said work and improve- ments and to be assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Rosemead, California, exclusive of streets and alleys, included within the exterior boundary of line shown upon that certain map or plot for improvement District No. 1, consisting of two sheets, heretofore approved by the City Council of said City indicating by said boundary line the extent of the territory included within the proposed Improvement District Ho. 1, and the proposed Maintenance District No. 1 and which map is on file in the office of the City Clerk. Reference is hereby made to said flap for any further, full and more particular description of said improvement District, and the said Map on file will govern all details as to the extent of said improvement District. The City Council hereby makes the expenses of maintain- ing and operating the curbs, gutters, sidewalks, landscaping, and all the improvements to be constructed under improvement District No. 1, chargeable upon a district which said district, the said City Council declares to be the district benefited by the opera- tion and maintenance of said improvements. Said maintenance district shall be known as Maintenance District No. 1. The des- cription of Maintenance District No. 1 shall be the same as the above description of the boundaries of Improvement District No. 1. DESCRIPTION OF BONDS Section 4. That serial bonds, bearing interest at the rate of six percent (b%) per annum, shall be issued to represent each assessment of fifty dollars ($50.00) or more remaining unpaid for thirty (30) days after the date of mailing statements to property owners, all as provided by the Improvement Act of 1911, being Part 5, Division 7, of the Streets and Highways Code. Said serial bonds shall extend over a period ending fifteen (15) years from the second day of January next succeeding the next September 1 following their date. Said serial bonds shall provide for the redemption of said bonds, upon payment of a premium of five percent (5%) of the unmatured principal under the authority of and in conformance with Section 6464 of the Streets and Highways Code. The City Treasurer shall retain the first one percent (1%) penalty on all delinquent payments, as a cost of servicing the delinquency, as authorized and in accordance with Section b442 of the Streets and Highways Code. TIME AND PLACE OF HEARING Section 5. Notice is hereby given that on the 9th day of Januarys at the hour of 8:00 o'clock p.m, in the chambers of the City Council in the City Hall in said City of Rosemead, any and all persons having any objections to the pro- posed work or improvement or to the extent of the assessment district, or to the proposed maintenance district or to its extent, may appear and show cause why said work should not be done or carried out in accordance with this resolution of intention. Protests must be in writing and must be delivered to the City Clerk by the time set for hearing. - 2 - IMPROVEMENT ACT Section 6. That all of the work herein proposed shall be done an cT arriea through in pursuance of an Act of the Legisla- ture of the State of California, designated the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California. PROVISION FOR IMPROVEMENT Section 7. These proceedings have been initiated by a Petition signea-715y all of the owners of more than 60% in area of the property to be assessed, which petition waives the require- ments of Division L!. of the Streets and Highways Code. The esti- mated cost of the improvements is the sum of $103,440. MAILING OF RESOLUTION OF INTENTION Section 3. The City Clerk is directed to mail notices of the adoption o-f-this resolution of intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for taxes, all in the :Wanner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 10,11," of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT Section 9. The Superintendent of Streets of the City of Rosemea s?nia TT cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices or' the passage of this Resolution of intention in the time, form, and manner provided by said Code. PUBLICATION OF RESOLUTION OF INTENTION Section 10. The SAN GABRIEL VALLEY DAILY TRIBUNE, a newspaper o genera circulation in the County of Los Angeles, is hereby selected as the newspaper in which this resolution shall be published, and, except when otherwise ordered by the City Council, in which all other publications required to be made shall be published. The City Clerk is directed to certify to the adoption of this resolution and to cause said resolution to be published in the manner provided by law. PROHIBITION ON TAKING CONTRACT Section 11. Pursuant to Section 5250 of said Code, the City Counci Inds t at public interest and convenience require that the property owners not elect to take the construction con- tract. 1967.
