RESOLUTION NO. 68-83
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD AUTHORIZING THE
ACQUISITION OF NECESSARY RIGHTS OF WAY
FOR ROAD PURPOSES AND ORDERING EMINENT
DOMAIN PROCEEDINGS.
WHEREAS, the public interast and necessity of the
people of the City of Rosemead do require the improvement of
Walnut Grove Avenue from Garvey Avenue to Hellman Avenue
over and across those certain parcels of land hereinafter
described, and for that purpose and for such public use it
is necessary that an easement in, upon, over and across said
parcels be acquired by said City by condemnation, which property
is located in the City of Rosemead, County of Los Angeles,
State of California, and is more particularly described as
follows:
Parcel 5-52, 53, 54: (Walnut Grove Avenue)
Those portions of those certain parcels of land in Lot
2, Fractional Section 19, Township 1 South, Range 11 West,
S.B.M., and in the southeast quarter of Fractional Section
24, Township 1 South, Range 12 West, S.B.M., described as
Parcel 2 in deed to Bobby Frank Allen et ux, recorded as
Document No. 3932, on March 5, 1962, in Book D1532, page
420, and described as Parcel 1 in deed to Bobby Frank Allen
et ux, recorded as Document No. 3933, on March 5, 1962, in
Book D1532, page 421, both of Official Records, in the office
of the Recorder of the County of Los Angeles, which lie
within a strip of land 20 feet wide, the westerly boundary
of which is the easterly boundary of Walnut Grove Avenue, as
shown on map of Tract No. 11391, recorded in Book 205, pages
12 and 13, of Maps, in the office of said recorder.
Parcel 5-52-56: (Walnut Grove Avenue)
That portion of that certain parcel of land in Lot 2,
Fractional Section 19, Township 1 South, Range 11 West,
S.B.M.., and in the southeast quarter of Fractional Section
24, Township 1 South, Range 12 West, S.B.M., described in
deed to Carl W. Beatty et us, recorded as Document No. 1039,
on May 23, 1962, in Book D1F23, page 576, of official Records,
in the office of the Recorder of the County of Los Angeles,
which lies within a strip of land 20 feet wide, the westerly
boundary of which is the easterly boundary of Walnut Grove
Avenue.as shown on map-of Tract No..11391, recorded in Book
205, pages 12 and 13, of.Maps,, in the office of said recorder.
Parcel 5-70: (Walnut Grove Avenue)
The westerly 20 feet of the southerly 121 feet of Lot
42, Tract No.. 3706, as shown on.map recorded in Book 40,
page 39, of Maps, in the office of the Recorder of the County
of Los Angeles,.
Excepting therefrom the northerly 60.5 feet therof.
Parcel 5-.78,79: (Walnut Grove Avenue)
The easterly 10 feet of the westerly 20 feet of the
southerly ,5 feet of Lot 44, Tract No. 3706, as shown on map
recorded in Book 40, page 39, of Maps, in the office of the
Recorder of the County of Los Angeles and the easterly 10
feet of the westerly 20 feet.of the northerly 66 feet of
Lot 45, said tract. ,

Parcel 5-85: (Walnut Grove Avenue)
That portion of Lot 47, Tract No. 3706, as shown on map
recorded in Book 40, page 39, of Maps, in the office of the
Recorder of the County of Los Angeles, which lies within a
strip of land 80 feet wide, lying 40 feet on each side of
the following described center line:
Beginning at the intersection of a line parallel with
and 25 feet easterly, measured at right angles, from the
easterly line of Lot 112, Tract No. 5242, as shown on map
recorded in Book 56, page 77, of said Maps, with the
center line of Garvey Avenue as said center line is shown on
said last mentioned map,, thence-northerly in a direct line to a
point in a line parallel with and 20 feet easterly, measured
at right angles, from the westerly line of Walnut Grove
Avenue, as shown on map of said Tract No. 3706, distant
southerly thereon 1263.45 feet from a line parallel with
and 30 feet southerly, measured at right angles, from the
southerly line of Lot 10, Block C, Tract No. 11391, as shown
on map recorded in Book 205, pages 12 and 13, of said Maps.
Excepting therefrom the southerly 220 feet thereof.
Also excepting therefrom the northerly 60 feet thereof.
Parcel 5-86: (Walnut Grove Avenue)
Parcel A:
That portion of the northerly 200 feet of the southerly
220 feet of Lot 47, Tract No. 3706, as shown on map recorded
in Book 40, page 39, of Maps, in the office of the Recorder
of the County of Los Angeles, within a strip of land 80 feet
wide, lying 40 feet on each side of the following described
center line:
Beginning at the intersection of a line parallel with
and 25 feet easterly, measured at right angles, from the
easterly line of Lot 112, Tract No. 5242, as shown on map
recorded in Book 56, page 77, of said Maps, with the center
line of Garvey Avenue as said center line is shown on said
last mentioned map; thence northerly in a direct line to a
point in a line parallel with and 20 feet easterly, measured
at right angles, from the westerly line of Walnut Grove
Avenue, as shown on map of said Tract No. 3706, distant
southerly thereon 1263.45 feet from a line parallel with and
30 feet southerly, measured at right angles, from the
southerly line of Lot 10, Block C, Tract No. 11391, as shown
on map recorded in Book 205, pages 12 and 13, of said Maps.
Parcel B:
That portion of above mentioned Lot 47, within the
following described boundaries:
Beginning at the intersection of the easterly line of
above described Parcel A with the northerly line of the
southerly 20 feet of said lot; thence easterly along said
northerly line to the beginning of a curve concave to the
northeast, having a radius of 27 feet, tangent to said
northerly line and tangent to said easterly line; thence
northwesterly along said curve to said easterly line; thence
southerly along said easterly line to the point of beginning.

