CC - 1993-02 - Establishing Drug Free Workforce and imposing ProceduresRESOLUTION NO. 93-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A DRUG-FREE WORKPLACE AND IMPOSING PROCEDURES TO IMPLEMENT SAME WHEREAS, Federal law (41 U.S.C. § 701 et seq.) requires that recipients of Federal grants publish a statement containing several provisions; and WHEREAS, the City of Rosemead is a recipient of Federal grants. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD HEREBY RESOLVES AS FOLLOWS: SECTION 1. All employees of the City of Rosemead are hereby notified that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the workplace and as a condition of employment under any Federal grant to the City, all employees shall: (i) Abide by the terms of this statement; and (ii) Notify the employer in writing of any criminal drug statute conviction for a violation occurring in the workplace no later than five calendar days after such conviction. SECTION 2. The following procedures will be followed by the City in compliance with 41 U.S.C. 702 and 703: (a) An ongoing drug-free awareness program is 'Res. 93-02 Page 3 E (ii) Require such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposed by a Federal, State or local health, law enforcement, or other appropriate agency. SECTION 3. The City Clerk shall certify to the adoption of this.Resolution. PASSED, APPROVED and ADOPTED by the Rosemead City Council on this 12thday of January 1993.
