CC - 1995-36 - Approving General Plan Amendment 95-010 RESOLUTION NO. 95-36 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING GENERAL PLAN AMENDMENT 95-01, AMENDING THE LAND USE MAP OF THE GENERAL PLAN TO CHANGE THE DESIGNATION FROM "OFFICE/LIGHT INDUSTRIAL" TO "MIXED USE RESIDENTIAL/COMMERCIAL" FOR A 1.45 ACRE SITE LOCATED AT 7503-7527 HELLMAN AVENUE, ROSEMEAD (APN: 5286-008-008 & 020, PLUS 5286-009-024, 027, & 028). WHEREAS, Mr. Chi-An Wang, 5923 N. Oak Avenue, Temple City, California, 91780, filed an application requesting an amendment to the general plan land use designation for property located at 7503-7527 Hellman Avenue; and WHEREAS, the proposed amendment is part of a proposed Planned Development (PD 95-01) which has been designed to create eleven (11) single family lots; and WHEREAS, the City Council desires to promote single family home ownership; and WHEREAS, on June 22, 1995, an initial study for the proposed general plan amendment was completed; and WHEREAS, on June 22 and July 27, 1995, 55 notices were mailed to property owners within 300-feet of the subject property, ten (10) notices were posted in public locations throughout the city, and a notice was published in the San Gabriel Valley Tribune noticing the public comment period and the time and place for a public hearing pursuant to California Government Code Section 65091(a)(3); and WHEREAS, on July 17, 1995, the Planning Commission held a public hearing to receive testimony and voted to recommend City Council approval of General Plan Amendment No. 95-01; and WHEREAS, on August 7, 1995 the Planning Commission adopted Resolution 95-23, recommending City Council approval of General Plan Amendment 95-01; and WHEREAS, on August 8, 1995, the City Council held a public hearing to receive testimony relative to General Plan Amendment 95-01; and WHEREAS, the City Council has sufficiently considered all testimony presented to make the following determination. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemead as follows: 0 0 Resolution No. 95-36 General Plan Amendment 95-01 Page 2 of 3 SECTION 1. The City Council HEREBY DETERMINES that a Mitigated Negative Declaration shall be adopted. An initial study was completed to analyze potential environmental impacts pursuant to the California Environmental Quality Act (CEQA), and guidelines for the implementation of CEQA (Rosemead Resolution 75-28). This study found that there would be potential environmental impacts that could be mitigated to a level of insignificance. The initial study and associated mitigation measures for Planned Development 95-01 are attached hereto and incorporated herein by reference. SECTION 2. The City Council HEREBY FINDS, DETERMINES AND DECLARES that the proposed amendment is consistent with the goals and objectives of the City. The surrounding land uses are residential with higher density along Hellman Avenue and a medium density designation to the north. The site had been designated for office use as part of an existing hospital located on the south side of Hellman Avenue. The hospital has reduced its size and no longer needs or desires use of this site for medical offices. Hellman Avenue is a residential collector street that would not be suitable for other types of commercial or office development. The "Mixed Use Commercial/ Residential" designation is consistent with the land use designation north of the site. SECTION 3. The City Council HEREBY RECOMMENDS APPROVAL of General Plan Amendment No. 95-01, amending the land use map of the general plan to change the designation from "Office/Light Industrial" to "Mixed Use Commercial/Residential" for properties located at 7503-7527 Hellman Avenue (APNs: 5286-008-008 & 020, plus 5286-009-024, 027 & 028), and said map shall be amended to note said change thereon. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and shall cause same to be published as required by law. PASSED AND APPROVED this .day of August, 1995.
