A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD AUTHORIZING THE ACQUISITION OF
NECESSARY RIGHTS OF WAY FOR ROAD PURPOSES
AND ORDERING EMINENT DOMAIN PROCEEDINGS,
WHEREAS, the public interest and necessity of the
people of the City of Rosemead do require the improvement of
Walnut Grove Avenue from Garvey Avenue to Fern Avenue over and
across those certain parcels of land hereinafter described,
and for that purpose and for such public use it is necessary
that an easement in, upon, over and across said parcel be
acquired by said City by condemnation, which property is
located in the City of Rosemead, County of Los Angeles, State
of California, and is more particularly described as follows:
Before Take: That portion of NW 1/4 of NW 1/4 of Section
30, T. 1Sā R. 11 W., S.B.B. & M. in Rancho
Potrero Grande, County of Los Angeles as
recorded in Book 54, Page 57 of Miscellaneous
Records, described as follows:
Beginning at intersection of Southerly line of
Garvey Avenue, 100 feet wide, as described in
deed, recorded in Book 10709, Page.316; or said
point of intersection being 50 feet Southerly
and 25 feet Easterly of the Northwest corner of
Section 30; thence East along Southerly line of
Garvey Avenue 90 feet to the Northwest corner
of land described in deed from Robert H. Bossert
to James E. Perkins, recorded in Book 18697,
Page 4; or thence Southerly parallel to Walnut
Grove Avenue, 138 feet; thence Westerly parallel
with Garvey Avenue, 90 feet, to the East line
of Walnut Grove Avenue; thence Northerly along
said East line of Walnut Grove Avenue; thence
Northerly along said East line, 138 feet, more
or less, to the point of beginning.
Property Part A:
e~ T5Fen: That portion of the Easterly 15 feet of the
Westerly 40 feet of the NW 1/4 of NW 1/4 of
Section 30, T. 1 Sā R. 11W ā S.B.B. & M. in
Rancho Potrero Grande, as shown on map recorded
in Book 54, Pages 57 and 58 of Miscellaneous
Records in the office of the Recorder of the
County of Los Angeles, which lies within that
certain parcel of land described in deed to
Allen J. Wollard et ux, recorded as Document
No, 1253, on May 1, 1942, in Book 19332, Page
30, of Official Records in the office of said
recorder.
To be known as WALNUT GROVE AVENUE,
Part B:
Ti-Tat portion of the NW 1/4 of above mentioned
section, within the following described
boundaries:
Beginning at the intersection of the Easterly
line of above described Part A, with the
Southerly line of the Northerly 50 feet of said
section; thence Easterly along said Southerly
line to the beginning of a curve concave to the
Southeast, having a radius of 27 feet, tangent
to said Southerly line and tangent to said
Easterly line; thence Southwesterly along
said curve to said Easterly line; thence
Northerly along said Easterly line to the
point of beginning.
To be known as WALNUT GROVE AVENUE.
NOW, THEREFORE, the City Council of the City of Rosemead
does hereby resolve as follows:
Section 1. That the improvement of Walnut Grove Avenue
from Garvey Avenue to Fern Avenue and the acquisition of an
easement in, upon, over and across said real property for
said public purpose is a use authorized by law.
Section 2. That the public interest and necessity
require tie 'improvement of said public highway.
Section 3. That the above described parcel of land is
necessary ch purpose.
Section 4. That such proposed improvement of said public
highway is cated in a manner which will be mose compatible
with the greatest public good and the least private injury.
Section 5. That the certain parcel of land above
described-6e condemned for a public purpose, namely, for the
improvement of Walnut Grove Avenue from Garvey Avenue to Fern
Avenue for public road and highway purposes, and the City
Attorney of the City of Rosemead is hereby directed to institute
eminent domain proceedings in the Superior Court of the State
of California for the County of Los Angeles, for the condemna-
tion of said parcel of land above described for public road and
highway purposes, and to take all steps necessary for the con-
demnation of said parcel of land in the name of said City.
Section 6. That the public A nterest and necessity
require tFe to Ting of immediate possession, the City Attorney
is directed to institute proceedings for the taking of immediate
possession, and the use of the property herein ordered to be
acquired, upon complying with the requirements of the law
applicable thereto.
