A. Public Hearing - Adoption of Resolution No. 2024-41 Approving the Placement of a
City Charter on the Ballot of the November 5, 2024 General Election and Calling of
a Special Municipal Election and Consolidating the Charter Measure with the
General Election and Additional Direction Regarding the Ballot Measure as Provided
for Under the Elections Code
Cities in California are either general law cities or charter cities. General law cities
may only adopt and enforce ordinances and regulations that are consistent with the
laws of the State of California. In contrast, charter cities which are authorized by the
California constitution may adopt and enforce ordinances and regulations regarding
municipal affairs subject only to the limitations contained in the city's charter.
The City of Rosemead is a general law city. The City Council has been discussing
converting to a charter city by placing a city charter on the ballot at the November 5,
2024 election. At its March 26, 2024 meeting, the City Council directed that a draft
charter be set for public hearing pursuant to State law. As required by State law,

the City then conducted two public hearings on the proposed charter on May 28 and
June 27, 2024.
After holding a second hearing on the draft charter, the City Council may vote to
adopt a motion submitting the proposed charter to the City's voters. The purpose of
this meeting is to consider whether to approve Resolution No. 2024-41, placing the
proposed charter on the ballot at the November 5, 2024 election. If the City Council
approves Resolution No. 2024-41, the City would not become a charter city.
Only the City's voters can authorize a conversion of the City from a general law to a
charter city. A majority of the City's voters must approve the measure for the City to
become a charter city.
Recommendation: That the City Council take the following actions:
1. Conduct the Public Hearing and take any public comment.
2. As it relates to items to include in Resolution No. 2024-41:
• Ballot Language for the Resolution.
• If the Council wants to select a letter(s) to designate the Ballot measure and
if so what the letter(s) should be.
• If the Council wants to submit an argument in favor of the measure and
potential rebuttal and designate up to two Councilmembers to submit on
behalf of the Council as whole or in part of the Council.
• City Council determine what Ballot Teat to include.
3. Consider whether to adopt Resolution No. 2024-41, entitled:

C. Biennial Review and Update of the City's Conflict of Interest List of Designated
Positions Pursuant to Adoption of Resolution No. 2024-39
The Political Reform Act (California Government Code 81000) controls conflicts of
interest of public officials through disclosure of financial interest and prohibitions on
participation in the making of decisions in which the official knows or has reason to
know he or she has financial interest. Pursuant to California Government Code
87306, each city is required to have a conflict-of-interest code, review its code
biennially, and make amendments, if necessary. The biennial review requires that
the City designate employees who must disclose certain investments, income,
interests in real property, and business positions, and who must disqualify themselves
from making or participating in the making of governmental decisions affecting
those interests.

DESIGNATED POSITIONS REQUIRED UNDER THE CITY'S
CONFLICT OF INTEREST CODE
D. Amendment to the Professional Services Agreement for Psomas - Updates to the
Zoning Code
On February 28, 2023, the City Council authorized the City Manager to execute a
Professional Services Agreement with Psomas to analyze and update the City's
existing General Plan, Zoning Code, and corresponding Environmental Impact
Reports (EIR) in order to be consistent with the vision and goals of the 2021-2029
Housing Element, the California Environmental Quality Act (CEQA), and California
State law as of January 1, 2024. The Professional Services Agreement was fully
executed on March 21, 2023, in the amount of up to $232,374 and amended on
February 24, 2024 to extend the term of the agreement for up to one year.
On May 22, 2024, a Special Joint Workshop with the City Council and Planning
Commission was held to discuss the project status and to receive direction on the
expansion of the project and corresponding CEQA compliance. In response to the
direction received from the City Council and Planning Commission, an amendment
to the Professional Services Agreement with Psomas is required to extend the term
of the agreement and to expand the scope of work.
Recommendation: That the City Council approve Amendment No. 2 with the
following term changes:
1. Section 3.1 — Scope of Services and Term. The terms of the agreement shall be
for two (2) years with a (1) one-year extension at the sole and absolute discretion
of the City beginning on July 23, 2024. The amendments will be applied to
Subsection 3.1.2.
2. Section 3.3 — Fees and Payments. The Professional Services Agreement between
the City of Rosemead and Psomas by increasing the not -to -exceed contract
amount from $232,374 to $459,639.74. The amendments will be applied to
Subsections 3.3.1.
E. Memorandum of Agreement for the Coordinated Integrated Monitoring Program and
Watershed Management Plan for the Upper Los Angeles River Watershed
Management Area
On August 5, 2015, the Regional Board approved the Upper Los Angeles River
(ULAR) Watershed Management Plan (WMP) and Coordinated Integrated
Monitoring Plan (CIMP). During the Regional Board approval process the ULAR
WMP group had developed a Memorandum of Agreement (MOA) to administer and
establish a cost share for the implementation of the CIMP. On May 8, 2018, the
Council approved an MOA to maintain the City's participation in the ULAR WMP
group for CIMP monitoring and reporting services for a five-year period beginning
July 1, 2018, through June 30, 2023. Following a reconciliation process for the ULAR

