CC - 1994-50 - Denying Zone changeRESOLUTION NO. 94-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD DENYING BOTH A ZONE CHANGE REQUEST FOR A ZONE CHANGE TO P-D AND THE ACCOMPANYING DEVELOPMENT PLAN FOR PROPERTY LOCATED AT 8723-8729 MISSION DRIVE, ROSEMEAD (ZONE CHANGE CASE 93-198) Section 1. The City Council finds, determines and declares: (a) An application for a change of zone was duly filed by the property owner for property located at 8723 through 8729 Mission Drive and more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and (b) A public hearing was held before the Rosemead Planning Commission on August 1, 1994, at which time the Commission recommended approval of the zone change request and development.plan; and (c) That on September 13, 1994, the City Council held a duly noticed public hearing on the zone change request and development plan; and (d) Pursuant to Section 9120.15 of the Rosemead Municipal Code, the previously approved development plan for the property at 8723 through 8729 Mission Drive is null and void on account of the failure to implement the plan within one year of its approval in 1990. Section 2. The City Council has considered the proposed Negative Declaration together with all comments, both written and oral, received during the public review and public hearing process. The City Council hereby approves the Negative Declaration for Zone Change 93-198 with the finding that there is no substantial evidence that the project will have a significant effect on the environment. The approval of the Negative Declaration is made upon the basis of the Initial Study, all comments received and staff responses to comments. Section 3. The City Council hereby denies Zone Change 93-198 and further denies the development plan that accompanied the Zone Change Request. The City Council finds and determines that while the P-D ordinance is designed to allow deviations from the established zoning development standards to obtain quality large-scale projects, this particular project has too many small lots and does not provide sufficient enhancements in terms of common-use amenities that would justify said small lots. Section 4. The City Clerk shall certify to the adoption of this Resolution and cause the same to be processed according to State law.
