CC - 1995-44 - Opposing sections of the CA Constitution Revision CommissionRESOLUTION NO.95-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD OPPOSING SPECIFIC SECTIONS OF THE PRELIMINARY RECOMMENDATIONS OF THE CALIFORNIA CONSTITUTION REVISION COMMISSION WHEREAS, the California Constitution Revision Commission (CRC) was formed for the specific purpose of making recommendations to change the structure of government and the delivery of public services in the State of California; and WHEREAS, the City of Rosemead supports the general effort to review potential changes in the way government functions in California, but has specific objections to some of the preliminary recommendations of the CRC; and WHEREAS, the CRC's preliminary recommendation to shorten the period in which bills must be in print before being acted upon by the California Legislature from thirty (30) to ten (10) days does not allow enough time for proper public scrutiny of measures being considered by the State Legislature; and WHEREAS, the CRC recommendation to allow the Legislature to amend initiatives statutorily after a period of four (4) years would serve to weaken a Constitutionally protected right of the people to effect necessary change; and WHEREAS, the CRC recommendation to create a legislative process to review, amend and enact initiatives that have qualified for the ballot, and allow the Legislature to preempt such measures in certain cases, would substantially undermine the ability of the people to act when the Legislature fails to address the will of the people; and WHEREAS, the CRC proposal to allow implementation of the State budget with a single Multiple Subject Implementation Bill would create a situation in which single issue advocates in the Legislature and/or the Governor's office may make it even more difficult to approve and implement the State Budget; and WHEREAS, the CRC recommendation to allow unified K-12 school districts to raise additional revenues through increased sales taxes with a majority vote of the people runs counter to the clear mandate of California residents to limit and reduce taxation whenever possible; and WHEREAS, the CRC's call for a unicameral legislature represents the antithesis to the system of checks and balances created by our forefathers. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ROSEMEAD HAS DETERMINED POLICY IN OPPOSITION TO THE FOLLOWING PRELIMINARY RECOMMENDATIONS OF THE CALIFORNIA CONSTITUTION REVISION COMMISSION (CRC): 1. The City of Rosemead opposes the recommendation of the CRC to shorten the period during which bills must be "in print' 'before being acted upon by the California Legislature from thirty (30) days to ten (10) days. 2. The City of Rosemead opposes the recommendation of the CRC to allow the Legislature, with gubernatorial consent, to amend statutory initiatives after being in effect for a period of four (4) years. The City of Rosemead opposes the recommendation of the CRC to create a legislative process for the review, amendment and enactment of initiatives that have qualified for the ballot, thus granting power to the Legislature to preempt such measures if they have been adjudged by the State Attorney General and Secretary of State as being "substantially similar" to the legislative proposal. 4. The City of Rosemead opposes the recommendation of the CRC to allow a Multiple Subject Implementation Bill to permit the California Legislature to pass and the Governor to sign a single budget implementation bill. 5. The City of Rosemead opposes the recommendation of the CRC allow unified K-12 school districts to raise additional revenues through countywide sales tax increases, up to cent, with a majority vote of the people. 6. The City of Rosemead opposes the recommendation of the CRC to shift from a bicameral to a unicameral legislature with 121 members serving no more than three (3) four (4) year terms.