WMG's MOA from 2018-2023, it was determined that the budget had been
exceeded. The City's proportional amount that was overrun and is due is $13,710.16.
To reconcile the financial overage, an MOA was prepared and provided to all
participating jurisdictions.
Recommendation: That the City Council authorize the City Manager to execute the
amendment to the Memorandum of Agreement for the Upper Los Angeles River
Watershed Management Area for Fiscal Years 2018-2023.
F. Adopt Resolution No. 2024-37, Authorization to Acquire One New Ford Explorer
Vehicle in an Amount Not -to -Exceed $75,000
The City is seeking to acquire one new 2024 Ford Explorer vehicle utilizing
Equipment Replacement (Fund 501) Internal Service Funds for Lieutenant Kevin
Tiwari of the Los Angeles Sheriffs Department ("LASD"). Due to specialized
equipment that needs to be installed in the vehicle, lack of inventory, high mark-ups,
and long lead times to acquire new vehicles on the open market, Staff is requesting
purchase order authority to acquire the vehicle pursuant to the City Purchasing Policy
as outlined in Rosemead Municipal Code Section 3.24.090. Therefore, it is
recommended that the City Council adopt Resolution No. 2024-37 amending the
City's Fiscal Year 2024-25 Equipment Replacement Fund (Fund 501) to appropriate
additional funds in the amount of $75,000, and authorize and direct the City Manager
to execute a purchase order in an amount not to exceed $75,000 for the acquisition
of one new 2024 Ford Explorer vehicle. The adopted Fiscal Year 2024-25 Budget did
include a budget of $100,000 for the purchase of the vehicle with the expectation that
AQMD Funds would be utilized. However, law enforcement agencies do not
frequently employ hybrid and electrical vehicles (AQMD eligible) due to the overall
lack of power and accelerating from a complete stop. Consequently, the decision was
made to purchase a gas -powered vehicle.
Recommendation: That the City Council take the following actions:
1. Authorize and direct the City Manager to execute a purchase order in an amount
not -to -exceed $75,000 for the acquisition of one new 2024 Ford Explorer vehicle.
2. Adopt Resolution No. 2024-37, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, AMENDING THE FISCAL YEAR
2024-25 BUDGET AND APPROPRIATE FUNDS FOR THE
ACQUISITION OF A VEHICLE
G. Traffic Review Along Willard Avenue Between Garvey Avenue and Dorothy Street
The City of Rosemead has received a resident request as well as a request from the
school district to review traffic conditions along Willard Avenue between Garvey
Avenue and Dorothy Street. The request reported that due to the number of school
children crossing Willard Avenue along with added school congestion, pedestrians
are vulnerable to approaching cars. In response to this request, engineering staff has

