CC - 1995-33 - Approving Program Supplement no. 006RESOLUTION NO. 95-33 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING PROGRAM SUPPLEMENT NO. 006 WITH THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR THE 1994/95 ASPHALT CONCRETE OVERLAY PROJECT WHEREAS, the City Council of the City of Rosemead has entered into State- Local Entity Master Agreement No. SLTPP-5358 for StateShare Funds; and WHEREAS, the State of California, through its Department of Transportation, has presented Program Supplement No. 006 for resurfacing various residential City streets as listed in Exhibit "A"; and WHEREAS, the City of Rosemead understands that the availability of State Share Funds will be determined by the California State Legislature and accepts any increase in local funding; and WHEREAS, a Final Audit must be completed and transmitted to the Caltran's 6 District Local Streets and Roads Engineer by December 30, 1996. .,i NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Rosemead approves Program Supplement No. 006 to the State-Local Entity Master Agreement No. SLTPP-5358. SECTION 2. I 1 No: None; Absent: None; Abstain: None City `C1 rk: • • RESOLUTION NO. 95-34 A RESOLUTION OF THE CITY OF ROSEMEAD, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089 WHEREAS, the Los Angeles County Metropolitan Transportation Authority ("MTA"), acting as the Congestion Management Agency for Los Angeles County, adopted the Congestion Management Program on November 17, 1993; and WHEREAS, the adopted CMP requires that MTA annually determine that the County and cities within the County are conforming to all CMP requirements; and WHEREAS, the adopted CMP requires submittal to the MTA of the CMP local implementation report by September 1, 1995; and WHEREAS, the City Council held a noticed public hearing on August 22, 1995. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City has taken all of the following actions, and that the City is in conformance with all applicable requirements of the 1993 CMP. By June 15, 1995, the City conducted annual traffic counts and calculated levels of service for selected arterial intersections, consistent with the requirements identified in the CMP Highway and Roadway System Chapter. The City has locally adopted and continues to implement a transportation demand management ordinance, consistent with the minimum requirements identified in the CMP Transportation Demand Management Chapter. The City has locally adopted and continues to implement a land use analysis program, consistent with the minimum requirements identified in the CMP Land Use Analysis Program Chapter. The City has adopted a Local Implementation Report, attached hereto and made a part hereof, consistent with the requirements identified in the CMP. This report balances traffic congestion impacts due to growth within the City with transportation improvements, and demonstrates that the City is meeting its responsibilities under the Countywide Deficiency Plan. • 0 SECTION 2. That the City Clerk shall certify to the adoption of this Resolution and shall forward a copy of this Resolution to the Los Angeles County Metropolitan Transportation Authority. NOW, THEREFORE, the Rosemead City Council resolves as follows: Section 1. The Rosemead City Council finds, determines, and declares: (a) The payment by the Rosemead Redevelopment Agency for the asphalt concrete overlay and street lighting improvements project on various streets within and adjacent to Project Area No. 1, as depicted in Exhibit "A" and Exhibit "I3", respectively, is of benefit to the Project Area. This finding is based on the fact that the street improvements made at the various locations indicated on Exhibit "A" and Exhibit "H' will serve to improve the aesthetic appearance and infrastructure within and adjacent to Project Area No. 1. (b) That there are no other reasonable means of financing such buildings, facilities, structures or other improvements available to the community. Although the City has a General Fund surplus, the uncertainty of continuing municipal revenue sources militates against the depletion of the existing reserves until such time as revenue sources and major required expenditures are stabilized. (c) The payment by the Rosemead Redevelopment Agency for the specified asphalt concrete overlay and street lighting improvements will eliminate blighting conditions within the project area by providing a "new" street appearance and improved lighting on roadways within and adjacent to the project area, thus enhancing the value of abutting properties.