Parcel 5-88: (Walnut Grove Avenue)
The easterly 20 feet of the southerly 50 feet of Lot 36,
Tract No. 3706, as shown on map recorded in Book 40, page 39,
of Maps, in the office of the Recorder of the County of
Los Angeles.
Parcel 5-90: (Walnut Grove Avenue)
The easterly 20 feet of Lot 35, Tract No. 3706, as shown
on map recorded in Book 40, page 39, of Maps, in the office of
the Reoorder of the County of Los Angeles.
Excepting therefrom the northerly 50 feet thereof.
Also excepting therefrom the southerly 71 feet thereof.
Parcel 5-102: (Walnut Grove Avenue)
That portion of that certain parcel of land in Lot 29,
Tract No. 3706, as shown on map recorded in Book 40, page
39, of Maps, in the office of the Recorder of the County of
Los Angeles, described in deed to James Laing et ux, recorded
as Document No. 2235, on April 10, 1963, in Book D1986, page
698, of Official Records, in the office of said recorder,
which lies within a strip of land 80 feet wide, lying 40 feet
on each side of the following described center line;
Beginning at the intersection of a line parallel with
and 25 feet easterly, measured at right angles, from the
easterly line of Lot 112, Tract No. 5242, as shown on map
recorded in Book 56, page 77, of said Maps, with the center
line of Garvey Avenue as said center line is shown on said
last mentioned map; thence northerly in a direct line to a
point in a line parallel with and 20 feet easterly, measured
at right angles, from the westerly line of Walnut Grove
Avenue, as shown on map oC.said Tract No. 3706, distant
southerly theron 1263.45 feet from a line parallel with and
30 feet southerly, measured at right angles, from the
southerly line of Lot 10, Blcok C, Tract No. 11391, as shown
on map recorded in Book 205, pages 12 and 13, of said Maps.

NOW, THEREFORE, the City Council of the City of
Rosemead does hereby resolve as follows:
Section 1. That the improvement of Walnut Grove
Avenue from Garvey Avenue to Hellman Avenue and the acquisition
of an easement in, upon, over and across said real property for
said public purpose is a use authorized by law.
Section 2. That the public interest and necessity
require the improvement of said public highway.
Section 3. That the above described parcels of land
are necessary for such purpose.
Section 4.. That such proposed improvement of said
public highway is located in a manner which will be most compat-
ible with the greatest public good and the least private injury.
Section 5. That the certain parcels of land above
described be condemned for a public purpose, namely, for the
improvement of Walnut. Grove Avenue from Garvey Avenue to Hellman
Avenue for public road and highway purposes, and the City Attorney
of the City of Rosemead is hereby directed to institute eminent
domain proceedings in the Superior Court of the State of California
for the County of Los Angeles, for the condemnation of said
parcels of land above described for public road and highway
purposes, and.to take all steps necessary for the condemnation
of said parcels of land in the name of said City.
Section 6. That the public interest and necessity
require the taking of immediate possession, the City Attorney
is directed to institute proceedings for the taking of immediate
possession, and the use of the property herein ordered to be
acquired, upon complying with the requirements of the law
applicable thereto.