completed a review of existing conditions along the segment, as well as the
installation of a crossing guard, and crosswalk installation review. The review
resulted in various recommended traffic improvements including the installation of a
new midblock crosswalk.
Recommendation: That the City Council authorize the following recommended
items:
1. NEW SPEED LIMIT 25MPH: Install 25 MPH speed limit sign (24"00") (R2-
1); Willard Avenue has a regular posted speed of 25 mph, the SCHOOL 25 mph
When Children are Present signs do not apply.
2. REPAINT CROSSWALKS: Repaint east leg and south leg crosswalks at the
intersection of Dorothy Street and Rockhold Avenue with yellow ladder striping.
3. REMOVE AND REALIGN SCHOOL SIGN (S1-1): west side of Rockhold
Avenue.
4. REMOVE AND REPLACE SIGNS: Remove "25 MPH when Children Are
Present" Sign (SR4-1) and replace with 25 MPH Speed Limit Sign (24"00")
(R2-1). Willard Avenue has a regular posted speed of 25 MPH, the SCHOOL 25
MPH When Children are Present signs do not apply.
5. INSTALL STOP AHEAD SIGN (W3-1): Install "STOP AHEAD" sign on
existing light pole, located on west side of Willard Avenue, approximately 350 -
feet north of Garvey Avenue for SB direction of traffic.
6. INSTALL MIDBLOCK CROSSWALK ALONG WILLARD AVENUE: north
of the school frontage of Willard Elementary School. The Crosswalk should be
painted yellow with either ladder or continental striping. The location is to be
determined by an engineering review of existing power vaults and existing power
poles along the sidewalks.
7. INSTALL PEDESTRIAN CROSSING SIGNAGE WITH DOWNWARD
FACING ARROW (SW24-2): Install School Pedestrian Crossing (SW24-2)
Signage (36"06") at the new midblock crosswalk will be installed along of the
school frontage at Willard Elementary School.
8. INSTALL PEDESTRIAN CROSSING AHEAD SIGNAGE (SW24-3): Install
Signage (36"06') along Willard Avenue, approximately 200' north and 200'
south of where the new midblock crosswalk will be installed along Willard
Avenue.
9. ASSIGN A CROSSING GUARD AT THE NEW MIDBLOCK CROSSWALK
DURING DROP OFF AND PICK UP HOURS TO BE DETERMINED BY THE
SCHOOL DISTRICT: to help alert drivers of pedestrians crossing the street to
reach Willard Elementary School, on the east side of the street on Willard Avenue

H. Award of Professional Services Agreement for Engineering Support Services for
American Rescue Plan Act (ARPA) Funded CIP Projects
As part of the City's Fiscal Year 2024-25 Capital Improvement Program, the City
Council approved three (3) American Rescue Plan Act (ARPA) funded projects. The
three (3) ARPA funded CIP projects are the City Hall Interior Renovation, Public
Safety Center Rehabilitation, and Rosemead Park Restroom Renovation projects.
The total cost of the three projects is $4,000,000. To assist in expediting the delivery
of the projects in order to meet funding timelines, the City released a Request for
Proposals for Engineering Support Services which includes program management,
project management, project development, design management, construction
management, and construction inspection. Bowman Consulting Group, Ltd.
submitted the most qualified proposal to provide Engineering Services for the
projects. Staff recommend utilizing ARPA funds for the Engineering Support
Services agreement to ensure the timely delivery of these ARPA funded projects.
Recommendation: That the City Council take the following actions:
1. Authorize the City Manager to execute a professional services agreement with
Bowman Consulting Group, Ltd., in the amount of $274,840; and
2. Adopt Resolution No. 2024-40, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, TO AMEND THE FISCAL YEAR
2024-25 CAPITAL IMPROVEMENT PROGRAM BUDGET AND
APPROPRIATE ADDITIONAL FUNDS FOR THE CITY HALL
INTERIOR RENOVATION (PROJECT NO. 49018), PUBLIC
SAFETY CENTER (PROJECT NO. 31028), AND ROSEMEAD
PARK RESTROOM RENOVATION (PROJECT NO. 41026)
L Adoption of Resolution No. 2024-38 Reestablishing Hiring and Referral Incentive
Pay for Part -Time Employees by Amending Salary and Benefits for Part -Time
Classifications in the Service of the City of Rosemead from July 1, 2023 Through
June 30, 2025
In addition to its' full-time staff, the City maintains a variety of employee
classifications on a part-time or hourly basis. The employees in these positions work
throughout the year, seasonally, or on a temporary basis and typically work no more
than 1000 hours per fiscal year unless exempt from Ca1PERS requirements or
assigned to one of the four 3/4 -time positions. Resolution No. 2024-38 reestablishes
the hiring referral/incentive pay for select part-time classifications which was initially
established via Resolution No. 2022-22, with an effective date of March 22, 2022.
On September 12, 2023, the hiring/referral incentive pay was inadvertently omitted
from the salary and benefits resolution for part-time employees, Resolution No.
2023-50. It is important to note that there are no other recommended changes to the
Salaries and Benefits for Part -Time Employees resolution.
