RESOLUTION NO.71-39
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD ORDERING THE VACATION OF A PORTION
OF RUSH STREET.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, the City Council of the City of Rosemead
did on May 11, 1971, adopt Resolution No. 71-37 entitled "A
Resolution of the City Council of the City of Rosemead
Expressing the Intention to Vacate a Portion of Rush Street
and Setting the Time and Place for a Public Hearing Thereon";
and
WHEREAS, the said City Council did hold a public
hearing thereon on June 8, 1971, at 8:00 p.m, at 8838 East
Valley Boulevard, City of Rosemead, State of California, at
which time said Council did hear all evidence offered by
persons interested in said vacation; and
WHEREAS, the City Council of the City of Rosemead
does hereby find that the portion of Rush Street as described
and referred to in said Resolution No. 71-37 is unnecessary for
present or prospective public street purposes,
NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE
CITY COUNCIL OF THE CITY OF ROSEMEAD AS FOLLOWS:
SECTION 1. That certain portion of Rush Street as
described in Exhibit "A" attached hereto and made a part hereof,
shall be and is hereby vacated, subject to the reservations and
exceptions provided in Section 2 hereof.
SECTION 2. The City Council has determined that the
public conveni- e and necessity require the reservation of
permanent easements and right of way for all existing franchises
and renewals thereof pursuant to Streets and Highways Code Sec-
tions 8330 and 8331, and such permanent easements and right of
way are hereby reserved and excepted.
SECTION 3. That the City Clerk of the City of Rosemead
shall cause a certified copy of this Resolution and order to be
recorded in the office of the Recorder of the County of Los Angeles.
PASSED, APPROVED AND ADOPTED this 8th day of June, 1971.
