A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD REQUESTING THE STATE LEGISLATURE
TO CLARIFY THE AREAS WITHIN WHICH MUNICIPAL
GOVERNMENT MAY LEGISLATE AND SUPPORTING
SENATE BILL NO. 4.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS
FOLLOWS:
WHEREAS, the California Constitution, Article X1,
Section 11 vests police power in local agencies, including
the cities of the State of California, thereby granting
cities the authority and imposing upon them the responsibility
to adopt local police, sanitary and other regulations for the
public peace, health, safety and welfare, and
WHEREAS, it has become increasingly difficult, and in
many areas of legislation, impossible, under decisions of the
appellate courts of California, for city legislative bodies to
determine whether vital areas of local public interest are
within their province to adopt local regulations, or would be
held by the courts to be pre-empted by the State, and
WHEREAS, the California Legislature has it within its
power to clarify the areas within which municipal government may
legislate, and such clarification would be in the interest of
the Legislature, local government and the people of the State of
California,
NOW, THEREFORE, BE IT RESOLVED:
Section 1. That this City Council urgently requests
the Cali ornif- state Legislature to adopt a statute declaring
its intention regarding pre-emption of local regulation by state
laws, for the guidance of the courts, the local governments and
law enforcement agencies of the State;
Section 2. That this City Council strongly supports
and endorses Senate Bill No. 4 as a measure that would alleviate
great confusion and uncertainty as to the areas wi.thin which
local government may validly legislate, and requests the
Legislature to enact Senate Bill No. 4, or a comparable measure,
into law;
Section 3. That the City Clerk is directed to certify
and transmit copies of this eesolution to Senator Alfred H. Song,
Assemblymen Walter Karabian and Harvey Johnson, all co-authors
of said Senate Bill No. 4, and to the California League of Cities
and to all cities in the County of Los Angeles.
