A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD ESTABLISHING A SERVICE CHARGE
FOR RELEASE OF STORED OR IMPOUNDED VEHICLES
WHEREAS, the Los Angeles County Sheriff's Department impounds
and stores vehicles within the City of Rosemead; and
WHEREAS, all related costs for impound, storage, and release of
said vehicles are paid by the City of Rosemead under contract with
the Los Angeles County Sheriff's Department; and
WHEREAS, $65.00 has been determined to be the reasonable cost
associated with impounding and storing vehicles in the City of
Rosemead, and does not exceed the estimated cost for providing such
services; and
WHEREAS, the costs would be imposed for impounding and storing
of vehicles that are abandoned, on the street with expired
registration of more than one year, creating a safety hazard,
blocking driveways and streets, having more than five outstanding
parking tickets, being operated by an unlicensed driver or a driver
with a suspended license, and when the driver is arrested and there
is no safe or legal way to park the vehicle; and
WHEREAS, the negligent or illegal operation of the vehicle by
the driver or registered owner results in impounding or storing; and
WHEREAS, no fees shall be charged for recovered stolen vehicles;
and,
WHEREAS, the laws of the State of California authorize cities to
adopt and implement rates, fees, and/or charges for municipal
services, provided that such rates, fees, and/or charges do not
exceed the estimated reasonable cost of providing such services; and
WHEREAS, the City of Rosemead desires to recover such reasonable
costs associated with impounding and storing vehicles resulting from
hazardous, illegal, or negligent actions.
NOW, THEREFORE, the City Council of the City of Rosemead
resolves as follows:
Section 1. That the City of Rosemead direct its administrative
staff to coordinate with Los Angeles County Sheriff's Department
administrative staff, Temple Station, to implement a $65.00 service
charge for the release of stored or impounded vehicles.
