CC - 1971 - 37 - Vacate Rush StRESOLUTION NO. 71-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD EXPRESSING THE INTENTION TO VACATE A PORTION OF RUSH STREET AND SETTING THE TIME AND PLACE FOR A PUBLIC HEARING THEREON. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Rosemead hereby elects to proceed under and pursuant to the provisions of Division 9, Part 3 of the Streets and Highways Code of the State of California, and hereby declares its intention to order the vacation of a portion of Rush Street within the City of Rosemead as delineated and shown on the map and plan on file in the office of the City Clerk of the City of Rosemead, more particularly described in Exhibit "A" attached hereto and made a part hereof. For further particulars as to the extent of said-proposed vacation, reference is made to the map and plan on file and open to public inspection in the office of the City Clerk. SECTION 2. The City Council has determined that the public convenience and necessity require the reservation of easements and rights of way for all existing franchises and renewals thereof pursuant to Streets and Highways Code Sections 8330 and 8331. SECTION 3. The hour of 8:00 P.M. on the 8th day of ,tune, 1971, at 8838 East Valley Boulevard in the City of Rosemead, County of Los Angeles, State of California, is hereby designated as the time and place for the public hearing in connection with this matter and all persons interested in or objecting to the proposed vacation may appear and be heard. SECTION 4. The City Clerk is directed to post notices of said proposed vacation conspicuously along the line of that portion of Rush Street proposed to be vacated at least ten (10) days before the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8322 of the Streets and Highways Code of the State of California. PASSED, APPROVED AND ADOPTED this 11th day of May, 1971. ATTEST: W, MAYOR OF THE Y EM AD 1~LiiL~ • EXHIBIT "A" (Portion 1) That portion of Rush Street, formerly Rush Avenue, in the City of Rosemead, County of Los Angeles, State of Cali- fornia, as shown on mapp of Tract No. 7123, filed in Book 82, pages 72, 73 and 74, of Maps, in the office of the Recorder of said County, said portion extends from the westerly prolongation of the straight line in the northerly boundary of Lot 110, said tract, southeasterly to a line parallel with and 5 feet westerly, measured at right angles, from the straight line in the easterly boundary of Lot 113, said tract. Reserving and.excepting unto the City of Rosemead and Sanitation District No. 15 of Los Angeles County, an ease- ment for sanitary sewers and appurtenant structures in and across above described parcel of land herein being vacated, within a strip of land 10 feet wide, the northeasterly line of which is a line parallel with and 33 feet southwesterly, measured at right angles, from the southwesterly line of Lot 112, said tract. (Portion 2) That portion of Rush Street, formerly Rush Avenue, in the City of Rosemead, County of Los Angeles, State of Cali- fornia, as shown on mapp of Tract No. 7123, filed in Book 82, pages 72, 73 and 74, of Maps, in the office of the Recorder of said County, said portion extends from a line parallel with and 5 feet easterly, measured at right angles, from the westerly line of Lot 141, said tract, southeasterly to the northerly boundary of that certain 100 foot strip of land described in Parcel 15-8 of deed to County of Los Angeles,_ for Rush Street, recorded as Document No. 3350, on December 6, 1967, in Book D3851, page 205, of Official Records, in the office of said Recorder. Reserving and excepting unto the City of Rosemead and Sanitation District No. 15 of Los Angeles County, an ease- ment for sanitary sewers and appurtenant structures in and across above described parcel of land herein being vacated, within a strip of land 10 feet wide, the northeasterly line of which is a line parallel with and 33 feet south- westerly, measured at right angles, from the southwesterly line of Lot 142, said tract. The reservation and exception herein being made is done in accordance with the provisions of Sections 8330 and 8331 of the Streets and Highways Code of the State of California.
